A RESOLUTION PROVIDING fOR THE ESTr~BLISf1MENT
OF SOCIAL AND FRATERNAL ORGANIZATIONS AND
CARE FACILITIES CONDITIONAL USES "2" l\llO "5"
IN THE "E" ESTATES ZONING DISTRICT PURSUANT
TO SECTION 2.2.3.3 Of THE COLLIE? r:OUIJ1"(
LAND DEVELOPMENT CODE FOR PROPERTY LOCATED
IN SECTION 29, TOWNSHIP 49 SOUTH, RANGE 26
EAST, COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in ~hapler
67-12~6, La~s of Florida, and Chapter 125, Florida Statutes, has
conferred on Collier County the power to establish, c~ordinate dnd
enfor~e zoning and such business regulations as ar~ nec~Ss~ry far the
protection of the public; and
WHEREAS, the County pursuant thereto has ~doptcrl d 1.dnd
Development Code (Ordinance No. 91-102) which :ncl~jos .1
Comprehensive Zoning Ordinance establishlng regulations for the
zoning of particular geographic divisions of the County, amonq ~hich
is the granti~g of Conditional Uses; and
WHEREAS, the Collier County Planning Commission, being the duly
appointed and constituted planning board for the drea hereby
affected, has held a public hearing after notice as in s~id
regulations made and prOVided, and has considered the adVisability of
Conditional Uses "2" and "5" of Section 2.2.3.3 in an "E:" ESlc1t'~s
zone with specific limitation that IJses conducted are rhose '.~it~i':n
the charter of tho Foundation for Mental Health~ :nc. on the property
hereinafter described, and has fou~d as a matter of fact (E%hlbit
"A") that satisfa.:tory provision and arrangement !'1a\'f) bf)en made

WHEREAS, all interested parties have been given opportu~i:y to
be heard by this Board in a public meeting assembled dnd the BOdrd
having considered all matters presented.

An appropriate portion of native vege~ation shall be
retained on site as required in Section 3,9.5.S.~.

An exotic vegetation removal, monitoring, and

be submitted to Current Planni~g Environmental Staff
for review and approval prior to final site plan!

d. A six (6) foot decorative masonry fence/~all shall be
constructed along the north property line OPPOsite
vehicular use areas at the time said vehicular use
areas are constructed.
c. Light st~ndards shall not oxceed a height of sixteen
(16) feet and shall be shielded to ensure that no
light reflection projects to the north property line.
Said standards shall be installed by the time
vehicular use improvements and/or additions are made.
BE IT FURTHER RESOLVED that this Resolution be reCorded in the
minutes of this Board.
