EXECUTIVE SUMMARY
Recommendation to approve a Termination of Easement to release a portion of the 1984 recorded
Utility Easement with Florida Power & Light Company and to approve a new Underground
Easement (Business) to Florida Power & Light Company to memorialize the location of the existing
electrical services.
OBJECTIVE: Terminate a portion of an existing ten (10) foot wide Utility Easement with Florida
Power & Light Company and approve a new Underground Easement (Business) to Florida Power & Light
Company.
CONSIDERATIONS: On February 7, 1984 a Utility Easement to Florida Power & Light Company, a
Florida corporation (hereinafter “FPL”), was granted by Collier County for electrical power to the J1 Jail.
Said Easement was recorded on March 8, 1984 in Official Records Book 1069, Page 1628.
When the J2 Jail was constructed, it was located on top of the existing utility service and as a result the
existing utility service had to be relocated. It is apparent the easement for the relocation of the existi ng
utility service was never recorded.
To correct this situation, a portion of the existing utility service required relocation and a new easement is
required to record the location of where the electrical service lines were relocated to.
The Easements have been reviewed and approved by Facilities Management Project Manager and the
County Attorney’s Office.
GROWTH MANAGEMENT IMPACT: None.
FISCAL IMPACT: The cost of recording the Termination of Easement and the FPL Underground
Easement (Business) will not exceed $81.00 and will be paid from the County-Wide Capital Projects
Fund 301.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a
majority vote for Board action. -- JAB
RECOMMENDATION: That the Board:
1. Approves the Termination of Easement and the FPL Underground Easement (Business) to
Florida Power & Light Company; and
2. Directs the County Manager, or his designee to record the Termination of Easement and FPL
Underground Easement (Business) in the official records of Collier County, Florida
