A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, AUTHORIZING THE CONVEYANCE OF PORTIONS OF
THE RIGHT-OF-WAY ON COLLIER BOULEVARD (CR 951) AND OTHER
COLLIER COUNTY REAL PROPERTY INTERESTS TO THE STATE OF
FLORIDA DEPARTMENT OF TRANSPORTATION.
WHEREAS, the State of Florida Department of Transportation proposes to construct
improvements to the I 75/Collier Boulevard (CR 951) Interchange ("the Project"); and
WHEREAS, it is necessary that portions of the Collier Boulevard right-of-way presently
owned by Collier County, a perpetual air rights easement, a temporary construction easement and
Collier County's interest in part of a lake, drainage, maintenance and access easement, all of which
are described in composite Exhibit "A" (collectively, "the Property"), be acquired by the State of
Florida Department of Transportation for construction of the Project; and
WHEREAS, pursuant to Section 125.38, Florida Statutes, a Resolution setting forth such
conveyances to the State of Florida Department of Transportation, must be approved by the Board;
and
WHEREAS, the State of Florida Department of Transportation has made application to
Collier County to execute and deliver to the State of Florida Department of Transportation the deeds
and other conveyance instruments set forth in Exhibit "A", conveying all rights, title and interests
that Collier County has in and to the Property required for transportation purposes, at no additional
cost to the State of Florida Department of Transportation, and said request having been duly
considered; and
WHEREAS, said use is in the best interest of Collier County; and
WHEREAS, the Property is no longer necessary for Collier County purposes.
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Collier
County, that the application of the State of Florida Department of Transportation for the Property
owned by the County is for transportation purposes that are in the public or community interest and
for public welfare; that the Property required for transportation purposes by the State is no longer
needed for Collier County purposes; and that the Chairman is hereby authorized to execute the
deeds and other conveyance instruments set forth in Exhibit "A" in favor of the State of Florida
Department of Transportation, conveying all right, title and interest of Collier County in the
Property described in Exhibit "A", along with such other closing documents needed to effectuate

transfer, after approval by the Office of the County Attorney, at no additional cost to the State of
Florida Department of Transportation.
BE IT FURTHER RESOLVED that a certified copy of this Resolution be forwarded
forthwith to the State of Florida Department of Transportation at Bartow, Florida.
