PARTIAL RELEASE OF EASEMENT
THIS PARTIAL RELEASE OF EASEMENT is made this 30771 day of
A LJ& uS I ,2006 by COLLIER COUNTY, a political subdivision of the State
of Florida, its successors and assigns, whose mailing address is 3301 Tamiami Trail
East, Naples, Florida 34112 (hereinafter referred to as "County").
WIT N E SSE T H:
WHEREAS, County is the holder of that certain Perpetual, Non-Exclusive Ingress
and Egress Easement and Perpetual, Non-Exclusive Parking Easement by and
between Naples Cay Master Association, Inc., a Florida not-for-profit Corporation and
Collier County, a political subdivision of the State of Florida and recorded on January
24, 1989 in Official Record Book 1411, Page 1013, et seq. of the Public Records of
Collier County, Florida (hereinafter referred to as "Easement"), encumbering the
premises legally described therein.
WHEREAS, Pursuant to Resolution 2000-69, adopted by its Board of County
Commissioners on March 14, 2000, County has determined that certain lands contained
within the Easement are no longer required for ingress and egress and parking, and
County is agreeable to releasing said lands as legally described in Exhibit "A" and
Exhibit "B" attached hereto and incorporated herein by virtue of this reference.
NOW, THEREFORE, in consideration of TEN DOLLARS ($10.00) and other good
and valuable consideration, the receipt and sufficiency of which is hereby
acknowledged, County does hereby release the lands described in Exhibit "A" and
Exhibit "B" from the Easement; provided, however, said Easement shall remain in full
force and effect except as to the released lands.
IN WITNESS WHEREOF County has caused these presents to be executed in
its name by its Board of County Commissioners acting by the Chairman of said Board,
the day and year aforesaid.
