Code Enforcement Investigator Ybaceta testified he supported the request from the Respondent in asking for an extension of time due to the Respondent having personal medical problems. Special Master granted an extension of time and will continue the Case to be reset on notification from the Investigating Officer if necessary. 3. PUBLIC HEARINGS 7. Case #2006081090 - BCC vs. Corinna & Dionicio Martinez This Hearing was requested by Code Enforcement Thomas Keegan who could not be present. Code Enforcement Investigator Carol Sykora presented the case in his absence. The Respondent was present. Violation(s): 04-41 Sec. 2.01.00 (C) Commercial Equipment/Vehicles in Residential Violation is at 810 Jackson Street, lmmokalee. This is zoned RMF-6. This is a repeat violation from Case #2006050151. Photographs were presented and entered into the record as Collier County Composite Exhibit "A" The Respondents testified they do park at the above address. They were told to remove it or store in an enclosed structure. They had removed them at one time, but moved them back. They admitted to the violation. They have the property for sale at this time. Finding the notice of hearing was properly served, the Respondent is found GUlL TY of the alleged violation(s) and is ordered to abate the violation on or before October 9, 2006 or a fine of $500 per day will be imposedfor each day the violation remains thereafter. Being this is a repeat Violation, Respondent is ALSO ORDERED to pay afine of$l,OOO on or before November 6, 2006. 5 October 6, 2006 Respondent is ordered to pay the previous Operational Costs in the amount of $113.46 incurred by Code Enforcement during the prosecution of this case on or before October 13,2006 and the present Operational Costs of $113.46 on or before November 6, 2006. The Respondent is to notify the Investigator within 24 hours of a workday to concur the violation has been abated. 16. Case #2006040575 - BCC vs. David Lee & Lisa Ann Gonzales This Hearing was requested by Code Enforcement Investigator John Santafemia who was present. The Respondent(s) was also present. Violation(s): 04-58 Sec. 6 Sub Sec. 1,4,5,6,8,9, 10, 11, 12A, B, C, D, F, G, H, I, J, K, L, M, N, 0, P, Q, 19A, B, C & 20 Numerous Minimum Housing Violations Violation was at 1909 Immokalee Drive, Immokalee. The Health Dept. contacted the Investigator regarding concerns of violations at the above address. Photographs were offered into evidence as Collier County Composite Exhibit "A." Both units had similar numerous violations of which were described. At one time the Health Dept. considered condemning the buildings and requiring them to be demolished. A completed Minimum Housing Violation NOV was mailed to the Respondent. On July 10, 2006 the Respondent contacted Investigator Santafemia and was informed the property was now vacant. The Health Dept. found the tenants suitable housing. The Respondent stated he was hiring a Contractor to get cost estimates to repair the property. After inspection on August 10th & 29th, 2006 the condition remained the same. (4 units) The Respondent testified he wasn't aware he had a deadline to repair the property. He has also been waiting for financial help. Investigator Santafemia stated the NOV had a compliance date of July 19,2006. The Respondent was under the impression if it was vacated he had complied. Finding the Notice of Hearing was properly served; the Respondent isfound GUILTY of the alleged violation(s) and is ordered to come into compliance with all County Codes by: 1) Obtaining a Demolition Perm it for all substandard structures and remove buildings and debris on or before November 6,2006 or afine of $250 per day will be imposedfor each day the violation continues, 2) Bringing into compliance all non-permit items by obtaining information from the Building Department on or be November 6,2006 or afine of $250 per day will be imposedfor each day the violation continues. 3) Obtain a Certificate of Occupancy or Certificate of Completion for Permit items on or before December 6,2006 or afine of$250 will be imposedfor each day the violation remains thereafter. 4) If Respondent fails to comply with the above recommendations on or before December 6, 2006, Collier County will then abate the violation by demolition, and costs incurred will be assessed the Respondent or the property. Respondent is ordered to pay Operational Costs in the amount of $216.91 incurred by Code Enforcement during the prosecution of this case on or before December 6,2006. The Respondent is to notify the Investigator within 24 hours to concur that "each" violation has been abated. 