EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien, with an accrued value of
$182,427.92, for payment of $627.92 in the code enforcement action titled Board of County
Commissioners v. Tarpon IV LLC., related to unimproved property, Folio No. 7621084000, Collier
County, Florida.
OBJECTIVE: For the Board of County Commissioners to accept an offer to release a code enforcement
lien with an accrued value of $182,427.92 for payment of $627.92 in relation to Code Enforcement Board
Case No. CENA20140022780.
CONSIDERATIONS: The Code Enforcement Board ordered the imposition of a lien against Tarpon IV
LLC, in Case No. CENA20140022780 for code violation on unimproved property, Folio No.
7621084000, Collier County, Florida. The violation consisted of having prohibited exotics species
including, but not limited to Java Plum growing on unimproved property. The lien was recorded on April
9, 2015, at O.R. Book 5138, Page 1354. The current lien amount of $182,427.92 is based on 1,823 days
of accrued fines ($100 per day from February 22, 2015 through February 18, 2020) totaling $182,300,
plus $127.92 in operational costs. The property was brought into compliance for the violation on February
18, 2020.
40000 Pine St LLC., acquired the property via Special Warranty Deed recorded on February 3, 2020.
Pursuant to Resolution No. 2012-46, a request for reduction of fines may be considered, in part, when a
lien encumbers property under new ownership and the new owner has diligently pursued abatement and
achieved compliance, and/or when payment of the lien would impose a severe financial hardship on the
owner. To achieve compliance, the new owners hired a contractor, obtained an exotic removal permit,
and paid disposal fees to remove the debris from the property. It took a substantial amount of time and
money, approximately $6,850, to bring the property into compliance. The property is actively
maintained, the owner has paid $627.92 in settlement of fines, and is requesting the remaining $181,800
in accrued fines be waived. There are no known code violations remaining on the property.
FISCAL IMPACT: Payment of $627.92 has been made, representing $500 in fines, plus $127.92 in
operational costs. If approved by the Board, accrued fines in the amount of $181,800 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. -JAB
RECOMMENDATION: To waive the remaining fines in the amount of $181,800, accept payment
amount of $627.92, and authorize the Chair to sign the attached releases and satisfaction of liens for
recording in the Official Public Records.

My name is, Adam Smith, with 40000 PINE ST, LLC. I .iust purchased parcel lD 76210840000 on January
30, 2020, attached is the Recorded Warranty Oeed with date of purchase. The parcel had two code
violations:
CENA20130o13748: S3,200 fines + 5936.17 costs
CENA2014m22780: S182,30o fines + S127.92 costs
I hired a contractor and incurred an expense of S6,850.00 in tetting this issue resolved by clearing the
exotics. I pulled an exotic removal permit which was approved (see attached) had the exotics removed,
and have a notarized Affidavit of Compliance by code enforcement (see attached). I ask that you reduce
the fees to 5500 and will pay your costs of 51,064.09 for a total of 51,554.09.

violations:
cENA20130013748: 53,20O fines + 5936.17 cosrs
CENA20140022780: S182,300 fines + S127.92 costs
I hired a contractor and incurred an expense of S6,850.00 in gettinS this issue resolved by clearing the
exotics. lpulled an exotk removal permit which was approved (see attachedl had the exotics removed,
and have a notarized Affidavit of Compliance by code enforcement (see attached). I ask that you reduce
the fees to S5O0 and will pay your costs of S1,0 .09 for a total of S1,554.09.
