OBJECTIVE: To approve a First Amendment to Lease Agreement with Collier Mosquito Control District to extend the lease term for space on a County-owned communications tower. CONSIDERATIONS: Collier Mosquito Control District (District) has been leasing tower space on the County’s communications tower located on County Barn Road since June 2000. This location is essential for the District’s radio communications equipment for mosquito control operations within Collier County. The First Amendment to Lease Agreement (Amendment) extends the lease term for an additi onal five (5) years. The District has the right to terminate at any time by providing the County with a minimum of thirty days prior written notice. The annual rent shall continue to be increased by three percent from the previous year’s rent. The rent for the first year of the renewal term shall be $1,362.69. All other terms and contained in the existing lease remain in full force. FISCAL IMPACT: The annual rent shall continue to be deposited into Intergovernmental Radio Communications Program account number 188-140480-362110. GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan. LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote for Board action. - JAB RECOMMENDATION: That the Board approves and authorizes the Chairman to execute the First Amendment to Lease Agreement with Collier Mosquito Control District. The following provision shall be added to Article 2 ofthe Lease Agreement: LESSEE, however, reserves the right to terminale this Lease, with or without cause, by providing LESSOR with at least thirty days prior written notice of such termination to LESSOR at the address set forth above. Said notice shall be elfective upon the date ofLESSEE'S notice to LESSOR. 2. The following provision shall be added to Article 3 ofthe Lease Agreement: The base rent for the period of July 13, 2020, to July 12, 2021, shall be $1,362.69, and shall be increased by three percent annually throughout the life ofthe Lease. 3. Except as expressly provided herein, the Lease Agreement between Collier Mosquito Control District and Collier County, a political subdivision of the State of Florida, for the utilization of the Demised Premises described in said Lease Agreement dated June 13,2000, remains in full force and eflect according to the terms and conditions contained therein, and said terms and conditions are applicable hereto except as expressly provided otherwise herein.