6 October 6, 2006 **Respondent is ALSO ORDERED that no one can occupy the premises until the structures are in a condition meeting all the Codes and Ordinances. All items in and on the premises need to be secured on or before October 13, 2006. The Respondent will also post the property that it is a dangerous structure and to obtain a Boarding Certificate prior to boarding all entrances (windows and doors) to the structures on or before October 13, 2006. Respondent is to notify the Investigator within 24 hours to concur the above orders concerning the premises has been done. 17. Case #2006070434 - BCC vs. William Williams This Hearing was requested by Environmental Investigator John Santafemia who was present. The Respondent was also present. Violation(s): 04-58 Section 6, sub Sec. 1, 11, 12B, C, I, L & 20 Minimum Housing Violations Violation is at 641 N. 9th Street, Immokalee. On July 17, 2006 a complaint was filed by the tenant at that location. Inspected and found numerous violations. NOV was mailed on August 15,2006. No contact with the Respondent as no phone number had been found. The Investigator has been told the tenants no longer reside at that address. Photographs were offered into evidence as Collier Counties Composite Exhibit "A." The Respondent testified he was evicting the tenants. Since then the property has been sold. The Respondent stated the new owners will be making the repairs. Finding the Notice of Hearing was properly served, the Respondent is found GUILTY of the alleged violation(s) and is ordered to contact and notify the new owners with providing proof to the County Attorneys Office and abate the violation on or before October 13, 2006 or a fine of $250 per day will be imposedfor each day the violation remains thereafter. Respondent is ordered to pay Operational Costs in the amount of $157.16 incurred by Code Enforcement during the prosecution of this case on or before November 6, 2006. This order will become a lien on the property. The Respondent is to notify the Investigator within 24 hours of a workday to concur the violation has been abated. The Assistant County Attorney, Jeff Wright, wanted the Respondent to be aware of the following: Under Florida Statutes Section 162.06 Sub Section 5 - if the owner of property that is subject to an enforcement proceeding before a Special Master, and if they transfer the ownership of the property between the time of the initial pleading and the time of the Hearing, the owner has to provide certain disclosures. Case #2006030278 - BCC vs. Edward Slasienski This Hearing was requested by Code Enforcement Investigator Heinz Box who was present. The Respondent was not present. Violation(s): 04-41 Section 2.01.00 (A) Unlicensed Vehicle Violation occurred at 1100 Highlands Drive and has been abated. 7 October 6, 2006 Finding the notice of hearing was properly served, and finding the Violation did exist, but was CORRECTED prior to today's Hearing, Respondent is found guilty of the alleged violation(s) and is ordered to pay Operational Costs in the amount of $162.98 incurred by Code Enforcement during the prosecution of this case on or before November 6, 2006. 11. Case #2005090008 - BCC vs. Barbara Lone This Hearing was requested by Code Enforcement Investigator Eddie Ybaceta who was present. The Respondent was not present. Violation(s): 04-41 Sec. 10.02.06 (B) (1) (A) 10.02.06 (B) (1) (B) & 2001 FL Bldg Code 104.1.1 Unlicensed/Inoperable Vehicle (Agenda is corrected to read Violation is: Renovation and Remodeling of Structure/Building without Proper Permits) This was Investigator Olney's case who is no longer with the Department. The Structure was burned out and is being re-built without permits. Finding the notice of hearing was properly served, the Respondent is found GUILTY of the alleged violation(s) and is ordered to: 1) hire a Contractor licensed in Collier County and prepare and submit detailed Architectural drawings for complete rehabilitation of the structure to Collier County Review and Permitting on or before December 6, 2006 or a fine of $200 per day will be imposed for each day the violation remains thereafter. 