2020 CENSUS AGREEMENT
(Use of Public Facilities)

THIS 2020 CENSUS AGREEMENT ("Agreement") is made and entered into this 0 day of
2020, by and between UNITED STATES CENSUS BUREAU, Atlanta Regional
Center (the "Bureau"), THE DISTRICT SCHOOL BOARD OF COLLIER COUNTY, FLORIDA (the
"School District"), and THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,
FLORIDA AS THE GOVERNING BODY OF COLLIER COUNTY (the "County").
RECITALS:
WHEREAS, the United States Census is mandated by the United States Constitution in Article 1,
Section 2;
WHEREAS, the United States has counted its population every ten (10) years since 1790;
WHEREAS, the United States Census of 2020 (the "Census") will be the twenty-fourth (24")
United States Census;
WHEREAS, the upcoming National Census Day, the reference day for the Census, shall be April
1, 2020;
WHEREAS, the Census presents an educational opportunity for the School District to foster civics
education;
WHEREAS, the School District and the County recognize and acknowledge the importance of the
Census to the local community; and
WHEREAS, the School District and the County would like to make certain facilities available to
the Bureau for the purpose of facilitating the completion of the Census.
WITNESSETH:
NOW, THEREFORE, in consideration of Ten Dollars ($10.00) and other good and valuable
consideration exchanged amongst the parties, and in consideration of the covenants contained above and
herein, the fact that all of the above recitals are true and correct and shall be fully incorporated herein and
form part of the basis for this Agreement, the parties agree as follows:
1. Recitals; Definitions. The foregoing recitals are true and correct and are incorporated into this
Agreement. The parties hereto agree and acknowledge that the intent of this Agreement is to create a legally
binding contract, whereby the School District and the County would like to make certain facilities available
to the Bureau for the purpose of facilitating the completion of the Census.
2. Term. The School District and the County shall make certain facilities available to the Bureau at
specified times, as determined in their soul and absolute discretion, commencing on March 1, 2020 and
terminating on May 31, 2020 (the "Term"). The parties may, at any time, and for any reason, terminate
this Agreement upon ten (10) days written notice to the other parties.

3. Use of Facilities.
a. The School District shall allow the Bureau to use certain facilities, as specified in writing
by the Superintendent (or staff designee), for the purpose of facilitating the completion of the Census during
the Term of this Agreement.
b. The County shall allow the Bureau to use certain facilities, as specified in writing by the
County Manager (or staff designee), for the purpose of facilitating the completion of the Census during the
Term of this Agreement.
4. Insurance. The Bureau shall maintain general liability insurance in the amount of $1 million/2
million in the aggregate and shall name the School District and the County as certificate holders as well as
name them as additional insureds on the certificate. The Bureau shall provide a copy of the Certificate of
Insurance directly to the School District and the County prior to the use of any School District or County
facilities.
5. Assignment. The Bureau shall not assign any interest in this Agreement without the prior written
consent of both the School District and the County.
IN WITNESS WHEREOF, the parties hereto have caused this Agreement to be executed by their
appropriate officials, as of the date first above written.
