A. Ave Maria Utility Company – Notice of Tariff Updates
Mr. Kovensky reported:
• In 2016, the Ave Maria Utility Company filed a Petition for an increase in rates charged
to the users of the system for water and wastewater service.
• The Authority conducted a review of the Petition including holding public hearings at
various venues so those impacted could comment.
• Following the review, on March 31, 2017 per Final Order 2017-01, the Authority
granted the Utility permission to implement the rate changes.
• The rate changes were to be implemented over a 5-year period with a 5 percent annual
increase, an additional annual increase based on the Florida Public Services Annual
Rate Index and the ability to recover the cost of the rate case over a 4 year period, 25
percent annually.
• The annual increase requires notification to the Authority on the company’s intention to
implement the permitted rate changes and said notice was filed on July 3, 2019 by the
Utility’s attorney.
• A Staff review of the notification was conducted of the methodology and data utilized
for the proposed annual increase.
• Staff found (following requests for additional information) the request for an increase
was in order.
• Notification was provided to the users as required and the Utility has implemented a
rate increase of 6.29 percent for water and 6.03 percent for wastewater.
• The Order issued in 2017 is in its 3rd year of implementation with 2 years remaining
within the prescribed timeframe.
During Authority discussion it was noted by Staff there is no “cap” on the amount of costs
incurred for the rate study that may be passed onto the customers.
Ms. Sherry moved to accept the notification from Ave Maria Utility Company as outlined by
Staff and establishment of the new rates. Second by Mr. Ricardo. Carried unanimously 4 –
0.

RECOMMENDATION: That the Authority approve Final Order No. 2020-01, establishing the
2020 Price Index Factor for investor-owned water and/or wastewater utilities operating in Collier
County and in the City of Marco Island.
REQUESTED APPROVAL: Request the Authority reviews the attached Florida Public Service
Commission (FPSC) Order No. PSC-2019-0525-PAA-WS issued December 17, 2019,
establishing the 2020 Price Index of 1.79 percent; and approve Final Order No. 2020-01,
establishing the equivalent 2020 Price Index for investor-owned utilities operating in Collier
County and the City of Marco Island.
REPORT: Section 1-6(I), Collier County Ordinance No. 96-6, as amended, requires the Authority
to adopt a price index for investor-owned water and/or wastewater utilities no later than May 15th
of each year, equivalent to the price index established annually by the FPSC. The adoption of the
price index is late this year due to the late filing of the consummating order by the FPSC and
subsequent logistics dealing with the COVID-19 pandemic. The 2020 Price Index was made
effective on March 26, 2020, via the FPSC’s Consummating Order PSC-2020-0089-CO-WS.
The index is applied to the major categories of operation and maintenance costs incurred by water
and/or wastewater utilities, except for the amortization of rate case expenses and those operating
costs subject to pass-through adjustments, reflecting the percentage of increase (or decrease) of
such costs from the most recent 12-month historical period available. The maximum allowable
increase resulting from the application of the 2020 Price Index can be no greater than 1.79 percent.
Staff recommends adoption of Final Order No. 2020-01, approving the 2020 Price Index and the
forms required for filing the price index adjustment.

NOTICE is hereby given by the Florida Public Service Commission that the action
discussed herein is preliminary in nature and will become final unless a person whose interests
are substantially affected files a petition for a formal proceeding, pursuant to Rule 25-22.029,
Florida Administrative Code (F.A.C.).
Background
Since March 31, 1981, pursuant to the guidelines established by Section 367.081(4)(a),
Florida Statutes (F.S.), and Rule 25-30.420, Florida Administrative Code (F.A.C.), we have
established a price index increase or decrease for major categories of operating costs on or before
March 31 of each year. This process allows water and wastewater utilities to adjust rates based
on current specific expenses without applying for a rate case.
This Order calculates the 2020 price index by comparing the Gross Domestic Product
Implicit Price Deflator Index for the fiscal year ended September 30, 2019. This same procedure
has been used each year since 1995 to calculate the price index. The U.S. Department of
Commerce, Bureau of Economic Analysis, released its most recent third quarter figures on
October 30, 2019.

