Attachment 16A 9 SIXTH AMENDMENT TO AGREEMENT #18-7245 FOR COLLIER COUNTY COMPREHENSIVE WATERSHED IMPROVEMENT PLAN THIS AMENDMENT, made and entered into on thisalj*' day of Mg 2020, by and between Taylor Engineering, Inc., (the "Consultant") and Board of Count Commissioners for Collier County, a political subdivision of the State of Florida, (the "County"): WHEREAS, on July 10, 2018 (Agenda Item 11.H), the County entered into an Agreement with Consultant to obtain the professional engineering services for project development and permitting of the Collier County Comprehensive Watershed Improvement Plan; and WHEREAS, on September 24, 2018, Amendment to the Agreement to replace Schedule Schedule E containing the vendor's signature; and the County administratively approved the First E, Truth in Negotiation Certificate with an updated WHEREAS, on November 13, 2018 (Agenda Item 16.A.25), the County approved the Second Amendment to the Agreement to (i) add Task 1.5, Countywide Evaluation of FDEP Comprehensive Verified List, for the lump sum of $44,490, (ii) add Subtask 1.5.1, Coordination with FDEP: Numeric Nutrient Criteria for Rookery Bay, for the time and materials amount of $12,833, (iii) delete Task 2.3, Grants Management for $35,916, (iv) reduce Contingency from $125,000 to $103,593, which will retain the amount of the contract award at $1,499,994, and (v) allow Lump Sum payments; and WHEREAS, on April 23, 2019 (Agenda Item 16.A.10), the County approved the Third Amendment to the Agreement revising Schedule A -Scope of Services to: (i) further define Task 1.3 Environmental Data Collection and Analysis, (ii) add Task 1.4.1 Water Availability Analysis, (iii) include additional tasks under Phase 2 Permitting, and (iv) revise Schedule B-Basis of Compensation to add new subtask and revise line item totals; and WHEREAS, on June 11, 2019 (Agenda Item 16.A.4), the County approved the Fourth Amendment to the Agreement to add: (i) Subtask 1.2.1 Additional Coordination Regarding Property Rights and TDR Incentives, (ii) Subtask 1.4.2 Additional Field Reconnaissance for Flow -Way Modifications to Schedule A -Scope of Services, and (iii) make a change in Schedule B-Basis of Compensation to add new subtasks and revise line item totals; and WHEREAS, on November 12, 2019 (Agenda Item 16.A.21), the County approved the Fifth Amendment to the Agreement to add subtask 1.2.2 Additional Coordination-GMP/LDC Code Revisions and revise line item totals resulting in no change to the total contract amount; and WHEREAS, the Parties desire to further amend the Agreement to revise Schedule A Scope of Services to: (i) expand upon Tasks 1.4, 2.1, and 2.2, and (ii) modify Schedule B, 2. Words Struck Thro are deleted; Words Underlined are added Page 1 of 4 Sixth Amendment to Agreement 418-7245 16A 9 18-7245 — Collier County Comprehensive Watershed Improvement Plan Schedule A Phase 1 - Permitting Needs Assessment, Data Collection, and Analysis 1.4 Hydrologic, Hydraulic, and Water Quality Modeling and Analysis This task includes additional hydrologic and hydraulic model runs, post-processinq of results, and water quality evaluations necessary to respond to SFWMD's request for additional information received on March 13, 2020. Phase 2- Permitting and Grant Management 2.1. Prepare Permit Application Depending on the results of the Permitting Needs Assessment and data collection activities, it is anticipated that sufficient funding may remain to perform permitting and design activities required by regulatory agencies for the following permits: • SFWMD Conceptual Environmental Resource Permit (ERP) • USACE Federal Dredge and Fill Permit Task includes development of permit applications and associated narratives, analyses, and exhibits such as: • GIS mapping of vegetation and species pre- and post -project (projected), • Water level and depth mapping pre- and post -project for an array of conditions including expected seasonal changes and design storm events required per the Basis of Review, • NEPA support including environmental and biological assessments, and • Responses to requests for additional information (RAls). This task includes additional efforts to respond to the extensive RAI received from SFWMD on March 13, 2020, and an anticipated RAI from the USACE 2.2 Prepare Preliminary Design Plans The activities completed in Phase 1 will be used to update the design parameters of the previous (Atkins, 2016) conceptual design plans. The Consultant will develop a refined and updated set of conceptual/preliminary drawings that will serve to support the permit applications. These drawings will not be of sufficient detail for construction but will convey the design intent suitable for a conceptual ERP. Design -level surveys of individual project areas (i.e., for preparation of final construction drawings) are not included in this effort. The Consultant will also revise the conceptual drawings in response to certain items requested by SFWMD in their RAI dated March 13. 2020, and as necessary to accommodate inqress/eqress issues in the proposed flow -ways around the Naples Reserve development.
