EXECUTIVE SUMMARY
Recommendation to approve the release of two code enforcement liens, with an accrued value of
$220,454.65 for payment of $1,454.65 in the code enforcement action titled, Board of County
Commissioners v. U.S. Bank Trust NA, related to the property located at 4265 20th Place SW,
Collier County, Florida.
OBJECTIVE: That the Board of County Commissioners accepts an offer to release two code
enforcement liens, with an accrued value of $220,454.65 for payment of $1,454.65 in relation to Code
Enforcement Special Magistrate Case Nos. CEPM20170004345 and CEV20170004426.
CONSIDERATIONS: The Code Enforcement Special Magistrate ordered the imposition of two liens
against U.S. Bank Trust NA, in Case Nos. CEPM20170004345 and CEV20170004426, for code
violations at the property located at 4265 20th Place S.W. The violations consisted of a commercial
vehicle parked on the property, a dilapidated fence, and an unsecured vacant dwelling. The lien in Case
No. CEPM20170004345 was recorded in the Official Records on August 21, 2018, at O.R. Book 5544,
Page 3612. The lien amount of $215,477.50 is based on 861 days of accrued fines ($250 per day from
December 7, 2017, through April 15, 2020) $215,250 plus $227.50 in operational costs. The lien in Case
No. CEV20170004426 was recorded in the Official Records on February 13, 2018, at O.R. Book 5476,
Page 2447. The lien amount of $4,997.15 is based on 95 days of accrued fines ($50 per day from
November 11, 2017, through February 13, 2018) $4,750 plus a $227.15 in operational costs. The
property was acquired by Janitzia Martinez, via Special Warranty Deed recorded on January 30, 2020.
Pursuant to Resolution No. 2012-46, a request for a reduction of fines may be considered, in part, when a
lien encumbers property under new ownership, and the new owner has diligently pursued abatement and
achieved compliance and/or when payment of the lien would impose a severe financial hardship on the
owner. The new owner took title to this property with uncorrected code violation s, with the intent of
remodeling the property and providing a home for her family. As a single parent and due to the COVID -
19 pandemic, Ms. Martinez was deemed a non-essential worker and endured a significant loss of income.
Approximately $45,000 was expended for repairs, including the replacement of windows and doors,
dumpster fees, and inspection and permit fees. It took a substantial amount of time, and extensive follow
up with County inspectors to make the home livable and brought into compliance. The property is
actively maintained, and the owner has paid $1,454.65 in settlement of fines. The owner is requesting a
waiver of $219,000 in accrued fines. There are no known code violations remaining on the property.
FISCAL IMPACT: Payment of $1,454.65 in settlement of fines has been received. If approved by the
Board, accrued fines in the amount of $219,000 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, conforms to the
Board’s policy contained in Resolution 2012-46, is approved as to form and legality, and requires
majority vote for approval. -JAK
RECOMMENDATION: To waive the remaining fines in the amount of $219,000, accept payment
amount of $1,454.65, and authorize the Chairman to sign the attached releases and satisfaction of liens for
recording in the Official Public Records.

I'm writing this letter to ask for a reduction of fines on the subject cases. My kids father
purchased this bank owned prop€rty in which state ofthe house was deplorable and being an
eyesore to the neighborhood where it was a place for vandalism and criminal acts. Evidence of
drug use was found at time entering the property not to mention the existing condition of the
house being inhabitable and with several code violations. I was closely working with county
inspector John Connetta and was able to bring the house up to code as soon as I could.
However. there is a lot of work to be done in order to make this house habitable in which will
result in substantial amount of money to be spent. Additionally, to make matters worse, due to
the COVID-19, my hours of work may be reduced since I am not considered an essential worker
and therefore my salary will be rcduced resulting in savings being carefully spent. I am
requesting this reduction in order to allow me to use my savings in fixing up the house and
making this a HOME for my kids and I. Furthermore, it will stop being an eyesore to the
neighbors and the community in general.
We have abated all violations and I am offering to pay the administrative cost of$454.65 and
$1000.00 towand fines. This offer may seem very low, but as I mentioned before I will be
spending a lot of this money into the house which will benefit both, us and the community.
Since I am a single mom this is an opportunity ofbeing able to provide my children a steady
home and something I would be able to afford.

Customer Service Rep at FGUA (Florida
Governmental Utility Authority) who stated
that the water service has been tumed off

to provide informatjon to Code Enforcement
lnvestigators as to whether or not the
elec{rical service is aclive or inactive.
Previous cases on lhis property u€re closed
due to Bankruptcy issue. The Eankruptcy
have been resolved and new case will be
opened and enforced. Therefore, a Notice of
Violation will be generated and mailed
Certified registered mail and regular US Mail

I’m writing this letter to ask for a reduction of fines on the subject cases. My kids father
purchased this bank owned property in which state of the house was deplorable and being an
eyesore to the neighborhood where it was a place for vandalism and criminal acts. Evidence of
drug use was found at time entering the property not to mention the existing condition of the
house being inhabitable and with several code violations. I was closely working with county
inspector John Connetta and was able to bring the house up to code as soon as I could.
However, there is a lot of work to be done in order to make this house habitable in which will
result in substantial amount of money to be spent. Additionally, to make matters worse, due to
the COVID-19, my hours of work may be reduced since I am not considered an essential worker
and therefore my salary will be reduced resulting in savings being carefully spent. I am
requesting this reduction in order to allow me to use my savings in fixing up the house and
making this a HOME for my kids and I. Furthermore, it will stop being an eyesore to the
neighbors and the community in general.
We have abated all violations and I am offering to pay the administrative cost of $454.65 and
$1000.00 toward fines. This offer may seem very low, but as I mentioned before I will be
spending a lot of this money into the house which will benefit both, us and the community.
Since I am a single mom this is an opportunity of being able to provide my children a steady
home and something I would be able to afford.
