EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien, with an accrued value of
$76,412.47 for payment of $612.47 in the code enforcement action titled, Board of County
Commissioners v. Lisa Coleman and Robert Boscaglia, related to property located at 1090 15th St
SW, Collier County, Florida.
OBJECTIVE: That the Board of County Commissioners accepts an offer to release a code enforcement
lien with an accrued value of $76,412.47 for payment of $612.47, in relation to Code Enforcement
Special Magistrate Case No. CESD20110007579.
CONSIDERATIONS: The Code Enforcement Special Magistrate ordered the imposition of a lien
against Lisa Coleman and Robert Boscaglia, in Case No. CESD20110007579, for a code violation at
property located at 1090 15th St SW. The violation consisted of an unpermitted storage structure on the
property. The lien was recorded in the Official Records on February 15, 2012, at O.R. Book 4765, Page
281. The lien amount of $76,412.47 is based on 763 days of accrued fines (January 3, 2012, through
February 3, 2014) $76,300 plus $112.47 in operational costs. The property was brought into compliance
on February 3, 2014. The property was then acquired by Stacy Mendoza and Jose E. Bedolla Jr, via
Special Warranty Deed recorded on September 3, 2014.
Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when a code
enforcement lien encumbers property that is under new ownership, and compliance has been achieved
within 30 days. The new owners were unaware of the lien on their property. The property is being
actively maintained, and $612.47 has been paid in settlement of fines. The new owner is requesting a
waiver of $75,800 in accrued fines. There are currently no known violations.
FISCAL IMPACT: Payment of $612.47 in settlement of fines has been received. If approved by the
Board, accrued fines in the amount of $75,800 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, conforms to the
Board’s policy contained in Resolution 2012-46, is approved as to form and legality, and requires
majority vote for approval. -JAK
RECOMMENDATION: To waive the fines in the amount of $75,800, accept the payment amount of
$612.47, and authorize the Chairman to sign the attached release and satisfaction of lien for recording in
the Official Public Records.

Request for Reduction of Lien
Dear Sir or Madam:
Pursuant to Resolution No. 2012-46, this is a formal request for the reduction of fines accrued
on the subject property. Please be advised as follows:
1. Under Case CESD20110007579 a County permit for a storage structure in rear of property
was filed. The case was made compliant on or about Febrlrary 3,2014.
2. The current owner at the time was Lisa coleman and Robert Boscaglia.
3. The property was subsequently foreclosed upon by Chase Home Finance, LLC and a
Certificate of Title was issued to Federal National Mortgage Association on December 5,
2013 to
4. The property was then transferred to the current owners, Stacy Mendoza and Jose E.
Bedolla, Jr. on or about August 29,2AL4.
5. The violation status is currently shown as Closed.
6. The payment of the outstanding lien would be a severe financial hardship on the owners.
7 . Operational Costs of the County in the amount of $1.1"2.47 will be paid as consideration of
the release of the lien.
8. Relief is requested to release the Code Enforcement Lien that should have been paid by the
prior owners and/or included in the Foreclosure,
9. A settlement amount of 5500 is being offered, plus the 5t1l2.ql Operational Costs for a total
of 5672.41.

but shall be limiled to appellate revierv of the record created within the original hearing. It is the
responsibility of the appealing party to obtain a transcribed record of the hearing from the Clerk of
courts. Filing an Appeal will not automatically stay the Special Magistrate's order.

A. Respondent is found guilty of violation of Collier County Land Deve lopment Code 04-41 , as
arnended, Section 10.02.06(8XlXa) and Section 10.02.06(8)(l)(e),
B. Respondent must abate the violation by obtaining all required Collier County building permits or
demolition permit, inspections, and certificate of completion/occupancy on or before January 2,
2012 or a fine of $100.00 per day rvill be imposed for each day the violation remains thereafter,
C.If Respondents fail to comply with this Order, the Collier County Code Enforcement Department
may abate the violation using any method to bring the violation into compliance. If neceisary, the
County may request the services of the Collier County SherifPs Office for the purpose of
accessing the property for abatement. All costs of abatement shall be assessed'against the
property.
D. Respondents are ordered to pay operational costs for the prosecution of this case in the amount of
$112.47 on or before January 2,

Pursuant to Resolution No. 2012-46, this is a formal request for the reduction of fines accrued
on the subject property. Please be advised as follows:
1. Under Case CESD20110007579 a County permat for a storag€ structure in rear of property
was filed. The case was made compliant on or about February 3, 2014.
2. The current owner at the time was Lisa Coleman and Robert Boscaglia.
3. The property was subsequently foreclosed upon by Chase Home Finance, LLC and a
Certificate of Title was issued to Federal National Mortgage Association on December 6,
2013 to
4. The property was then transferred to the current owners, Stacy Mendoza and Jose E.
Eedolla, lr. on or about August 29,2014.
5. The violation status is currently shown as Closed.
6. The payment of the outstanding lien would be a severe financial hardship on the owners.7. Operational Costsof the County in the amount of S1j.2.47will be paid as consideration of
the release of the lien.
8. Relief is requested to release the code Enforcement Lien that should have been paid by the
prior owners and/or included in the Foreclosure.
