Resolution 2006-228 RESOLUTION NO. 06N-.E~ A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, CONCERNING PETITION AVESMT -2006-AR-9540, DISCLAIMING, RENOUNCING AND VACATING THE COUNTY'S AND THE PUBLIC'S INTEREST IN TWO 30 FEET WIDE RIGHT-OF-WAY EASEMENTS LOCATED IN SECTION 18, TOWNSHIP 49 SOUTH, RANGE 26 EAST, AS RECORDED IN O.R. BOOK 353, PAGE 72, AND O.R. BOOK 2860, PAGE 553, AND AS SHOWN ON THE PLAT OF ANDALUCIA, AS RECORDED AT PLAT BOOK 43, PAGES 93-97, PUBLIC RECORDS OF COLLIER COUNTY, FLORIDA, AND AS FURTHER DESCRIBED IN EXHIBIT "A" WHEREAS, pursuant to Section 177.101, Florida Statutes, Petitioner, DJMC Homes, LLC, has requested the vacation of two 30 feet wide right-ot-way easements ("ROW Easements") located in Section 18, Township 49 South, Range 26 East, as recorded in O.R. Book 353, Page 72, and in O.R. Book 2860, Page 553, and as shown on the Plat of Andalucia, as recorded at Plat Book 43, Pages 93-97, Public Records of Collier County, Florida, and as more specifically described and depicted in Exhibit "A"; and WHEREAS, the Board of County Commissioners of Collier County, Florida, has this day held a public hearing to consider the aforementioned request to vacate the ROW Easements, and notice of said public hearing to vacate was given as required by law; and WHEREAS, the granting of the request to vacate will not adversely affect the ownHrship or nght of convenient access of the property owners; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's interest in the ROW Easements specifically described in Exhibit 'A' are hereby vacated, extinguished, renounced and disclaimed, and this action is declared to be in the Public's interest and for the Public's benefit. BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board is hereby directed to record a ~ertitied copy of this Resolution in the Official Records of Collier County, Florida, and to make proper notation ot this vacation on the recorded plat as referenced above.
