EXECUTIVE SUMMARY
Recommendation to approve the release of four (4) code enforcement liens, with an accrued value
of $527,564.40 for payment of $964.40, in the code enforcement actions entitled Board of County
Commissioners v. Pee-Wee’s Dumpsters, Inc., Code Enforcement Board Case Nos.
CESD20120014608, CELU20120014618, CEOCC20150022849, and CEOCC20160012333, relating
to property located at 721 Logan Blvd. S., Collier County, Florida.
OBJECTIVE: For the Board of County Commissioners to accept an offer to release four code
enforcement liens with an accrued value of $527,564.40 for payment of $964.40 in relation to Code
Enforcement Board Case Nos. CESD20120014608, CELU20120014618, CEOCC20150022849, and
CEOCC20160012333.
CONSIDERATIONS: As a result of various code violations, The Code Enforcement Board ordered the
imposition of four (4) liens against Pee-Wee’s Dumpsters, Inc. for property located at 721 Logan Blvd.
S., Collier County, Florida.
The lien is Case No. CESD20120014608, for code violations consisting of a detached garage that was
built without obtaining the final Certificate of Occupancy as well as an unpermitted canopy on the
property, was recorded in the Official Records on July 11, 2013, at O.R. Book 4942, Page 3731. The lien
amount of $293,100 is based on 1,954 days of accrued fines ($150 per day from April 30, 2013, through
September 4. 2018) totaling $293,100. This violation was abated on September 4, 2018, by the new
owner.
The lien in Case No. CELU20120014618, for code violations consisting of the storing of miscellaneous
construction equipment, building supplies and debris on the property, was recorded in the Official
Records on October 18, 2013, at O.R. Book 4976, Page 909. The lien amount of $217,000 is based on
868 days of accrued fines ($250 per day from August 24, 2013, through January 8, 2016), totaling
$217,000. This violation was abated on January 8, 2016, by the previous owner.
The lien in Case No. CEOCC20150022849, for a code violation consisting of the prohibited business
activity taking place on the property, was recorded in the Official Records on August 5, 2016, at O.R.
Book 5301, Page 913. The lien amount of $12,128.64 is based on 12 days of accrued fines ($1000 per
day from June 26, 2016, through July 1, 2016) $12,000 plus $128.64 in operational costs. This violation
was abated on July 1, 2016, by the previous owner.
The lien in Case No. CEOCC20160012333 for a code violation consisting of a repeat violation of
prohibited business activity taking place on the property was recorded in the Official Records on
November 30, 2016, at O.R. Book 5338, Page 2. The lien amount of $5,000 is based on a fine for repeat
violation plus $125.76 in operational costs. This violation was abated on August 25, 2016, by the
previous owner.
Case Nos. CEOCC200158008 and CEOCC20160017328 imposed a civil penalty of $100 each on
citations CO 03891 and CO 08001, respectively, for the violations of changing the character on the
Estates zoned property by placing and storing goods, products, and dumpsters within the outside grounds.
The fine amount of $210 is based on a $200 civil penalty plus $10 in operational costs and will be paid
out of the offer of settlement of $964.40.
Pursuant to Resolution No. 2012-46, a request for a reduction of fines may be considered, in part, when a
lien encumbers property under new ownership, the new owner has diligently pursued abatement and

achieved compliance, and/or when payment of the lien would impose a severe financial hardship on the
owner. The property was a foreclosure and later acquired at auction by CDL Naples Investment, LLC,
via Certificate of Title recorded on August 2, 2018. CDL Naples Investment LLC was unaware of the
previous code violations and substantial property damage due to Hurricane Irma. Peter Dean (CDL
Naples Investment. LLC) spent a substantial amount of time and over $200,000, which included the costs
to remove the unpermitted structures, several dumpsters, and equipment from the property as well as
hiring an architect and rebuilding the house. All permits have been obtained, inspections completed, and
Certificate of Completion issued. The property is actively maintained, and the owner has paid $964.40 in
settlement of fines. The owner is requesting a waiver of $526,600 in accrued fines. There are no known
code violations remaining on the property.
FISCAL IMPACT: Payment of $964.40 has been made, representing $500 in fines, and $464.40 in
operational costs. If approved by the Board, accrued fines in the amount of $526,600 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. KLN
RECOMMENDATION: To waive the fines in the amount of $526,600, accept the payment amount of
$964.40, release the liens, and authorize the Chairman to sign the attached releases and satisfaction of
liens for recording in the Official Public Records.

CDL Naples lnvestment LLC purchased the property at the Collier County Auction on 812119. Then
we applied for a Writ of Possession and went about improving the property instantly.
We removed a detached garage, that didn't have a building permit (CESD2O120014608), then went
to go ahead with abating the fines. However, there was an open case for interior demolition and
remodeling without first obtaining a Collier County building permit.( CESD20180010597).
Ithen hired an architect and applied for Permit PR8D201810599269. I rebuilt the house and passed
all inspections. ljust received my CO.