Since March 31, 1981, this Commission has received and processed approximately 3,741
index and pass through applications. We have jurisdiction over this matter pursuant to Section
367.081, F.S.
Decision
In 1993, the Gross Domestic Product Implicit Deflator (GDP) was established as the
appropriate measure for determining the water and wastewater price index. At the same time, the
convention of using a four quarter fiscal year comparison was also established and this practice
has been used every year since then.1 The GDP is prepared by the U.S. Department of
Commerce. Prior to that time, the Gross National Product Implicit Price Deflator Index (GNP)
was used as the indexing factor for water and wastewater utilities. The Department of Commerce
switched its emphasis from the GNP to the GDP as the primary measure of U.S. production.
Pursuant to Section 367.081(4)(a), F.S., this Commission, by order, shall establish a price
increase or decrease index for major categories of operating costs incurred by utilities subject to
its jurisdiction reflecting the percentage of increase or decrease in such costs from the most
recent 12-month historical data available. Since 1995, the price index was determined by using a
four quarter comparison, ending September 30, of the Implicit Price Deflator Index in order to
meet the statutory deadline. The updated price index was determined by comparing the change in
the GDP using the four quarter fiscal year comparison ending September 30, 2019. This method
has been used consistently since 1995 to determine the price index.2
In Order No. PSC-2018-0612-PAA-WS, issued December 27, 2018, in Docket No.
20180005-WS, in keeping with the practice started in 1993, we reiterated the alternatives which
could be used to calculate the indexing of utility revenues. Past concerns expressed by utilities,
as summarized from utility input in previous hearings, are:
1) Inflation should be a major factor in determining the index;
2) Nationally published indices should be vital to this determination;
3) Major categories of expenses are labor, chemicals, sludge-hauling, materials and
supplies, maintenance, transportation, and treatment expense;
4) An area wage survey, Dodge Building Cost Index, Consumer Price Index, and the GDP
should be considered;
5) A broad measure index should be used; and

6) The index procedure should be easy to administer.
Based upon these concerns, we have previously explored the following alternatives:
1) Survey of Regulated Water and Wastewater Utilities;
2) Consumer Price Index;
3) Florida Price Level Index;
4) Producer Price Index – previously the Wholesale Price Index; and
5) GDP (replacing the GNP).
Over the years, we found that the Survey of Regulated Water and Wastewater Utilities
should be rejected because using the results of a survey would allow utilities to pass on to
customers all cost increases, thereby reducing the incentives of promoting efficiency and
productivity. We have also found that the Consumer Price Index and the Florida Price Level
Index should be rejected because of their limited degree of applicability to the water and
wastewater industry. Both of these price indices are based upon comparing the advance in prices
of a limited number of general goods and, therefore, appear to have limited application to water
and wastewater utilities.
We further found that the Producer Price Index (PPI) is a family of indices that measure
the average change over time in selling prices received by domestic producers of goods and
services. PPI measures price change from the perspective of the seller, not the purchaser, and
therefore shall be rejected. The bases for these indices have not changed, and the conclusions
reached in Order No. PSC-2018-0612-PAA-WS continue to apply in this case. Since 1993, we
have found that the GDP has a greater degree of applicability to the water and wastewater
industry. Therefore, we shall continue to use the GDP to calculate water and wastewater price
level adjustments.

Appropriate Rates for 2020 Index
The U.S. Department of Commerce, Bureau of Economic Analysis, released the most
recent third quarter 2019 figures on October 30, 2019. Consistent with our establishment of the
2019 Price Index last year, we are using the third quarter 2019 amounts to calculate the 2020
Price Index. Using the third quarter amounts allows time for a hearing if there is a protest, in
order for this Commission to establish the 2020 Price Index by March 31, 2020, in accordance
with Section 367.081(4)(a), F.S. The percentage change in the GDP using the fiscal year
comparison ending with the third quarter is 1.79 percent. This number was calculated as follows.

Noticing of Indexing Requirements
The package presented in Attachment 1 shall be mailed to every regulated water and
wastewater utility after the expiration of the PAA protest period, along with a copy of the
finalized PAA order. The entire package will also be made available on this Commission’s
website.
In an effort to increase the number of water and wastewater utilities taking advantage of
the annual price index and pass-through programs, we find that the attached cover letter
(Attachment 2) from the Director of the Division of Accounting and Finance shall be included
with the mailing of the PAA Order in order to explain the purpose of the index and pass-through
applications and to communicate that Commission staff is available to assist them.

