AN ORDINANCE OF THE BOARD OF COUNTY
COMMISSIONERS, COLLIER COUNTY, FLORIDA,
AMENDING ORDINANCE NUMBER 2004-41, AS
AMENDED, THE COLLIER COUNTY LAND
DEVELOPMENT CODE WHICH ESTABLISHED THE
COMPREHENSIVE ZONING REGULATIONS FOR
THE UNINCORPORATED AREA OF COLLIER
COUNTY, FLORIDA, BY AMENDING THE
APPROPRIA TE ZONING ATLAS MAP OR MAPS BY
CHANGING THE ZONING CLASSIFICATION OF THE
HEREIN DESCRIBED PROPERTY FROM
AGRICULTURAL (A) ZONING DISTRICT TO THE
RESIDENTIAL MULTI-FAMILY 6 (RMF-6) ZONING
DISTRICT WITH A DENSITY OF 3.2 DWELLING
UNITS PER ACRE THAT WOULD ALLOW 27 MULTI-
FAMILY DWELLING UNITS. CONSISTING OF 8.68::1:
ACRES FOR A PROJECT KNOWN AS MANU'S
REZONE. THE SUBJECT PROPERTY IS LOCATED
WITHIN ONE MILE OF THE INTERSECTION OF
RATTLESNAKE-HAMMOCK ROAD (CR 864) AND
POLLY AVENUE IN SECTION 16, TOWNSHIP 50
SOUTH, RANGE 26 EAST, COLLIER COUNTY,
FLORIDA; PROVIDING FOR STAFF AND PLANNING
COMMISSION CONDITIONS; AND BY PROVIDING
AN EFFECTIVE DATE.
WHEREAS, Davidson Engineering, Inc., representing Polly Ave, LLC,
petitioned the Board of County Commissioners to change the zoning classification of the
herein described real property.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:

described in Ordinance No. 2004-41, as amended, the Collier County Land Development
Code is/are hereby amended accordingly. The herein described real property is the same
for which the rezone is hereby approved subject to the following conditions:

STIPULATIONS
1. Lot No, 28 as depicted on Exhibit B, the Conceptual Site Development Plan shall be
reserved for water management facility purposes.
2. The developer shall convey to Collier County a 70 foot easement along the future
Santa Barbara Boulevard Extension at no cost to the County.
3. The developer shall contribute the sum of One-Thousand Dollars and No/IOO
($1000.00) per unit to the Collier County Affordable Housing Trust Fund, The entire
sum of Twenty-Seven Thousand Dollars and Noll 00 ($27,000.00) shall be paid upon
issuance of the first building permit for the project. These sums shall be credited
against any linkage or other fee the County may adopt in the future for affordable
housing purposes.
4. No building shall exceed 35 feet in height.
5. The developer agrees to participate in an MSTU or MSBU for roadway
improvements along Polly and Adkins Avenues and Sunset Boulevard if the affected
residents agree.
6. Payment in lieu of sidewalks and bike lanes along future Santa Barbara Boulevard
Extension shall be required. The amount shall be determined utilizing Florida
Department of Transportation (FDOT) 2004 Transportation Cost Estimates, as
amended. Payment shall be required within 30 days of approval of the zoning
petition by the Board of County Commissioners.
