RESOLUTION NO. 98-_-LL6
RELATING TO PETITION NUMBER V-98-3,
fOR l\. Vl\.R!l\.NCE ON PR0Pfo:R1"{ Ilfo:PF:HJl\.FTEH
DESCRIBED IN COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 125,
Florida Stat~t~s, has conferred on all counties in Florida the pow~r to
establish, ccordi~ate and enforce zoning and such businoss regulations as
are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development
Code (Ordinance No. 91-102) which establishes regulations for the zoning
of particular geoqraphic divisions of the County, among ~Ihich is the
granting of variances; and
WHF:REl\.S, the Board of Zoning Appeals, being the duly elected
constituted Board of the area hereby affected, has held a public h0aring
after notice as in said regulations made and provided, and has considered
the advisability of a 6-foot variance from the required side yard of 15
feet to 9 feet as shown on the attached plot plan, Exhibit
"l' "

zone for the prOpE,rty hereinafter described, and has found ~s ~ ~atter of
fact that satisfactory provision and arrangement have been made
concerning all ap~licable matters required by said regulations and in
accordance with SEction 2.7.5 of the Zoning Regulations of said Land
Development Code for the unincorporated area of Collier County; and
WHEREAS, all interested parties have been gi~en cpportunity to be
heard by this Soard in public meeting assembled, and the eoard ha~ing
considered all matters presented;

1. In the c~se of destruction of the encroaching structure, for
any reason, to an extent equal to or greater than 50 percent of
th~ actual replacement cost of the structure at the time of its
destru~tion, any reconstruction shall ~onform to th0 pro~ision~
of th~ ~pplicable zoning code in effect at the time of
reconstruction.
2. Th~ Si:~ Dq~~l~pment Plan shall indica~0 tho continuation of
th~ ir.~~r~al side~~lk to the eastern access door.
3. The Sit~ Development Plan shall indicate landscaping along the
southeast corner of the addition, which shall include, at a
minimum, three mature palm trees and shrubbery.