Closure of Docket
Uniform Rule 25-22.029(1), F.A.C., contains an exception to the procedural requirements
set forth in Uniform Rule 28-106.111, F.A.C., providing that “[t]he time for requesting a Section
120.569 or 120.57 hearing shall be 14 days from issuance of the notice for PAA orders
establishing a price index pursuant to Section 367.081(4)(a), F.S.” We therefore require any
protest to the PAA Order in this docket be filed within 14 days of the issuance of the PAA Order,
and that any party filing the protest shall be required to pre-file testimony with the protest. Upon
expiration of the protest period, if a timely protest is not received, the decision shall become final
and effective upon the issuance of a Consummating Order. However, this docket shall remain
open through the end of the year and be closed upon the establishment of the new docket on
January 2, 2020.
Based on the foregoing, it is
ORDERED by the Florida Public Service Commission that the Gross Domestic Product
Implicit Price Deflator Index is approved for use in calculating price level adjustments. It is
further
ORDERED that the 2020 Price Index for water and wastewater utilities shall be 1.79
percent. It is further
ORDERED that pursuant to Rule 25-30.420(1), F.A.C., the Office of Commission Clerk,
after the expiration of the Proposed Agency Action (PAA) protest period, shall mail each
regulated water and wastewater utility a copy of the PAA order establishing the index containing
the information presented in Attachment 1. A cover letter from the Director of the Division of
Accounting and Finance shall be included with the mailing of the order (Attachment 2). The
entire package shall also be made available on the Commission’s website. It is further
ORDERED that any substantially affected person filing a protest to this order shall do so
within 14 days of the issuance of this order. It is further
ORDERED that any substantially affected person filing a protest to this order shall pre-
file direct testimony with the protest. It is further
ORDERED that the provisions of this Order, issued as proposed agency action, shall
become final and effective upon the issuance of a Consummating Order unless an appropriate
petition, in the form provided by Rule 28-106.201, Florida Administrative Code, is received by

Dear Utility Owner:
Since March 31, 1981, pursuant to the guidelines established by Section 367.081(4)(a),
Florida Statutes (F.S.), and Rule 25-30.420, Florida Administrative Code (F.A.C.), the
Commission has established a price index increase or decrease for major categories of operating
costs. This process allows water and wastewater utilities to adjust rates based on current specific
expenses without applying for a rate case. The intent of this rule is to insure that inflationary
pressures are not detrimental to utility owners, and that any possible deflationary pressures are
not adverse to rate payers. By keeping up with index and pass-through adjustments, utility
operations can be maintained at a level sufficient to insure quality of service for the rate payers.
Pursuant to Rule 25-30.420(1)(a), F.A.C., all operation and maintenance expenses shall
be indexed with the exception of:
a) Pass-through items pursuant to Section 367.081(4)(b), F.S.;
b) Any amortization of rate case expense; and
c) Disallowances or adjustments made in an applicant's most recent rate proceeding.
Please note that all sludge removal expense should now be removed from operation and
maintenance expenses for the purpose of indexing. Incremental increases in this category of
expense may now be recovered using a pass-through request.

Upon the filing of a request for an index and/or pass-through increase, staff will review the
application and modify existing rates accordingly. If for no other reason than to keep up with
escalating costs, utilities throughout Florida should file for this rate relief on an annual basis.
Utilities may apply for a 2020 Price Index anytime between April 1, 2020, through March 31,
2021 by mail or by emailing Applications@psc.state.fl.us. The attached package will answer
questions regarding what the index and pass-through rate adjustments are, how to apply for an
adjustment, and what needs to be filed in order to meet the filing requirements. While this
increase for any given year may be minor, (see chart below), the long-run effect of keeping
current with rising costs can be substantial.

