EXECUTIVE SUMMARY
Recommendation to approve adjusting the Fiscal Year 2021 Proposed Budget to return $5 million
to the Tax Collector for funding of Phase 1 of the Heritage Bay Government Center.
OBJECTIVE: In FY21 return excess fees remitted in FY20 in the amount of $5 million to help fund
Phase 1 of the Heritage Bay Government Center.
CONSIDERATIONS: The Tax Collector’s Office (TCO) and Collier County Government have entered
into a Memorandum Agreement that the TCO will be responsible for and pay for the Phase 1 of the
Heritage Bay Government Center. The TCO has established in their FY 2020 budget $6,551,300 for the
start-up of Phase 1 of Heritage Bay. Due to unforeseen circumstances and issues beyond the control of
either the TCO and/or Collier County Government, it is anticipated that only $1,245,100 can be
completed within the current fiscal year.
Florida Statute 218.36 requires the TCO to pay all money in excess of the monies needed to fund their
operations for any given fiscal year back to the governmental units in the same proportion paid in fees to
the TCO. The TCO is not allowed to establish a reserve and/or carryover funds into the new year for any
project. Therefore, at the end of the FY 2020, the TCO is obligated to turn back all unspent money.
Conversations with the Department of Revenue indicate that TCO can enter into an agreement with the
County to set aside funding on the County’s books for major projects that cross fiscal years.
FISCAL IMPACT: In the current FY21 recommended budget reviewed by the Board on June 18th, the
General Fund forecast (FY20) for excess fees from the Tax Collector (revenue) were estimated at $2
million.
Therefore, to accommodate the above request, the forecast for excess fees from the Tax Collector
(revenue) will be increased by $5 million and in FY 21, the transfer to the Tax Collector (expense) will be
increased by $5 million. These changes can be included in the July Tentative Budget book.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, raises no legal
issues, and requires majority vote for approval. -JAK
RECOMMENDATIONS: Approve the payment of $5 million to the Tax Collector on October 15, 2020
for the continuation of Phase 1 of the Heritage Bay Government Center and authorize all necessary
adjustment to the FY 2021 budget.

Please consider the below terms a memorialization of the coordination between Collier
County Government and the Collier County Tax Collector's Office for the Heritage Bay
Government Services Center Project. If Collier County Tax Collector's Office agrees with

This agreement is between Collier County Government ('CCGI on behalf of its
Facilities Management Division ("CCFM") and the Collier County Tax Collector's Oflice
('rcol.
This agreement is to establish the joint coordination of the development ol
Phase 1 ofthe Heritage Bay Government Center to be located on CCG owned Parcel
Number 49660082584 in the area of North Naples and the Heritage Bay Planned Unit
Development (PUD).
Thrs first phase is identified as the approimate 20,000 +/- square feet (sf)
Collier County Government Services Center (GSC) that will provide space for the
operations of multiple Coliier County Constitutional Offices and Collier County
Government similar in function to the North Collier Government Services Center.
Additionally, CCG may develop future phases that include an Emergency
Medical Services (EMS) station and other government facilities.
Exhibit A: Heritage Bay Government Center Phasing Breakdown illustrates the
use and funding sources of the multiple phases of the entire site.

CCG and TCO have identified the public health and safety and mutual benefits
in locating other constitutiona-1 offices and government services in the GSC and
ensuring it is designed and constructed to serve this purpose.
Coordinating the design and construction of the facility will require a joint effort
and pa-rtnership between the TCO and CCG.
This agreement, in establishing roles and responsibilities, will guide the joint
effort to ensure the facility meets the needs of the TCO, CCG and the citizens of Collier
County.
This will include the overa.ll site features, parking, utilities, ent{,'ways, turn
lanes, and any other on-site or off-site infrastructure necessary to ful1y construct the
GSC building and provide a site ready for future development.
TCO, having established al approved budget for the desigrr ald construction of
the GSC, will provide the funding through a dedicated project budget and contract
directly with the selected design team and construction entity for the completion of the
first phase in its entirety as indicated in Exhibit A. This phase will include the high-
level programming of the site, creation arrd approval of a site development plan (SDP),
programming, design and construction of the GSC building and the physical site
development excluding future buildings.
CCFM and TCO wilt each provide an assigned Project Manager (PM) to
participate in the programming, design and specifications development, bidding, and
facility construction and provide overall project management for the project. This
project team will manage the Phase 1 project as a partnership.
CCFM will provide project oversight including coordination, planning, design
and construction expertise to all phases of the project ald ensure the design and
construction of the facility meets Collier County Vertica-1 Standards, aligns with the
CCFM's long-term operations and maintenance program and serves the intended
purpose of providing a government services center in the area.
The CCFM PM and TCO PM will work jointly to manage the phase 1 project
and ensure the facility will meet a-ll of the intended uses and be designed and
constructed in the best interest of the citizens of Collier County.
Dunng the course of t].e phase 1 project, both the CCFM PM and TCO PM
will review and approve the various documents as required for the project includtng
but not limited to pay applications, programming and design documents,
specilications, systems and equipment submittals.
TCO has a particular interest in the form and function of the interior customer
service and office space and Collier County Facilities Management has a particular
interest in the other public spaces in the facility, overall site layout, and building and

site design components that alfect the long-term maintenance and operations costs of
the facility. Given these particular interests, the project team will typically defer the
review and selection oversight on each of these particular interests to the appropriate
parties with t}te understanding that the partnership will always work to develop an
agreement on each portion of the phase 1 project.
The project team will request additional information and recommendations from
the design team to provide recommended actions when a disagreement occurs between
the TCO and CCFM on particular phase 1 project decisions.
Pay applications submitted by the desigrr firm and construction entity will be
reviewed and approved by both the TCO PM and CCFM PM prior to pal.rnent by the
TCO,
Upon completion of the phase 1 project, Collier County Government will take
ownership and maintenance responsibilities of the GSC. The facility, has been
designed and constructed for the purpose of serving the needs of the Collier County
TCO to perform State business and various Collier County government transactions
as agent, now and in the future. Additionally, the GSC will provide space for Collier
County Government Offices ald other Coilier County Constitutional Offices. Its use
may be adjusted in the future, as needed, to support its intended mission in
accordance with ai1 previous use agreements, County Ordinance and State Statutes.
