MINUTES OF THE MEETING OF THE COLLIER COUNTY
PUBLIC VEHICLE ADVISORY COMMITTEE
Naples, Florida, November 6, 2006
LET IT BE REMEMBERED, that the Collier County Public Vehicle
Advisory Committee in and for the County of Collier, having conducted
business herein, met on this date at 9:30 A.M. in REGULAR SESSION at
the Collier County Development Services Building, 2800 N. Horseshoe
Drive, Conference Room #609, Naples, Florida, with the following members
present:

I. Call to Order
The meeting was called to order by Chairman Tony Marino at 9:33 A.M.
II. Roll Call
Roll call was taken by Evelyn Trimino and a quorum established.
III. Approval of Agenda
Correction under item IX Next Scheduled Meeting Date: December 4, 2006
instead of November 6, 2006.
Russ Berghuis moved to approve the Agenda, as amended. Second by
Reg Buxton and carried unanimously 5-0.
IV. Approval of Minutes: October 2, 2006
Russ Berghuis moved to approve the minutes of October 2, 2006 as
presented. Second by Reg Buxton and carried unanimously 5-0.
V. New Business:
Evelyn Trimino presented the following application packages, which have been
recommended for approval by staff.
A. New Application:
1. Luly's Transportation - Request is for new CTO
Owner is Lourdes Piloto and was present. Applicant was cautioned to file
a DBA iflogo is to read "School Transportation", as shown on the visual
sketch of the vehicle. Applicant responded that the word "School" would
not be used.
Randall Smith moved to recommend approval. Second by Tom Lugrin and
carried unanimously 5-0.
2. All- In Limo - Request is for New CTO.
Applicant is Douglas Daubmann. Bill Daubmann, a partner, was present.
Russ Berghuis moved to recommend approval. Second by Reg Buxton and
carried unanimously 5-0.
VI. Complaint Report (handout)
Michaelle Crowley covered the complaint report items since the last meeting,
including 16 complaints and 126 patrol cases, many of them at homecoming
events at Palmetto Ridge, Lely and Gulf Coast High Schools. Three limousine

companies at Gulf Coast were either not licensed, driver had no ID or had no
decals. Citations issued to both drivers and companies.
Complaint of Charles Limo offering rides to airport was received. A pretense call
was made, complaint was valid and staff will be sending out letter of violation.
Atlas Limousine has new owners and was sent CTO package which they are
working on.
Hot Pursuit Limousine, which looks like a police car, has the same owner as
Racing Limos. Owner stated this is not a franchise; he is selling the right to use.
Not in use, decaled or approved at this time. Michaelle will be tracking this.
Black Diamond Transportation had no CTO. They were sent application packet
and copy of Ordinance.
United Taxi and Ace American are also getting letters of violation -no CTO/Decal.
Michaelle gave a reminder- that when applying for Driver ID, they cannot operate
on just the receipt or they will incur a fine for both driver and company.
She stated she is also now going through phone books/ newspaper ads to see if
Certificate Numbers are in ads according to Ordinance. However, Ordinance may
not address internet or magazine ads.
Randy Smith suggested putting into packets going out, the reminder to post
Certificate Number in all ads.
Tom Palmer stated the Ordinance is sufficient notice and any additional notices
would be as a courtesy. Upon suggestion by Chairman Marino that an item should
be in the Ordinance that any type of ad must contain Certificate Number, Tom
Palmer noted that they could add that to changes in the Ordinance, ifPV AC so
decided.
VII. Discussion: Final Draft - PV AC Ordinance
Tom Palmer reviewed the items on the Executive Summary which will be on the
Consent Agenda. Publication and presentation to BCC for approval will follow.
After agreeing to include the requirement for Certificate Number in advertisings,
Chairman Tony Marino moved to incorporate into the Ordinance
Amendment, the provision to require all advertising to contain the Certificate
Number. Second by Russ Berghuis and carried unanimously, 5-0.

Discussion followed on adding proper wording for adding the Certificate Number
is to be required in ads, to the Ordinance. Ordinance now speaks to only phone
book and newspaper advertising. PV AC agreed that it should say, "all advertising
must include the Certificate Number" and the effective date of January I, 2007 or
the due date of the next phone book ads.
Russ Berghuis moved to recommend for approval, the drafted amendment to
the Public Vehicle for Hire Ordinance, with the addition of the provision that
all advertising must contain the Collier County Certificate Number. Second
by Reg Buxton and carried unanimously 5-0.
To the question posed regarding the letter sent to RSW, Mr. Palmer responded that
after several inquiries into the matter, the most he can do is write the letter. The
discretion to change the regulation is limited as the Federal Government has these
mandates through the Homeland Security Act.
Questions also arose on whether all drivers must have a Florida driver license
versus a valid out of state license. Michele Arnolds reply was that due to
background checks and other requirements for vehicle-for-hire operators, Collier
County vehicle-for-hire drivers must have a Florida Driver's license.
VIII. Speakers:
Ken Mastrodomenico, Taxi Time, brought up for discussion and consideration:
. The proposed rate increase change, now premature, due to the fact that
business drops 25% when rates increase. Suggested increase only when
gas goes above three dollars a gallon.
. Proposed Ordinance still concern of definition of taxi vs. sedan. Would
like to sustain the on-demand nature of taxi business and would like to
preserve their market.
. Licensing issue of too many coming in, setting up business with no plan of
knowing where business is coming from. Applications should show plan
for action. Population demands change. Running into parking problems
with businesses vying with taxis for parking space.
It was clarified that raising the rate by twenty five cents is at owner's discretion
Doug Wilcox, Aaron Airport Transportation, requested clarification on
competition between taxicab and charter rates. His understanding was that this
differentiation has been eliminated. A charter can now pick up at hotels and
charge a flat rate.
Tom Palmer The only time you must have meter turned on (in taxis) is if trip

starts and ends in Collier County. Airport trips and anything ending outside
Collier County, rates are negotiable for both charter and taxis.
Jack Bridenthal, USA Taxi, remarked on codes not being followed especially in
Marco. Cars with no meters are providing taxi service. Some advertise Airport
and Taxi service. He would like to see more checking done. Also, he requested a
copy of the Ordinance.
Ken Mastodomenico added that security is an issue at bus and airport facilities;
if vehicle is not by appointment and not on call, a taxi can be mistaken for
charter.
City Ordinances for Naples and Marco use the County's Vehicle for Hire
Ordinance and have the ability to enforce it, according to Michele Arnold. She
will contact them to provide additional enforcement.
Copies of Ordinance have been sent out but many were returned as addresses had
been changed. She emphasized business owners are to provide current addresses,
phone numbers and e-mail addresses.
VIII. Next Scheduled Meeting Date is December 4,2006 - 9:30 A.M.
There being no further business for the good of the County, the meeting was
adjourned by the order of the Chair at 10:15 A.M.