A FINAL ORDER OF THE COLLIER COUNTY WATER AND WASTEWATER
AUTHORITY, PURSUANT TO SECTION 1-6, COLLIER COUNTY ORDINANCE
NO. 96-6, AS AMENDED, PROVIDING FOR THE ADOPTION OF THE 2020
PRICE INDEX FACTOR SET ANNUALLY BY THE FLORIDA PUBLIC
SERVICE COMMISSION, FOR UTILIZATION IN PRICE INDEX RATE
APPLICATIONS FOR NONEXEMPT WATER AND/OR WASTEWATER
UTILITIES PROVIDING SERVICE IN UNINCORPORATED COLLIER
COUNTY AND THE CITY OF MARCO ISLAND, FLORIDA.
WHEREAS, Collier County Ordinance No. 96-6, as amended, provides for the
Collier County Water and Wastewater Authority (AUTHORITY) to adopt a price index
factor for water and/or wastewater utilities on or before May 15th of each calendar year for
the utilization in price index rate application; and
WHEREAS, due to logistical delays related to the COVID-19 pandemic, the
adoption of the price index will not meet the May 15th deadline; and
WHEREAS, Collier County Ordinance No. 96-6, as amended, provides that the
price index factor shall be equivalent to the price index factor set annually by the Florida
Public Service Commission (COMMISSION); and
WHEREAS, the COMMISSION issued Order No. PSC-2019-0525-PAA-WS on
December 17, 2019, establishing the 2020 Price Index of 1.79 percent for water and/or
wastewater utilities; and
WHEREAS, the COMMISSION issued Consummating Order No. PSC-2020-
0089-CO-WS on March 26, 2020, enabling Order No. PSC-2019-0525-PAA-WS to
become final and effective on March 26, 2020.
NOW, THEREFORE, IT IS HEREBY ORDERED by the Collier County Water
and Wastewater Authority, in public meeting assembled, that:
1. The 2020 Price Index is 1.79 percent.
2. Any water and/or wastewater utility that intends to increase its rates by
implementation of this price index must notify the AUTHORITY on or after
the effective date of this Final Order of such intent and shall apply the 2020
Price Index to applicable 2019 calendar year operation and maintenance
expenses.
3. Utilities using the 2020 Price Index shall use the forms attached as Appendices
“A”, “B”, “C” and “D”, and shall follow all price index application
requirements specified in Collier County Ordinance No. 96-06, as amended,
before implementing any index.

4. This Order shall become effective upon adoption by the AUTHORITY and

REPORT: The Collier County Water and Wastewater Authority was established by Ordinance
96-6 on February 27, 1996. The Board of County Commissioners appointed the original members
to the Authority on May 21, 1996. The last election was held on February 19, 2019, and the
Authority has not met in an official capacity since October 21, 2019.
In previous years, the chairman and vice chairman positions have been elected by fellow Authority
members. After selection by majority vote, staff recommends the outgoing chairman pass the
gavel to the incoming chairman, thus turning the meeting over to the new chairman.

CUSTOMER NOTICE
May 1, 2020
Dear Valued Customer:
We at Ave Maria Utility Company, LLLP (“Utility”) are aware that many of our customers
are experiencing many challenges brought on by the Coronavirus pandemic. As many of our
customers spend much more time at home, we at your utility have noticed an increase in the
quantities of water services utilized by our residential customers. In an attempt to alleviate some
of the hardship our customers are experiencing, we have submitted an Emergency Application
with the Collier County Board of County Commissioners and the Collier County Water and
Wastewater Authority (the “CCWWA” or “Authority”) requesting that the Utility be allowed to
forgo utilization of all upper tiers of our residential water usage rates for the next 2 months. The
County Authority has quickly approved this request. This will help most customers who are using
larger amounts of water service during this period. We will re-evaluate the situation at the end of
June and decide then if we feel we can or should consider extending this temporary discount of
rates.
You should notice a slight reduction in your water charges for the next 2 months as a result
of this voluntary temporary change. Stay Safe and should you have any questions, please contact
your local utility office. Be sure to have your account number handy for quick reference.

