Agenda 09/08/2020 Item #16A25 (LDC Amendment)09/08/2020 EXECUTIVE SUMMARY Recommendation to hear a Land Development Code Amendment at two regularly scheduled daytime hearings and waive the nighttime hearing requirement. OBJECTIVE: To waive the requirement to hold a nighttime hearing and present to the Board of County Commissioners (Board) a Land Development Code (LDC) amendment at two regularly scheduled daytime hearings on October 13, 2020 and October 27, 2020. CONSIDERATIONS: This LDC amendment is related to self-storage buildings. On September 10, 2019, staff brought an amendment to the Board that proposed separation requirements between self- storage buildings on properties located within a particular area of U.S. 41. However, the Board voted against advertising such an ordinance. Instead, on December 10, 2019, the Board directed staff to draft an ordinance to incentivize a mix of uses rather than creating separation standards for self -storage buildings. The proposed amendment represents such an ordinance, by allowing self-storage buildings as permitted uses on C-4-zoned lands if such self-storage uses are combined in the same building (on the ground floor) with at least one other permitted commercial use. Since this LDC amendment includes a proposed change to the list of permitted and conditional uses on lands that potentially can be greater than 10 acres, LDC section 10.03.06 K requires two Board hearings with at least one hearing held after 5:00 p.m. on a weekday. However, the Board may elect to conduct the hearing at another time of day by a supermajority vote. If the Board elects not to waive the night hearing, one of the proposed hearings will need to occur after 5:00 p.m. Prior to the Board’s review, this LDC amendment (LDCA-PL20200000359) will be reviewed by the Collier County Planning Commission (CCPC) on Wednesday, September 9, 2020, at 5:05 p.m. It is staff's opinion that the public will have an opportunity to address their concerns at this nighttime hearing, and that a nighttime hearing by the Board is not necessary. FISCAL IMPACT: There are no fiscal impacts associated with this action. GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this action. LEGAL CONSIDERATIONS: This item is approved as to form and legality, and it requires a majority vote for Board approval. (HFAC) RECOMMENDATION: To hold two regularly scheduled daytime hearings on October 13, 2020 and October 27, 2020. This option waives the night meeting requirement as provided for in LDC section 10.03.06 K.
