EXECUTIVE SUMMARY
Recommendation to approve the release of two code enforcement liens, with an accrued value of
$627,054.79, for payment of $2,904.79 in the code enforcement action titled, Board of County
Commissioners v. Ella III LLC., related to property located at 459 S. 8th St, Collier County, Florida.
OBJECTIVE: That the Board of County Commissioners, accept an offer to release two code
enforcement liens, with an accrued value of $627,054.79, for payment of $2,904.79 in relation to Code
Enforcement Special Magistrate Case Nos. CEPM20120016004 and CEV20170002645.
CONSIDERATIONS: As a result of various code violations, the Code Enforcement Special Magistrate
ordered the imposition of two (2) liens against Ella III, LLC for property located at 459 8th Street, Collier
County, Florida.
The lien in Case No. CEPM20120016004, is for code violations that consist of a vacant mobile home
with broken windowpanes and screens, broken doors, and a fractured exterior wall and roof line. The lien
was recorded on September 18, 2013, at O.R. Book 4966, Page 1932. The lien amount of $622,674.73 is
based on 2,484 days of accrued fines ($250 per day from April 13, 2013 through January 30, 2020)
totaling $621,000, plus $1,562.35 in boarding costs, and $112.38 in operational costs. The violation was
abated on January 30, 2020 by the new owner.
The lien in Case No. CEV20170002645, is for code violations that consist of an unlicensed and
inoperable vehicle parked at the residence. The lien was recorded on August 29, 20 17, at O.R. Book
5429, Page 2201. The lien amount of $4,380.06 is based on 83 days of accrued fines ($50 per day from
May 13, 2017 through August 3, 2017) totaling $4,150, plus operational costs of $230.06. The violation
was abated on August 3, 2017 by previous owner.
Pursuant to Resolution No. 2012-46, before a code enforcement lien settlement recommendation is made
to the Board, the following conditions must be taken into consideration: a fine/lien amount is fixed and no
longer accruing on a periodic basis; the underlying violation resulting in the fine/lien have been abated or
corrected; the history of the violation involving the offering party; fines that accrued prior to transfer of
title and thirty days following transfer of title is considered for waiver as long as the new owner has
diligently pursued abatement and compliance has been achieved; when a full payment of the full lien
amount would impose a severe financial hardship on the property owner; fines accrued by an existing
owner would be considered for a waiver as long as the existing owner has diligently pursued abatement
and compliance has been achieved; and when the amount recovered will equal or exceed the costs and
expenses incurred by the County in prosecuting the violation and obtaining, recording, and enforcing the
fine/lien.
Guery Plancher and Brunel Dupera acquired the property with the existing uncorrected code violations
via Quit Claim Deed recorded on December 26, 2019. The new owners spent a substantial amount of
time and money, approximately $2,500 for payment of permit fees for replacement of doors, and
windows, remodeling of the residence, and extensive follow up and inspections to come into compliance.
The property is actively maintained, and the new owners have paid $2,904.79 in settlement of fines and is
requesting the remaining $624,150 in accrued fines be waived. There are no known code violations
remaining on the property.
FISCAL IMPACT: Payment of $2,904.79 in settlement of fines has been received. If approved by t he
Board, accrued fines in the amount of $624,150 would be waived.

GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. KN
RECOMMENDATION: To waive the remaining fines in the amount of $624,150, accept payment
amount of $2,904.79, and authorize the Chair to sign the attached releases and satisfaction of liens for
recording in the Official Public Records.