I discussed the issues with the folks at AMUC. While the credit or rebate is doable, it requires
individual customer calculations and entries each month which is a pretty significant undertaking for
each billing cycle. As such, while we may try to do that for the first month, we would like you to
proceed to get this on before the Authority or the BOCC for approval as filed (with the corrected
tariff attached) as soon as possible so that we do not have to repeat those each month that we

As promised please find my letter with proposed customer notice and tariff to implement a
Temporary reduction in water usage rates for a 2 month period. Please consider this as our
Emergency Application and see to it that it is considered and approved as quickly as possible. I also
think it would be a good idea that we are given authorization in that approval to continue with this
reduction after 2 months, should the Utility choose then to do so.
Let me know if you have any questions or if I can provide anything else.

MASTER DEVELOPER AGREEMENT
NATIONAL GOLF AND COUNTRY CLUB AT AVE MARIA
THIS MASTER AGREEMENT, made as of this 5th day of December 2019, between
LENNAR HOMES, LLC ("Developer"), and AVE MARIA UTILITY COMPANY, LLLP, a
Florida limited liability limited partnership ("Utility").
RECITALS
WHEREAS, the Developer is or will be the owner of land in Collier County, Florida
within the development known as Ave Maria, more particularly described in Exhibit “A” and
incorporated herein by reference (“Property”); and,
WHEREAS, the Utility owns and operates or will own and operate a potable water
production, treatment, storage, transmission and distribution system and a sanitary wastewater
collection, treatment and effluent disposal system; and,
WHEREAS, subject to the terms and conditions of this Master Agreement, the Developer
desires to obtain, and the Utility desires to provide, water and wastewater service to the Property;
and,
WHEREAS, the purpose of this Master Agreement is to set forth the general terms and
conditions under which the Utility will extend and provide water and wastewater service to the
Property, subject to the take down of specific capacity for a given phase of development through
a subsequent Developer Phase Agreement(s) to this Master Agreement; and
NOW, THEREFORE, in consideration of the premises and mutual covenants contained
herein, the Utility and Developer agree as follows:
1.Definitions. For the purpose of this Master Agreement, the following terms shall have the
following meanings:
a.Active Connection - A physical connection to the Utility's water and/or wastewater
system at the Point of Delivery, whether or not service is currently being provided.
b. Authority – The Collier County Water and Sewer Authority.

whether due to existing or future rules, regulations, orders, laws, or proclamations either
federal, state or county, civil or military; adoption of new or modification of existing rules
by a Governmental Agency; or by any other causes, whether or not of the same kind as
enumerated herein, not within the sole control of Utility and which by exercise of due
diligence Utility is unable to overcome.
9.Miscellaneous.
a.This Master Agreement shall be effective and its terms and conditions binding on
the parties unless (i) Utility receives a notice of disapproval from the Authority, in
which event this Master Agreement shall be null and void, or (ii) the Authority
requires any modifications or amendments of the terms of this Master Agreement,
in which event this Master Agreement shall, at the option of Utility, be null and
void or be modified or amended accordingly. This Master Agreement is subject to
Utility’s Water Tariff and Wastewater Tariff. If a conflict between this Master
Agreement and either of Utility’s Tariffs exists, the Tariff(s) shall control.
b.Developer is subject to Utility’s Technical Standards and Specifications. This
Master Agreement shall be construed in a manner that is consistent with the terms
and conditions of Utility’s Technical Standards and Specifications. Nothing in this
Master Agreement is intended to modify or otherwise limit Developer’s obligation
to adhere to Utility’s Technical Standards and Specifications. Unless expressly
modified in this Master Agreement or as provided in Utility’s Technical Standards
and Specifications, the terms and conditions set forth in Utility’s Technical
Standards and Specifications shall remain in full force and effect and not modified
by this Master Agreement.
c.This Master Agreement shall be binding upon and shall inure to the benefit of
Developer, Utility and their respective assigns and successors by merger,
consolidation or conveyance. This Master Agreement shall not be sold, conveyed,
assigned, transferred or otherwise disposed of by Developer without the written
consent of Utility first having been obtained, except in the case of a bona fide sale
of the Property by Developer to a third party, in which event consent shall not be
unreasonably withheld. Any such attempt not authorized by Utility in writing shall
be void ab initio.
d.Until further written notice by either party to the other, all notices provided for
herein shall be in writing and delivered by U.S. certified mail, and if to Developer,

Please find the enclosed copy of the Developer Agreement– Silverwood Phase 2 executed between Ave Maria
Utility Company, LLLP and CC Ave Maria, LLC. This agreement is subject to the general terms of the Master
Developer Agreement – Maple Ridge Reserve @ Ave Maria executed on October 17, 2014.
The current amount of capacity reserved at the water and wastewater plants (including this project) are 1.32
MGD and 1.12 MGD, respectively. The water and wastewater plants have a total permitted maximum day
operation capacity of 0.999 MGD and 0.9 MGD, respectively and the current Max Daily Flow is .925 MGD and
.599 MGD, respectively.

