A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, TO DISCLAIM, RENOUNCE
AND VACATE THE COUNTY AND THE PUBLIC INTEREST IN A
PORTION OF THE SANITARY FORCE MAIN UTILITY
EASEMENT AS RECORDED IN OFFICIAL RECORD BOOK 2706,
PAGE 2637 OF THE PUBLIC RECORDS OF COLLIER COUNTY,
FLORIDA, LOCATED ON THE SOUTH SIDE OF GOLDEN GATE
PARKWAY, APPROXIMATELY 0.4 MILES WEST OF
LIVINGSTON ROAD, IN SECTION 25, TOWNSHIP 49 SOUTH,
RANGE 25 EAST, COLLIER COUNTY, FLORIDA.

WHEREAS, pursuant to Resolution 2013-166, Petitioner, Ray Piacente of
Stantec Consulting Services, Inc., on behalf of the property owner, has requested the
vacation of the County and the Public interest in a portion of the Sanitary Force Main
Utility Easement as recorded in Official Record Book 2706, Page 2637 of the public
records of Collier County, Florida, located on the south side of Golden Gate Parkway,
approximately 0.4 miles west of Livingston Road, in Section 25, Township 49 South,
Range 25 East, Collier County, Florida, being more specifically shown in Exhibit A,
attached hereto; and
WHEREAS, the Board of County Commissioners, on this day, held a public
hearing to consider the petitioner's request and notice of said public hearing was given as
required by law; and
WHEREAS, the granting of the petitioner's request will not adversely affect the
ownership or right of convenient access of persons owning other parts of the subdivision.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County and
public interest in a portion of the Sanitary Force Main Utility Easement as recorded in
Official Record Book 2706, Page 2637 of the public records of Collier County, Florida,
located on the south side of Golden Gate Parkway, approximately 0.4 miles west of
Livingston Road, in Section 25, Township 49 South, Range 25 East, Collier County,
Florida, being more specifically shown in Exhibit A, is hereby vacated, extinguished,
renounced and disclaimed, and this action is declared to be in the public interest and for
the public benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board
is hereby directed to record a certified copy of the Resolution in the Public Records of
Collier County, Florida.

Legal Description

(Portion of Collier County Easement to be Vacated)
All that part of Section 25, Township 49 South, Range 25 East, being more
particularly described as follows:
COMMENCING at the Northwest corner of a 110 foot Florida Power & Light
Company Easement, as recorded in Official Records Book 185, Page 845,
Public Records of Collier County, Florida,
Thence along the West line of said 110 foot Florida Power & Light Company
Easement, South 00022'26" East 40.08 feet to a point on the southerly right-of-
way line of Golden Gate Parkway, as described in Official Records Book 3633,
Page 957;
Thence along said southerly right-of-way line for the following nine (9)
described courses:
1. South 89°32'50" West 349.56 feet;
2. North 00026'10" West 8.08 feet;
3. South 89032'50" West 294.51 feet;
4. 360.00 feet along the arc of a non -tangential circular curve concave
North having a radius of 3,901.72 feet through a central angle of
05017'12" and being subtended by a chord which bears North 87047'34"
West 359.88 feet;
Thence leaving said right-of-way, South 04151'02" West 19.98 feet to the
POINT OF BEGINNING;
Thence continue South 04051'02" West 8.50 feet to a point on the South line of
a Utility Easement as described in Official Records Book 2706, Page 2631, and
Official Records Book 2706 Page 2637, and Official Records Book 2720, Page
3180, all of the Public Records of Collier County, Florida;
Thence along the boundary of said easement in the following five (5) described
courses:
1. 456.01 feet along the arc of a non -tangential circular curve concave
North having a radius of 3,930.22 feet through a central angle of
06038'52" and being subtended by a chord which bears North 81 °49'21"
West 455.76 feet;
2. North 78029'55" West 205.30 feet;
3. South 11 °30'05" West 24.29 feet;
4. North 78029'55" West 20.00 feet;
5. North 11030'05" East 37.52 feet;
Thence leaving said easement boundary, South 78029'55" East 20.00 feet;
Thence South 11 030'05" West 4.74 feet;
Thence South 78029'55" East 205.30 feet;
Thence 455.03 feet along the arc of a tangential circular curve concave North
having a radius of 3,921.73 feet through a central angle of 6038'52" and being
