A RESOLUTION OF THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA,
RELATING TO PETITION AVROW-2006-AR-9221,
DISCLAIMING, RENOUNCING AND VACATING THE
COUNTY'S AND THE PUBLIC'S INTEREST IN A 10-FOOT
UTILITY EASEMENT LOCATED ON TRACTS 24, 25, 26, 27,
AND 28; A 15-FOOT DRAINAGE EASEMENT LOCATED ON
TRACT 26; AND A PORTION OF A GO-FOOT RIGHT -OF-
WAY KNOWN AS TOLLHOUSE DRIVE TRACT "A"
ACCORDING TO THE PLAT OF "TOLLGATE COMMERCIAL
CENTER PHASE THREE" AS RECORDED AT PLAT BOOK
22, PAGES 95 THROUGH 100, PUBLIC RECORDS OF
COLLIER COUNTY, FLORIDA, AND AS FURTHER
DESCRIBED IN EXHIBIT 'A'
WHEREAS, pursuant to Section 177.101, Florida Statutes, Jeppesen
Engineering, Greg Jeppesen, P.E. as agent for the Petitioner, Tollgate Business
Park, LLC, has requested the vacation of a 10-foot utility easement located
between Tract 24, 25, 26, 27, and 28; a 15-foot drainage easement located on
Tract 26; and a 60-foot right-of-way on Tollhouse Drive Tract "A" according to the
plat of "Tollgate Commercial Center Phase Three", Public Records of Collier
County, Florida, specifically described in Exhibit 'A'; and
WHEREAS, the Board has this day held a public hearing to consider
vacating and notice of said public hearing to vacate was given as required by
law; and
WHEREAS, the granting of the vacation will not adversely affect the
ownership or right of convenient access of the property owners; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that the County's 10-foot
utility easement located along Tracts 24, 25, 26, 27, and 28; a 15-foot drainage
easement located on Tract 26; and a 60-foot right-of-way on Tollhouse Drive
Tract "A" according to the plat of "Tollgate Commercial Center Phase Three" as
specifically described in Exhibit 'A' are hereby vacated, extinguished, renounced
and disclaimed, and this action is declared to be in the Public's interest and for
the Public's benefit.
BE IT FURTHER RESOLVED AND ORDERED that the Clerk to the Board
is hereby directed to record a certified copy of this Resolution in the Official
Records of Collier County, Florida, and to make proper notation of this vacation
on the recorded plat as referenced above.
This Resolution adopted after motion, second and majority vote favoring