MASTER DEVELOPER AGREEMENT
NATIONAL GOLF AND COUNTRY CLUB AT AVE MARIA
THIS MASTER AGREEMENT, made as of this 5th day of December 2019, between
LENNAR HOMES, LLC ("Developer"), and AVE MARIA UTILITY COMPANY, LLLP, a
Florida limited liability limited partnership ("Utility").
RECITALS
WHEREAS, the Developer is or will be the owner of land in Collier County, Florida
within the development known as Ave Maria, more particularly described in Exhibit “A” and
incorporated herein by reference (“Property”); and,
WHEREAS, the Utility owns and operates or will own and operate a potable water
production, treatment, storage, transmission and distribution system and a sanitary wastewater
collection, treatment and effluent disposal system; and,
WHEREAS, subject to the terms and conditions of this Master Agreement, the Developer
desires to obtain, and the Utility desires to provide, water and wastewater service to the Property;
and,
WHEREAS, the purpose of this Master Agreement is to set forth the general terms and
conditions under which the Utility will extend and provide water and wastewater service to the
Property, subject to the take down of specific capacity for a given phase of development through
a subsequent Developer Phase Agreement(s) to this Master Agreement; and
NOW, THEREFORE, in consideration of the premises and mutual covenants contained
herein, the Utility and Developer agree as follows:
1.Definitions. For the purpose of this Master Agreement, the following terms shall have the
following meanings:
a.Active Connection - A physical connection to the Utility's water and/or wastewater
system at the Point of Delivery, whether or not service is currently being provided.
b. Authority – The Collier County Water and Sewer Authority.

whether due to existing or future rules, regulations, orders, laws, or proclamations either
federal, state or county, civil or military; adoption of new or modification of existing rules
by a Governmental Agency; or by any other causes, whether or not of the same kind as
enumerated herein, not within the sole control of Utility and which by exercise of due
diligence Utility is unable to overcome.
9.Miscellaneous.
a.This Master Agreement shall be effective and its terms and conditions binding on
the parties unless (i) Utility receives a notice of disapproval from the Authority, in
which event this Master Agreement shall be null and void, or (ii) the Authority
requires any modifications or amendments of the terms of this Master Agreement,
in which event this Master Agreement shall, at the option of Utility, be null and
void or be modified or amended accordingly. This Master Agreement is subject to
Utility’s Water Tariff and Wastewater Tariff. If a conflict between this Master
Agreement and either of Utility’s Tariffs exists, the Tariff(s) shall control.
b.Developer is subject to Utility’s Technical Standards and Specifications. This
Master Agreement shall be construed in a manner that is consistent with the terms
and conditions of Utility’s Technical Standards and Specifications. Nothing in this
Master Agreement is intended to modify or otherwise limit Developer’s obligation
to adhere to Utility’s Technical Standards and Specifications. Unless expressly
modified in this Master Agreement or as provided in Utility’s Technical Standards
and Specifications, the terms and conditions set forth in Utility’s Technical
Standards and Specifications shall remain in full force and effect and not modified
by this Master Agreement.
c.This Master Agreement shall be binding upon and shall inure to the benefit of
Developer, Utility and their respective assigns and successors by merger,
consolidation or conveyance. This Master Agreement shall not be sold, conveyed,
assigned, transferred or otherwise disposed of by Developer without the written
consent of Utility first having been obtained, except in the case of a bona fide sale
of the Property by Developer to a third party, in which event consent shall not be
unreasonably withheld. Any such attempt not authorized by Utility in writing shall
be void ab initio.
d.Until further written notice by either party to the other, all notices provided for
herein shall be in writing and delivered by U.S. certified mail, and if to Developer,
