EXECUTIVE SUMMARY
Recommendation to approve a Fiber Cable Easement between Collier County and The
District School Board of Collier County, Florida, at no cost to the County.
OBJECTIVE: To approve a Fiber Cable Easement between Collier County (County) and The District
School Board of Collier County, Florida (School Board).
CONSIDERATIONS: The School Board has requested a Fiber Cable Easement from County on
County-owned property on the north side of Lely Cultural Parkway where the Bureau of Emergency
Management facilities (ESC) are located. The Fiber Cable Easement will facilitate the installation of
fiber cable to connect the Lely Elementary School to the County’s ESC Building to the west to improve
the performance of emergency first responder’s radio systems at all District school sites.
The proposed pathway for the fiber cable installation will not impact the Conservation Easements that
exist on both the School Board property, and the County’s property.
The attached document has been reviewed and approved by the County Attorney’s Office.
FISCAL IMPACT: There is no cost to the County.
GROWTH MANAGEMENT IMPACT: There is no Growth Management Impact.
LEGAL CONSIDERATIONS: This item has been approved for form and legality and requires
majority vote for approval. - JAB
RECOMMENDATION: Staff is recommending that the Board of County Commissioners:
1) Approve and authorize the Chairman to execute the Fiber Cable Easement; and
2) Direct the County Manager or his designee to record the Fiber Cable Easement in the
Public Records of Collier County, Florida.

FIBER CABLE EASEMENT
THIS FIBER CABLE EASEMENT, made and entered into this ____ day of
2020, by COLLIER COUNTY, a political subdivision of the State
of Florida, whose mailing address is 3335 Tamiami Trail East, Suite 101, Naples,
Florida 34112, its successors and assigns, as Grantor to THE DISTRICT SCHOOL
BOARD OF COLLIER COUNTY, FLORIDA, whose mailing address is 5775 Osceola
Trail, Naples, FL 34109-0919, as Grantee.
(Wherever used herein the terms "Granto/'and "Grantee" include all the parties to this instrument and their respective heirs,
legal representatives, successors and assigns.)
WITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby
acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, a
perpetual, non-exclusive easement, license, and privilege for fiber cable facilities and
maintenance purposes, on the following described lands located in Collier County,
Florida, to wit:
See attached Exhibit "A" which is
incorporated herein by reference.
Subject to easements, restrictions, and reservations of record.
THIS IS NOT HOMESTEAD PROPERTY
TO HAVE AND TO HOLD the same unto the Grantee, together with the right to enter
upon said land, place, excavate, and take materials for the purpose of constructing,
operating and maintaining fiber cable facilities and maintenance thereon. Grantor and
Grantee are used for singular or plural, as the context requires. The easement granted
herein shall constitute easements running with the land and shall burden the lands
described above.
