COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
AMENDING ORDINANCE NUMBER 04-41, AS AMENDED,
THE COLLIER COUNTY LAND DEVELOPMENT CODE,
WHICH INCLUDES THE COMPREHENSIVE ZONING
REGULATIONS FOR THE UNINCORPORATED AREA OF
COLLIER COUNTY, FLORIDA, BY AMENDING THE
APPROPRIATE ZONING ATLAS MAP OR MAPS BY
CHANGING THE ZONING CLASSIFICATION OF THE
HEREIN DESCRIBED REAL PROPERTY FROM THE
RESIDENTIAL SINGLE FAMILY-4 (RSF-4) ZONING
DISTRICT TO A RESIDENTIAL PLANNED UNIT
DEVELOPMENT (RPUD) ZONING DISTRICT FOR A
PROJECT KNOWN AS IMMOKALEE FAIR HOUSING
ALLIANCE INC. RPUD. THE PROJECT WILL ALLOW UP
TO 128 RESIDENTIAL DWELLING UNITS. THE
PROPERTY IS LOCATED AT THE NORTHWEST
CORNER OF LAKE TRAFFORD ROAD AND NORTH 19TH
STREET, IMMOKALEE, IN SECTION 32, TOWNSHIP 46
SOUTH, RANGE 29 EAST, COLLIER COUNTY, FLORIDA,
CONSISTING OF 9.52± ACRES; AND BY PROVIDING AN
EFFECTIVE DATE. (PL20190000734)
WHEREAS, Andres Boral PE of Boral Engineering and Design, Inc., representing the
Immokalee Fair Housing Alliance Inc., petitioned the Board of County Commissioners to change
the zoning classification of the herein described real property.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
SECTION ONE:
The zoning classification of the herein described real property located in Section 32,
Township 46 South, Range 29 East, Collier County, Florida, is changed from a Residential
Single Family-4 (RSF-4) Zoning District to a Residential Planned Unit Development (RPUD)
Zoning District for a project known as the Immokalee Fair Housing Alliance Inc. RPUD, in
accordance with Exhibits A through F, attached hereto and incorporated herein and by reference
made part hereof. The appropriate zoning atlas map or maps, as described in Ordinance Number
[19-CPS-01924/1555235/1]113

04-41, as amended, the Collier County Land Development Code, is/are hereby amended
accordingly.
SECTION TWO:
This Ordinance shall become effective upon filing with the Department of State.

Exhibit A
The Immokalee Fair Housing Alliance, Inc. RPUD is a total of 9.52 acres that will be developed with 128
dwelling units. This amounts to a gross density of 13.44 units per acre. This is an affordable housing
project(see Exhibit F).
TRACT A: Permitted Uses
No building or structure, or part thereof, shall be erected, altered or used, in whole or in part, for
other than the following:
1. Principal Uses:
a. Multi-family dwelling units;
b. Any other principal use, which is comparable in nature with the foregoing listed of
permitted principal uses, determined by the Board of Zoning Appeals ("BZA") or the
Hearing Examiner("HEX") by the process outlined in the Land Development Code
("LDC").
2. Accessory Uses:
a. Community center shall be for residents and their guests
b. Pre-school and after school care shall be for residents and their guests
c. Laundry rooms
d. Solid waste enclosures
e. Garages
f. Carports
g. Recreation facilities, including but not limited to, swimming pools, tennis courts,
playground equipment or other amenities intended for residents and their guests
h. Essential services, in accordance with Section 2.01.03 of the LDC
i. Any other use that is comparable in nature with the foregoing list permitted uses, as
determined by the BZA according to the process described in the LDC.

Development of the Immokalee Fair Housing Alliance, Inc. RPUD shall be in accordance with the
contents of this Ordinance and applicable sections of the LDC and Growth Management Plan (GMP) in
effect at the time of issuance of any development order, such as, but not limited to, final subdivision plat,
site development plan, excavation permit and preliminary work authorization, to which such regulation
relate.

Deviations from the Land Development Code:
1. Parking:
Seeking a deviation from Section 4.05.04.G of the Collier County LDC which requires one
space per unit plus one visitor parking space per unit for dwelling units with two bedrooms or
larger, to instead reduce the amount of parking required to 1.5 space per dwelling unit of two
bedrooms or larger.

List of Development Commitments
1. Affordable Housing:
A. As documented in the Affordable Housing Density Bonus Agreement, the developer has
agreed to construct 128 rental units for residents in or below the low income category
(60% or less of County Median Income).
2. Transportation:
A. The maximum total daily trip generation for the PUD shall not exceed 40 two-way PM
peak hour net trips based on the use codes in the ITE Manual on trip generation rates in
effect at the time of application for SDP/SDPA or subdivision plat approval."
3. Environmental:
A. This site contained 9.41 Acres of native vegetation (not including easement areas).
Collier County LDC 3.05.07.b1 requires 15%to be preserved or 1.41 acres.
B. A management plan for the entire project shall be submitted in accordance with the
requirements and procedures of the LDC for Scrub Jays. The management plan shall be
submitted prior to development of the first phase of the project.
C. Preserve may be used to satisfy the buffer requirements after removal of exotics and
supplemental planting in accordance with LDC Section 3.05.07. In order to ensure that
the requirements of a Type'B' Buffer are met, a 6'wide buffer reservation has been
provided on the Master Plan. In the event that the preserve does not meet buffer
requirements after removal of exotics and supplemental planting, plantings will be
provided in the 6'wide reservation to meet the buffer requirements. The type, size, and
number of such plantings, if necessary,will be determined at time of initial SDP and
included on the landscape plans for the SDP.
4. Planning
A. Monitor the excavation by a certified archaeologist.
