EXECUTIVE SUMMARY
Recommendation to approve “after-the-fact” submittal of a Fire Management Assistance Subgrant
to the Florida Division of Emergency Management for reimbursement of expenses incurred during
the Florida 36th Avenue SE Fire in the estimated amount up to $300,000.
OBJECTIVE: To request reimbursement of expenses incurred during the Florida 36th Avenue SE Fire
to the Florida Division of Emergency Management through the Fire Management Assistance Subgrant.
CONSIDERATIONS: Collier County incurred expenses in response to the recent Florida 36th Avenue
SE Fire. To be eligible for federal financial assistance, Collier County must be approved as an applicant
by the Florida Division of Emergency Management. If approved as an applicant, Collier County will
seek reimbursement for all eligible expenses including labor, equipment, and materials in support of the
emergency. If awarded, FEMA will reimburse at a rate of 75% of eligible expenses. All reimbursement
activities will be coordinated by the Administrative Services Department. Prior to any reimbursement, a
funding agreement will be in place, which must be approved by the Collier County Board of County
Commissioners.
The Florida Division of Emergency Management informed the Collier County Bureau of Emergency
Services that the application deadline was June 30, 2020. In order to meet the deadline, the request was
submitted on June 24, 2020. Collier County CMA #5330 authorizes the County Manager to approve the
submittal of grant applications with subsequent Board of County Commissioners action at the next
available Board meeting to ratify the approval as “after-the-fact.”
FISCAL IMPACT: Approval of the request for Fire Management Assistance Subgrant will enable
Collier County to be reimbursed for eligible expenses associated with the Florida 36th Avenue SE Fire in
an estimated amount up to $300,000. FEMA will reimburse the County at a rate of 75% of eligible
expenses with FDEM typically sharing the 25% match requirement 50/50 leaving a 12.5% local match
responsibility to the County. The match is supported by General Fund (001) as valorem taxes.
LEGAL CONSIDERATIONS: The Board will have the opportunity to accept or reject the funds if the
grant is approved. Accordingly, this Office has no issue with respect to the legality of this request, which
is appropriate for Board action and requires a majority vote for Board action. -JAB
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
RECOMMENDATION: To authorize an “after-the-fact” submittal of a Fire Management Assistance
Subgrant to the Florida Division of Emergency Management for reimbursement of expenses incurred
during the Florida 36th Avenue SE Fire in an estimated amount up to $300,000.

Title 44 CFR part 204.41 defines Fire Management Assistance eligibility criteria as: (a) The following entities are eligible to apply through a
State grantee for a subgrant under an approved fire management assistance grant: 1) State agencies; 2) Local government; and 3) Indian

Dear Mr. Moskowitz:
This is to confirm FEMA’s determination regarding a recent request for a fire management
assistance declaration from the State of Florida for the 36th Avenue SE Fire. Assessment of the
situation determined that the Fire threatened such destruction as would constitute a major
disaster. The 36th Avenue SE Fire was declared on May 13, 2020, at 11:45 p.m. EST, and was
designated as FEMA-5309-FM-FL.
Section 420 of the Stafford Act authorizes Federal assistance to any State for the mitigation,
management, and control of any fire on publicly or privately owned forest or grassland that
threatens such destruction as would constitute a major disaster. In keeping with those provisions
of the Stafford Act and 44 C.F.R. Part 204, FEMA authorizes assistance for the mitigation,
management, and control of this fire. Pursuant to 44 C.F.R. §204.25, after a State’s request for a
fire management assistance declaration has been approved, the Governor and the Regional
Administrator must enter into a standing FEMA-State Agreement for the declared fire and for
any future fires declared in that calendar year. The FEMA-State Agreement must be signed and
up-to-date before FEMA may provide any Federal funding for fire management assistance
grants. Pursuant to 44 C.F.R. §204.62, costs attributable to the acts of a third party will be
considered in determining the amount of Federal assistance to be made available. The State is
responsible for taking reasonable steps and cooperating in efforts to recover costs from a liable
third party.
Finally, in accordance with 44 C.F.R. §204.51(d), before FEMA can approve the Request for
Federal Assistance and provide funds, the State must have an up-to-date State Administrative
Plan for the Fire Management Assistance Grant Program and a State Hazard Mitigation Plan that
addresses wildfire risks and mitigation measures, that have been reviewed and approved by the
Regional Administrator.
