EXECUTIVE SUMMARY
Recommendation to approve the eligibility of the Disaster Permit Fee Relief program to victims of
the 36th Avenue SE Fire, allowing affected homeowners to receive targeted reductions related to
permit application and plan review fees.

OBJECTIVE: To allow affected homeowners of the 36th Avenue SE Fire to be eligible for the Disaster
Permit Fee Relief program and receive a 50% reduction of permit application and plan review fees for
residential and residential mobile home repairs as defined by the Florida Building Code and outlined in
the Collier County Growth Management Department (GMD) Development Services Fee Schedule (Fee
Schedule).
CONSIDERATIONS: At the December 12, 2017 Board meeting, item 11B, the Board approved
Resolution 2017-251 amending the Fee Schedule to include a Disaster Permit Fee Relief program that
reduces application and plan review fees by 50% for residential and residential mobil e home repairs, as
defined by the Florida Building Code, for 180 days following a Board declaration of a disaster, and
allowing for a 90-day provision beyond the 180 days where an eligible resident paid the full fees within
the initial 180-day period. The item that was approved by the Board also applied the targeted reductions
retroactively to the fees identified in the petition related to the Lee Williams fire presented to the Board at
the October 10, 2017 meeting under item 11G.
The fee schedule provides for a 50% reduction of the application and plan review fees for repairs related
to a Board-declared disaster affecting Collier County residents. The intent is to offer financial relief to
victims experiencing damage resulting in a threat to life and safety in their primary dwelling. This fee
schedule reduction applies to primary residential structures.
The disaster relief fee reductions apply to permit application and review fees as specified in section OO in
the attached Fee Schedule and include application fees for building permits, as well as fees for structural,
electrical, plumbing and gas, mechanical, and plan review. Additionally, a permit fee reduction would be
applied to the repair and full replacement of a mobile/manufactured home.
36th Avenue Wildfire
The 36th Avenue SE Fire was first reported on May 13, 2020. As of May 19, 2020, there were twelve
(12) residences destroyed and thirty-three (33) outbuildings destroyed.
Under the terms of the Disaster Permit Fee Relief program, affected owner s are eligible for reduced
application and plan review fees only when a disaster declaration is announced by the Board. With
regards to the 36th Avenue SE Fire, no disaster declaration was announced by the Board; consequently,
the affected homeowners are ineligible to participate in the Disaster Permit Fee Relief program. This
item is being brought to the Board for consideration to allow the affected homeowners to participate in
the program.
Eligibility:
As approved in Resolution 2017-251, eligibility for fee reductions are contingent upon the applicant
providing the following:
1) Proof of ownership and occupancy as a primary residence

2) Damage assessment report from the property’s insurance adjuster, Collier County Building
Official, or authorized FEMA/FDEM representative
3) Photographs depicting the declared disaster-related damage
4) Attestation that damage was caused during the declared disaster, signed by the owner
5) Owner verification that no other monetary aid from the Board has been or will be applied in
relation to disaster relief.
Timeframe:
The window of time for taking advantage of the fee reductions is 180 days from the date of the disaster.
Additional time may be granted by the Board for those eligible residents that did not make application
within the 180-day period.
FISCAL IMPACT: Based on an average permit cost of $450 for permitted repairs, the disaster relief fee
reduction applied to the additional affected homeowners could result in an approximate $9,000 reduction
of revenue primarily to Fund 113 (the “Building” fund) and to a lesser extent, Fund 131 (the “Land
Development” fund), assuming 20 residential occupancy structures were affected. This action has no
impact to the General Fund.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been reviewed by the County Attorney, is approved as to
form and legality, and requires majority vote for approval. -JAK
RECOMMENDATION: To approve the eligibility of the Disaster Permit Fee Relief program to victims
of the 36th Avenue SE Fire, allowing affected homeowners to receive targeted reductions related to permit
application and plan review fees, in accordance with the guidelines outlined in section OO in the Fee
Schedule.

1) When a disaster declaration is announced by the Collier County Board of County Commissioners,and
Board-declared provisions are enacted by the Board,the permit application and plan review fees
referenced in Sections L-Q and T(Zoning,Building,Structural,Electrical,Plumbing and Gas,
Mechanical and Mobile Home/Other Trailer),and domestic water heaters,shall be reduced by 50%.The
reduction applies only to Florida Building Code residential structures and mobile/manufactured homes
that are considered primary residences including their attached garages and carports. Excluded from the
provision are all other structures not identified above or not within the Florida Building Code residential
code,non-primary residences,damages to outbuildings and accessory structures,including but not limited
to sheds,detached carports,guest houses,and pool cages.Also excluded from this provision are
inspection fees.
2) Eligibility criteria under the Board Declared Disaster Provisions are as follows:
