EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien with a value of $138,000 for
payment of $1,500 in the code enforcement actions entitled Board of County Commissioners v.
CKK Properties LLC, relating to property located at 3440 22ND AVE SE, Collier County, Florida,
and to authorize the Chair to execute the Satisfaction of Lien.
OBJECTIVE: To release a code enforcement lien with an accrued value of $138,000 for payment of
$1,500.
CONSIDERATIONS: As a result of a code violation, the Special Magistrate ordered the imposition of a
lien, against CKK Properties LLC, in Case No. CESD20160003515 for code violations at 3440 22nd Ave
SE. The violation consisted of an unpermitted fence and structures on the property. The lien was
recorded on October 31, 2016, at O.R. Book 5328, Page 1640. The current lien amount is $138,000 based
on 1,380 days of accrued fines ($100 per day from July 4, 2016 through April 13,2020) totaling $138,000.
The property was brought into compliance on April 13, 2020.
Pursuant to Resolution No. 2012-46, a request for waiver of fines may be considered when full payment
of the full lien amount would impose a severe financial hardship on the property owner. Fines accrued by
an existing owner would be considered for a waiver as long as the existing owner has diligently pursued
abatement and compliance has been achieved. In May 2019, Tony Kelly, president of CKK Properties
LLC passed away, leaving a new owner with the responsibility of taking over the business. The new
owner diligently pursued fixing the code violations created by the previous owner, including hiring an
attorney to assist with the purchase and lot line adjustment of a neighboring lot. The new owner incurred
at least $54,000 for inspections, contractors, legal, and other fees, with the project taking some time to
complete, including a six-month wait to obtain approval from DEP. At this time, CKK Properties LLC
seeks to satisfy the lien to sell or refinance the property due to severe financial hardship. The property is
being actively maintained and owner has paid $1,500 in settlement of fines. The owner is requesting
$136,500 in accrued fines be waived; see attached hardship letter as required. There are no known code
violations at this time.
FISCAL IMPACT: Payment of $1,500 in settlement of fines has been received. If approved by the
Board, accrued fines in the amount of $136,500 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, conforms to the
Board’s policy contained in Resolution 2012-46, is approved as to form and legality, and requires
majority vote for approval. -JAK
RECOMMENDATION: To waive the remaining fines in the amount of $136,500, accept payment
amount of $1,500, and authorize the Chair to sign the attached release and satisfaction of liens for
recording in the Official Public Records.

Thank you for your follow-up and providinS previous executive summaries, submitted to the county
Commissioners, that outlined cases where owners met the specifics of Resolution 201246 and subsequently had
their fines waived by the Board of county commissioners. we appreciate that the county commissioners have
provided a means for owners to have the fines waived once compliance is obtained'
As previously indicated, our house was purchased on a short sale. lt was a dilapidated and long-time vacant house
that was an eyesore in the neighborhood.
we borrowed s37,0o0. and repaired and replaced broken windows, peeling paint etc. we were then notified by
Code Enforcement, that the propertY had an incomplete permit, from the prior owner, for the barn. We hired a
contractor to obtain a .permit by alfidavir for the barn, as directed by code Enforcement.
After hiring a contractor to work on the permit issue, Code Enforcement staff stated there was a "new problem"'
The barn is in wetlands. we had to work through a time-€onsuming process, with trips to and from Kentucky, to
obtain a permit from DEP. While working to obtain a permit by affidavit and a permit from DEP, Code Enforcement
staff stated we have a "new problem." The barn doesn't meet setback requirements. We had to take out anoth€r
loan and purchase the neighborinS property to 'obtain compliance'. while workinS through all these lssues, the
contractor we hired to obtain a 'permit by affidavit'went bankrupt. we had to start the whole process over with
another contractor and additional funds.
After four years and expense of traveling between Kentucky and Naples, numerous meetinSs with code
tnvestigators, contractors, OEP, County permitting staff, etc. to get thls code case resolved, Code Enforcement staff
has confirmed we have'obtained compliance'.
We spent an additional S54,OOO. to'obtain compliance'. My sister and I are now in debt due to the costs to 'obtain
compliance'and are financially unable to pay the fines that have accrued while we worked to 'obtain compliance.'
pursuant to Resolution No. 2012{6, we have diligently pursued abatement and achieved compliance. Payment of
the accrued Iines will impose a severe financial hardship on us. The property is actively maintained and we have
paid the operational costs as requested by Code Enforcement. We have no history of prior code violations.

Dear Mr. Ossario,
We inherited this situation. We did not build a barn, a fence, or the feeder.
We purchased the property and closed through a reputable law firm title
company. There were no outstanding permits or liens. There was not a wetland
issue. We hired JD Designs. That assured me while living in KY that they were on
top of the situation going through the process, only to find nearly 2 years later
they were dishonest and filed bankruptcy taking our money.
Renald Paul can show how we have worked on this together since JD Design
closed for the past 2 years.
I have met with every code enforcement officer assigned to the case at the
property explaining what I was told about bona fide usage, changing to
agriculture use. These meetings took a lot of time only to find out none of these
options were available. This situation was never ignored and always taken
seriously and has been very expensive to cure.
We ask to settle for 51000.00. We also ask to expedite this please, as we cannot
sell the property or refinance with the lien on our property.

As previously indicated, our house was purchased on a short sale. lt was a dilapidated and long-time vacant house
that was an eyesore in the neighborhood.
We borrowed S37,OOO. and repaired and replaced broken windows, peeling paint etc we were then notified by
code Enforcement, that the property had an incomplete permit, from the prior owner, for the barn. we hired a
contractor to obtain a 'permit by affidavit'for the barn, as directed by Code Enforcement'
After hiring a contractor to work on the permit issue, code Enforcement staff stated there was a "new problem"'
The barn is in wetlands. we had to work throuSh a time-consuming process, with trips to and from Kentucky, to
obtain a permit from DEP. While working to obtain a permit by af{idavit and a permit from DEP, Code Enforcement
staff stated we have a "new problem." The barn doesn't meet setback requirements. We had to take out another
loan and purchase the neighboring property to'obtain compliance'. While working through all these issues, the
contractor we hired to obtain a 'permit by affidavir went bankrupt. we had to start the whole process over with
another contractor and additional funds.
After four years and expense of travelinS between Kentucky and Naples, numerous meetin8s with code
lnvestigators, contractors, DEP, County permittinS staff, etc. to 8et this code case resolved, code Enforcement staff
has confirmed we have'obtained compliance'.
We spent an additional S54,OOO. to 'obtain compliance'. My sister and I are now in debt due to the costs to'obtain
compliance' and are financiallY unable to pay the fines that have accrued while we worked to 'obtain compliance'
Pursuant to Resolution No. 2012{6, we have diliSently pursued abatement and achieved compliance' Payment of
the accrued fines will impose a severe financial hardship on us. The property is actively maintained and we have
paid the operational costs as requested by code Enforcement. we have no history of prior code violations'
we respectfully request that the Board of countY commissioners, for payment of an additional 51500., waive the
remaininB fines.
