EXECUTIVE SUMMARY
Recommendation to adopt a resolution authorizing the acquisition by gift, purchase, or
condemnation of fee interest in holdout parcels required for the future development of essential
government services at the Resource Recovery Business Park north of the Collier County Landfill.
OBJECTIVE: To adopt a resolution authorizing the acquisition of lands by gift, purchase or
condemnation to facilitate the future development of essential government services at the Resource
Recovery Business Park. (Project No. 59007).
CONSIDERATIONS: There are three (3) properties included in the Gift, Purchase and Condemnation
Resolution as shown on the attached Location Map that are surrounded by preserve and the County’s well
systems. These parcels are located in or adjacent to the County-owned Resource Recovery Business Park
(RRBP) north of the Collier County landfill and are considered “holdout” properties. The County has
reached out to the property owners over the years offering to purchase their land at fair market value in
order to encourage continuity of preservation, achieve exotic vegetation mitigation requirements, and
ensure safety of County infrastructure, and promote a good neighbor policy to avoid un -desirable
operations near privately owned homes.
Property #1 has filed suit against the County for access. All parcels are currently vacant. The location of
these parcels present security and safety issues for existing and future County infrastructure. Specifically,
there are several production wells that supply raw water for potable water treatment processes located on
the RRBP (Exhibit 1). The Resource Recovery Business Park is zoned for essential government
operations that are required for human health and safety, though are not desirable, especially when
located in close proximately of privately-owned homes. The Resource Recovery Business Park will
eventually consist of a solid waste transfer station, transporting 1200 tons of trash each day, and a
biosolids processing facility. Currently a Sheriff’s Evidence and Inventory Building are scheduled for
construction and will require the security measures; therefore, a private road or access will not be
permitted. The Resource Recovery Business Park will provide essential government services that directly
benefit the health, safety and welfare of County residents and visitors; consistent with the County’s
mission to provide the best place to work, live, and play.
The parcels conflict with Growth Management’s Land Development code to encourage continuity of
preservation areas; where 50% of the Resource Recovery Business Park is designated as State sending
lands preserve in order to retain, maintain, and preserve native vegetation and maintain wildlife corridor
connectivity. As shown on Exhibit A attached to the Resolution and also shown on the attached Exhibit
2, these properties are surrounded by Preserve and mitigation areas. Since 2013; the County has
maintained Army Corp and State permits that require exotic removal. The County -owned property is
required to maintain less than 5% exotic vegetation. The outlying parcels provide exotic seed sources,
inhibiting native growth management in the conservation permitted areas. These mitigation requirements
cost the County up to $50,000 per year, depending on the impact from neighboring seed sources and fire.
The exotic removal is in perpetuity, thereby, these excessive costs and conservations efforts will continue
to be impacted. Acquisition of these parcels provides conservative conservation efforts, as required by
permits, as well as, relieves excess costs for mitigation, and allows for the continuity of habitat area, as
well as, secures the County’s critical infrastructure.
Additionally, there have been numerous issues with ATVs and trucks tr espassing and damaging fence
lines and tampering with well head infrastructure. In certain instances, these incidents could be related to
individuals trying to access their properties through other areas of the preserve and business park.

The adoption of the attached resolution will provide staff with the Board’s authority to secure title work,
obtain independent real estate appraisals and negotiate for the purchase and condemnation, if necessary,
of the fee interest in lands for the future development of essential government services at the Resource
Recovery Business Park. Gift and Purchase Resolutions delegate to the Chairman or his designee and to
the County Manager certain ministerial authorities that streamline the acquisition process and preclude
the necessity to return to the Board for the approval of each and every purchase. The Board is advised
that it is necessary and in the public’s best interest to acquire, by condemnation if necessary, the fee
interest specified on the legal descriptions attached to the resolution.
In addition to the direct cost of the land required to facilitate the future development of essential
government services at the Resource Recovery Business Park, the County is also required to pay all
expenses for title work, real estate appraisals, and those expenses related to condemnation when
necessary, such as property owner attorney fees and expert witness fees, according to Sections 73.091 and
73.092, F.S. To the extent settlements are achieved in lieu of litigation, these co sts may be reduced
significantly.
FISCAL IMPACT: The fiscal impact associated with acquiring the three (3) parcels and associated
costs is estimated to be $414,900. Funding is available in the Resource Recovery Business Park project
59007 within the Solid Waste Capital Fund 474 and is consistent with the FY20 Capital Budget approved
by the Board September 19, 2019. The source of funding is solid waste user fees.
GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan
standards to ensure the adequacy and availability of viable public facilities.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote
for Board action. - CMG
RECOMMENDATION:
Adopt the attached resolution;
Authorize the Chairman to execute same on behalf of the Board; and
Authorize any budget amendments that may be necessary to implement the collective will of the
Board as evidenced by the adoption of the attached Resolution and the approval of this Executive
Summary.
