EXECUTIVE SUMMARY
Recommendation to approve the release of a code enforcement lien with an accrued value of
$14,630.86, for payment of $580.86, in the code enforcement action titled, Board of County
Commissioners v. Timothy Todd Lainhart, Lori Renee Lainhart, Anthony Ira Lainhart, and Deana
Renee Lainhart, related to property located at 75 25th Avenue NW, Naples, Collier County, Florida.
OBJECTIVE: That the Board of County Commissioners, accept an offer to release a code enforcement
lien, with an accrued value of $14,630.86, for payment of $580.86, in relation to Code Enforcement
Board Case No. CELU20120007339.
CONSIDERATIONS: The Code Enforcement Board ordered the imposition of a lien against Timothy
Todd Lainhart, Lori Renee Lainhart, Anthony Ira Lainhart, and Deana Renee Lainhart, in Case No.
CELU20120007339, for a code violation at 75 25th Avenue NW, Naples. The violation consisted of a
structure that had unpermitted alterations and was located on a parcel without a principal structure. The
lien was recorded on February 6, 2013, at O.R. Book 4883, Page 2981. The current lien amount is
$14,630.86, which is based on 97 days of accrued fines ($150 per day from December 21, 2012, through
March 27, 2013) totaling $14,550, plus $80.86 operational costs. The property was brought into
compliance on March 27, 2013.
Pursuant to Resolution No. 2012-46, before a code enforcement lien settlement recommendation is made
to the Board, the following conditions must be taken into consideration: a fine/lien amount is fixed and no
longer accruing on a periodic basis; the underlying violation resulting in the fine/lien have been abated or
corrected; the history of a violation involving the offering party; full payment of the full lien amount
would impose a severe financial hardship on the property owner; fines accrued by an existing owner
would be considered for a waiver as long as the existing owner has diligently pursued abatement and
compliance has been achieved; and the amount recovered will equal or exceed the costs and expenses
incurred by the County in prosecuting the violation and obtaining, recording, and enforcing the fine/lien.
The Lainhart's achieved compliance on March 27, 2013, by demolishing the structure, and the accrual of
fines ceased at this time. The Lainhart's have had no other violations related to this property. The
Lainhart's became aware of the lien while in the process of selling their homestead property, which has
become necessary to avoid financial ruin and foreclosure. The owner has paid $580.86 in settlement of
fines, which exceed the costs to the County of $80.86 and is requesting the remaining $14,050 in accrued
fines be waived. The required hardship letter is attached. There are no known code violations at this
time.
FISCAL IMPACT: Payment of $580.86 in settlement of fines has been received. If approved by the
Board, accrued fines in the amount of $14,050 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney's Office has reviewed this item and approved it as
to form and legality. Majority support is required for approval. This item conforms to the Board's policy
contained in Resolution 2012-46. KN
RECOMMENDATION: To waive the remaining fines in the amount of $14,050, accept payment
amount of $580.86, and authorize the Chair to sign the attached release and satisfaction of lien for
recording in the Official Public Records.

The subject property is jointly owned by myself, my brother, and our wives. We were unaware of the codes and mandates
involved, and we were also unaware of any liens that were put on the property. With the demolition of the garage we believed
our debt was paid. Now the lien has been transferred to our personal home, and that home is under contract to sell by March
3'1st 2020 and we are needing to sell that property to avoid a foreclosure. This Lien is creating even more financial difficulties
and further hardship for us.
Please understand that we have done nothing malicious and and to our knowledge we had complied to all board requirements
