Agenda 06/09/2020 Item #16E4 (Resolution - Repealing Outdoor Burn Ban Resolution 2020-65)06/09/2020
EXECUTIVE SUMMARY
Recommendation to repeal Resolution 2020-65 which enacted an outdoor burning ban in the
unincorporated areas of Collier County in accordance with Ordinance No. 2009-23, the Regulation
of Outdoor Burning and Incendiary Devices during Drought Conditions Ordinance.
OBJECTIVE: To repeal the current outdoor burning ban.
CONSIDERATIONS: On May 12, 2009, the Board adopted Ordinance No. 2009-23, the Regulation of
Outdoor Burning and Incendiary Devices during Drought Conditions Ordinance, for the purpose of
protecting public health, safety and welfare, and averting the destruction of real and personal property
caused by wildfires. Since this is a reoccurring event in our area, the Ordinance is structured similar to a
light switch, becoming applicable only upon the Board declaring a state of local emergency by
Resolution. The ban then becomes inactive upon the Board finding, by Resolution, that the local
emergency no longer exists.
On April 14, 2020, the Board implemented a burn ban in Collier County by adopting Resolution 2020-65.
Due to significant rainfall that has accumulated since the burn ban was implemented, the Division of
Emergency Management and the Collier County Fire Chiefs Association are recommending that the
Board lift the ban on all outdoor burning at this time.
FISCAL IMPACT: There are no fiscal impacts.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
GROWTH MANAGEMENT IMPACT: There are no Growth Management impacts associated with
this action.
RECOMMENDATION: To lift the burn ban by repealing Resolution 2020-65.

Dear Chairman Saunders:
Consistent with the requirements of Ordinance 2009-23, as amended, please allow this email to serve as
notification of my determination(supported by the attachments)that a drought emergency presently exists
requiring the imposition of a burning ban in unincorporated Collier County. The current State of Local
Emergency adopted by the Board on March 16, 2020 delegates to you the power and authority to take
whatever prudent action is necessary to ensure the health, safety and welfare of the community. Consistent
with that authority, I recommend that you execute the attached Resolution enacting an Outdoor Burning
Ban effective on the date of signing and to remain in effect indefinitely until further notice.
In recognition of the near-record drought conditions in Florida,Collier County is one of the driest counties
in Florida with a Keetch-Byram Drought Index(KBDI) of 600+. We have had very little rain in the last
few months, and there is no significant rainfall projected in the immediate forecast.
Current dry and windy conditions are resulting in fire behavior that is well outside the norm. Fires could
start with little effort, burning with greater intensity and could spread faster causing a drain on our local
public safety resources-already impacted by COVID-19 operations.
This ban would not apply to prescribed burns authorized by the Florida Forest Service or by those who
conduct prescribed burns as a generally accepted practice. The Forest Service and Collier County Sheriff's
office will coordinate information as to what sites and or permits have been authorized for open burning.
The Collier County Fire Chiefs have requested to enact the burn ban immediately and to remain in effect
until further notice.I support this burn ban recommendation with the understanding that should the drought
index drop substantially, and the Florida Forest Service recommends termination of the local ban,we too
will follow by rescinding the ban.
Attached is the associated ordinance,Resolution and supporting documentation for your consideration.
If you have any questions or concerns, please don't hesitate to call. I'll await notification that the Resolution
has been executed. Thank you.
Sincerely,
Leo E. Ochs,Jr.

County Manager Ochs:
In recognition of Collier County's vulnerability to wildfires during periods of extreme drought
and the current COVID 19 situation, representatives from the Florida Forest Service and Collier
County Fire and EMS Chiefs Association have met and see an urgent need to have a burning ban
for all unincorporated Collier County become effective immediately. Collier County has not
experienced any significant rainfall in several months and the current drought index is 633 which
is considered extreme.
In light of COVID 19, there is an anticipation that there may be an increase in open burning
occuring across the County. This burn ban will assist in preventing potential fire-related dangers
that could result in unneccessary emergency response as well as diminish airborne irritants
caused by burning.
This ban would not apply to prescribed burns authorized by the Florida Forest Service or by
those who conduct prescribed burns as a generally accepted agriculture practice.
This ban shall be in effect for 60 days or until the ban is recommended to be rescinded by the
Florida Forest Service or Collier County Fire and EMS Chiefs Association and the Director of
the Bureau of Emergency Services in Collier County.
Under Resolution 2017-83 the County Manager has the authority to enact the Burn Ban without
having to go through the formalities of the Board of County Commissioners. I am requesting that
you enact this resolution. This action is urged for the safety and well-being of all Collier County
residents whose lives and property may be placed at risk as a result of uncontrollable conditions.
We ask that you strongly consider issuing a burn ban to protect the citizens of Collier County
during this State of Emergency.

Collier County Fire and EMS Chiefs Association
