Notice is hereby given that the Collier County Board of County Commissioners and the
South Florida Water Management District will hold a meeting Wednesday, Jan. 10 at 4
p.m. at the Hilton Towers, 5111 Tamiami Trail North, Naples.
In regard to the public meeting:
AU interested parties are invited to attend, and to register to speak and to submit their
objections, if any, in writing, to the board/committee prior to the meeting if applicable.
All registered public speakers will be limited to three minutes unless permission for
additional time is granted by the chairman.
Collier County Ordinance No. 2004-05, as amended, requires that all lobbyists shall,
before engaging in any lobbying activities (including, but not limited to, addressing the
Board of County Commissioners, an advisory board or quasi-judicial board), register
with the Clerk to the Board at the Board Minutes and Records Department.

Dear Mr. Mudd,
Pursuant to discussion with County staff, this letter serves as the South Aorlda Water
Management District's (District) proposal for discussion at the Joint Board Meeting
scheduled between the District's Governing Board and the Board of County
Commissioners on January 10. 2007 at 4 P.M.
Collier Countv Settlement prooosal
1. The District will immediately deed the title of the 628 acre Lake Trafford
parcel to the COUnty with the District retaining a construction easement to
complete the dredging of the Lake and earthwot1< associated with the
development of the A TV site.
2. The District will retain a consultant to design an A TV pat1< similar to the
conceptual design developed by the County (IBIS).
3. The District will obtain permits and the District will construct the earthwork
consistent with the approved design and applicable required regulatory
protections.
4. The County will provide management oversite of the design and
construction of the site In conjunction with the District.
5. The County will handle the zoning and comprehensive plan process for
the site.
6. The County will be responsible for the operation of the site once
construction is completed.
7. The District will additionally provide a temporary leased 150 acre site more
or less to the County to operate as an ATV site until the site is
constructed.
. The site will be open two weekends a month, daylight hours only.
. The District will provide funding to the County for onsile
management and the lease of the land.
. The County will manage the site.

8. The County win agree to amend the Memorandum of Understanding
between the State, District and County to identify the Division of Forestry
as the Agency responsible for the access and maintenance of roads as
outlined in the agreement, removing the District as a responsible party.

Collier County, a political subdivision of the State of florida, (hereinafter .COUNTY'").

WHEREAS. DISTRICT and STATE haVe aoqulred certain land located In ColIJer
County In an area known as the Southam Golden Gate Estates for wetlands restoration
and 8S part of the Everglades Restoration Project (hereinafter .Project"); and
WHEREAS, COUNTY holds certain right-of-way easements in trust for the public
by virtue of the subdivision plat dedIcations and other ~1s wfthin this iuea and has.
()WI( B thirty year period. constructlld bridges and improved and maintained lhese
roadways for 111& benefit of !he public; and
WHEREAS, COUNTY has expGnded mllITont of taxpayer's dollSJ9 far these
Improvements and for the maintenance of these roadways and has estimated the va/ue
of these easements and the improvements thentupOn at approximately 38 million
dollars and depreciated sam. to 17.6 million dollars; and
WHEREAS, STATE has petitioned the COUNTY to relinquish ell Interest and right
it hu In these roadways to the state of Florida for purpose, of its project; and
WHEReAS, COUNTY is desirous of &Sllsting in the project and has scheduled
and noticed a public hearing for consideration by the Board of County Commlsslanens of
the vacation of these roadways; and
WHEREAS, the vacation of these roadwaYS in furtherance of this Project will
enhance 1I1e sunounding wetlands and (acDifate the preservation of weUands rn the
Southem Golden Gates Eslates; and