2) When permits are issued, the Respondent will have all required inspections done by obtaining a Certificate of Occupancy or Certificate of Completion on or before April 6, 2007 or afine of $200 per day will be imposed for each day the violation remains thereafter. (OR) the Respondent is ALSO ORDERED to obtain a Demolition Permit, if needed. and have the structure demolished by a licensed Contractor and must remove all debris on or before December 6, 2006 or a fine of $200 per day will be imposed each day the violation remains thereafter. Respondent is ordered to pay Operational Costs in the amount of $166.35 incurred by Code Enforcement during the prosecution of this case on or before November 6,2006. The Respondent is to notifY the investigator within 24 hours of a workday to concur the violation has been abated. 12. Case #2006080856 - BCC vs. Jon & Wendy Davis This Hearing was requested by Code Enforcement Investigator Eddie Ybaceta who was present. The Respondent(s) were not present. Violation(s): 04-41 Sec. 2.01.00 (B) Recreational Vehicles Investigator Ybaceta testified the Respondent wanted the County to abate the violation. Special Master Garretson stated on September 27,2006 the Respondent asked for a Continuance. No reason was stated for their absence at this Hearing. Motion for Continuance was DENIED. Finding the notice ofhearing was properly served, the respondent isfound GUILTY of the alleged violation(s) and is ordered to abate the violation by removing both recreational vehicles 8 October 6, 2006 or make operable and license the vehicles on or before October 11,2006 or afine of $50. 00 per day will be imposed for each day the violation remains thereafter. Respondent is ordered to pay Operational Cost in the amount of 127.25 incurred by Code Enforcement during the prosecution of this case on or before November 6,2006. The respondent must notifY Code Enforcement within 24 hours of a workday to concur the violation has been abated. 13. Case #20060606327 - BCC vs. Jon & Wendy Davis This Hearing was requested by Code Enforcement Investigator Eddie Ybaceta who was present. The Respondent( s) were not present. Violation(s): 04-41 Section 2.01.00 (A) Unlicensed/Inoperable Vehicle Vehicles still remain - photographs were submitted into evidence as Collier County Composite Exhibit "A." Finding the Notice of Hearing was properly served, the Respondent is found GUILTY of the alleged violation(s) and is ordered to abate the violation by removing the vehicles or make operable and license on or before October 11, 2006 or a fine of $50 per day will be imposed for each day the violation remains thereafter. Respondent is ordered to pay Operational Costs in the amount of $125.27 incurred by Code Enforcement during the prosecution of this case on or before November 6,2006. The Respondent is to notifY the Investigator within 24 hours of a workday to concur the violation has been abated. 5. OLD BUSINESS A. Request for Imposition of Fines/Liens 1. Case #2005100724 - BCC vs. Randy Shelton The Code Enforcement Investigator John Santafemia was present. The Respondent was not present. Property located at 4400 20th Avenue SW, Golden Gate City. Case was presented in February 17,2006. Minimum Housing Violations were to be repaired within 30 days of the Hearing or a $250 fine would be imposed for each day it continues along with a fine of $500. The property has been checked and at this time the Respondent has done nothing to the property with it deteriorating further. It is not occupied. Seeing the Violations have not been abated, Special Master Garretson imposed the fines of $250 per day from March 17, 2006 to October 5, 2006 as a lien in the amount of $50,500 as well as the $500 and Operational Costs of $182. 23 with a total amounting to $51,182.23. Fines will continue to accrue. If the lien is removed, the Respondent will pay the amount that is on the face of the Lien plus any fines that accrue from October 5, 2006 to the date of Satisfaction. 6. NEW BUSINESS A. Request for Reduction of Fines 9 October 6, 2006 1. Case #2006020108 - BCC vs. Delio Condomina The Code Enforcement Investigator Joe Mucha was present. The Respondent was also present. Supervisor Code Enforcement Dennis Mitchell testified the County feels in the best interest of fairness and the Respondents ill health to waive the fines. The Respondent has made progress and abated the violation. The Respondent has also entered into a payment plan and agreed to pay the fines imposed which respondent is doing in a timely manner. Taking that all into consideration, the County has no objection to waiving the fines in the amount of $4,500. Special Master Garretson noted the compassion o/the County and accepted the Resolution o/the case and will not impose the $4,500 Accrual 0/ Fines. 7. REPORTS - None 8. COMMENTS - None 9.