WHEREAS, the Big Oypreas Basin. a sub.district of the OISTRICT, (hereinafter
referred to as the -Bee.) suppor18 the DISTRICT and STATE and is committed to
meet1ng the obllgatiol"S contBlned herein but Is without statutory authority to contract
independently of the DISTRICT; I!U1d
WHEREAS, DISTRICT. BCB, and STATE to the extent it may have an Interest In
lands managed by DISTRICT or BCe and Identified far thl. pUfPOS8, BIB willing to
transfer to COUNTY 640 acre. of contIgUous unImproved land to be used for Coller
County residents for recreational purpose. In exchange for the vacatron of these
roadways; and
WHEREAS, the acquisition of 840 acre$, whether directly or Indirectly by
DISTRICT, or Bea for the purposes set forth herein. will further 1his project and
constitutes a public purpose as contemplated by Chapter 373; and
WHEREAS, because of the Importance of the MC:OnclBI'Y canal system to the
overall water management mission of the sce, the DISTRICT, through Ih8 budget of
the BCB, is willing to dedicat8 $1 million from the BCB budget to callier County for
maJrnananco. repair and operation of the secondary canal system In Collier County over
a period of CwenIy yeats or until the District assumes all responsibility for rile operation
and maintenance of the secondary canal syslem, whichever occurs flrstj end
Wl-EREAS. Ihe parties desire to enter into a binding agreement which wiJ provide
for and govern the transfer or property and allocation of fw1CIs if the Cowrty vacates,
terminal9s or releaSeS ItS Interest and right In celtaln roadways located 'Wi.thIn the
Southern Golden Gate Eslales; and
WHEREAS. the parties intend thal1he COUNTY Will enter Into this Agreement if
and only if the COUNTY, after having considered the requesl for vacation at a public
meemg. haS delennined fhal it WIll approve the request and adopt a resolution vacating
and renouncing all Interest In the roadways delCribed herein.
NOW. THEREFORE, in consideration of the ben-'its flowing from each 10 the
other, STATE, DISTRICT, Bce and COUNTY agree 8!1 follows:
1. The above recitals are llUe and QOfT1!lIOI and are Incorporated herein as a part of
this Agreement.

and Incorporated herein, In accordance with Chapter 836. FJortda Statutes.
3. OISTRICT, on behalf of and through the budget of Its Big Cypress Basin, win
dgdlcate annually 0119 minion dollars of ils funding annually to the operation,
maintenance and repelir of the secondary canal aystem In Collier County. This
allocation of dollaP.J will commence in budget year 2()04 and continue for a period of

Cypress Basin Board and DISTRICT Governing Board annual budgetary appropriatIon.
In the avent the DISTRICT does not approve funding for any subsequent fiscal year.

make every reasonable effort to meet this funding obligation every year, and shall not
unreasonably withheld allocaflon of this monetary commitment In ItS annual budget.
The parties agree lI1at this paragraph will constitute a severable portion of thIs
Agreement so that the failure of DISTRICT 10 fulflll thIs provision will not tsrmlna1e or
release DISTRICT and STATE from olher obllgatlons let forth in thIs Agreement.
4. DISTRICT and/or BCB will convey, or cause to be conveyed, at no cost to
COUNTY, fee simple interest to 640 contiguous acres, more and less, of unimproved
land to COUNTY no later 'than October 1. 2005. The .Iand shall be suitable fOr
recreational purposes, including, but not limttecl to, recreationaJ ATV use. and must be
accep1able to the COUNTY. The COUNTY agrees not to u~asonably withhold
approval of the land tendered by the DISTRICT.
5. DISTRICT and BCB ackJ1Ow\'edge and agree that ,he dedica:tion of dollars for the
maintenance and repair of 1he secondary canal system If1 Collier County and for the
acquisition of 640 acres of land. as both .8 contemplated bV this Agreement, are
statutorily-authorized expenditures.
6. The COUNTY will reJeaae. tarmlnata or dIsclaim 8ny Interest it has in the rights-of-
way In portions of that roadway known aa Jan.. Scenic Drive (commencing just south
of the Harmon Brothers rock pit and continuing to its northemmost terminus) as more
particularly described in Exhibit -B" attached hereto. AJJ a condition of this
abandonment of Janes Scenic Drive, STATE and OISTRICT agree to provk:le access
from Janes Scenic Drive to Lee County Electric for purposes 01 maintaIning Its facilities
and. if requested by utility, STATE will provIde a replacement easement of suffICient
width for the maintenance, repelr and operatIon of lIS existing facRiUes. Moreover
STA1E and DISTRICT agree to provide aCCS88 to and from Janes ScenIc Drive to 'the
City of Everglades welrfield as such access ourrently exJsts. County acknowledges that
not all portions of Janes Scenic Drive will revert to STATE or DISTRICT after ~OUNTY
vacates Janas Scenic Drive, and that STATE and D\STRICT shall have no duty to
perform under the provisions of this paragrapt1 e as to those portions of the right-of-way
not under their ownership and control subsequent to the vacation of the rlgnts-of-way.
7. COUNTY will release, terminate or dIsclaim any interest It has In the Miller
Boulevard Extension, more partlcu!a.rty described In Exhibit "e: and agrees to execute

Collier County, Florkia, pursuant to which each party ahall bear Its own costs and
attorneys fees and I'&leaslil the other of any and all related claims.
a. The STATE and DISTRICT agree to maintaIn UtoH roadways contained within the
project area and identlfied en Exhibit -C::, attached hereto, In the follo'Nlng manner:
ea) All 'prim8JY. all weather roads" (represented by sorid line on Exhiblt"Cj wnl
be maintained above-grade and wiU be open to the traveling public 24-hours a day,
seven days a week.
(b) "Secondary. dry season" roads (represented by a. dashed Une on Exhibit -c")
wtll be :stabilized and maintained at or befow grade unCI v.ill be epen to the general
public wealhet permitfing, as nolictld by U1e OMsion of Forestry. For those landownem
of Improved property whOse only access is via one of these secondary dry season
roads. they win be provided ecress 24-hours a day, seven days a week.
Ce} Notwithstanding the foregoing. otSTRlCT agrees that safe vehicular access
Will be provided to aJi homeowners WIthin 1tle Project Area at all times.
(d) STATE and DISTRICT will provide access to Sprint and Florida Power &
Ught from those roadways designated as "primary, all weather roads" to all telephone
and electric facilities located within these rights-of.way. If requested, STATE will
provide a replacement easement to Sprint and FPL ot sufficient dimensions to provide
fOr the continued maintenance, repair and operation 0'1 these utlTrlies. This prevision will
not be construed as requiring the grantIng of easements or licenses fO( the expansion of
such facilities. County acknowledges thai not all portions of Janes Scenic Drive will
revert to STATE or DISTRiCT after COUNTY vacate8 Janes Scenic Drive, anCl that
STATE or DISTRICT shan haVe no duty to perform under the provisions of 1his
paragraph B(d) as to those portions of the rlght..of.way not under their ownership end
control subsequent te the vacation of the rights-Of-way. I
9. DISTRICT and/or STATE agree that the general public will be given access for
recreatIonal uses on lands wlthfn me Project Area and tn ."e adJofnIng picayune Fores'.
As part of this commi1ment the Picayune Stnmd State Foreet Recreation Program will
provide for dispersed recreational opportunttlea B11d will recognize tJ1e following uses as
comparlble wi1h resource protection and passive r.creatlon~ hOrseback riding; fIshing;
off-road bicycling; t1iklng; primitiVe camping; !lome types of hunting; wildlife viewing and
nature study. The DivisIon of Forestry Is currently evaluating the potentlat of an off.
highway vehJcle area and a gun range. All us.. must be consistent with the resource
management plan, and U5e best management practtces (BMPs) to protec1 the

10. STATE win provide CoBler County with access to the gats north of 1-15 at
EvergladeS Boulevard either by providIng key ace... or by el.bllshlng a protocol
suitable to permit emergency access for emergency medicsl and fire rescue and control
persDnnel, equipment and vehicles from 1..75 to Everglades BouJevard.
11. The laws of the State of Florida shall govem 811 aspects 01 this Agreement.
12. By executlon of this Agreement, the COUNTY. DISTRICT and S1'ATE are not
assuming any liabilities or dulie! M1atsoever, for the olher, which may then exiSt or
have previously accrued to third parties, Including, but no1 Rmited to, personal injury, property
damage. InversB condemnation. etc-. resulting rrom either party's ownership, operation or
contrO\ evel \he propertv that is the subject of \hia Agreement.
13. This A!J9Bment and the terms and pIOIIIslons hereof shall be effective as of the
date this Agreement Is executed by aN parties and shall inure to the benett 01 and be
binding upon the parties hereto and their respective successors andlDr assignees, whenever
the context so requires or admits-
14. The effective date of this Agreement wltl be the date last. signed by one of the
parties.
15. OISTRlCT and STATE, by signing below, repoMent that &ach has the authodty to
enter Into this Agreement, and that the performance contemplated by this Agreement is
lawful, serves a public purpose and provides a public benefit. 1n the event any portion
of this Agreement shall be held Invalid or unlawfUl by a court of oompetent jurtsdiotlon,
such portlon shall be deemed El seperat. and severable provfslon. and suoh holding will
not affect the validity of the remaining portions of this Agreement. The STATE's
obligation to pay under tI1e provisions of this agreement IS contingent upon an 8llnuEH
appropriation by the Legislature.
