WHEREAS, the County pursuant thoreto has adopted a Land
Development Code (Ordinanc0 rIo. ':11-102) which includes a

zoning of particular n00graphic divisions of the County, amo~g which
is the granting of Conditional Uses; and
\'lflERf.AS, on l-lilCch 23. 1993 !tIC Collier County Board of Zoni:".g
Appeals approved Petition CU-92-16 which granted Conditional Use
approval for the property hereinafter described; and
WHERE^~, the Collier County F.nvironmental Advisory Board has
requested the deletion of Condition "cN i)5 contained in Resolution
"umber 93-:29 which requires the PetItioner to submit bird surveys;
and

be and the same is hereby approved for Conditional Use "23" of the A-
ACSC/ST zoning district for recreational facilities in accordance
with the Conceptual Master Plan (Exhibit DB") and subjrct to the
following conditions:
a. The Planning Services Manager may approve minor changes
in thc location, siting, or height of buildings,
structures, and improvements authorized by th~
conditional use. Expansion of the uses identified and
approved within this conditional use application, or
major changes to the site plan submitted as part of this
application, shall require the submittal of a new
conditional use application, i)nd shall comply with all
applicable County ordinances in effect at the time of
submittal, including Division 3.3, Site Development Plan
Peview and approval, of the Collier County Land
Development Code (Ordinance No. 91-102).
b. This project shall be required to meet all County
Ordinanccs in cffcct at the time final construction
documcnts ar~ submitted for development approval.
c. At the time of private airboat tour operation
commencement, the petitioner shall install and Maintain
no trespassing signage along the entire property line
every 300+ yards. The entire property shall be utilized
specifically for commercial conservation/ecological tours.
There shall be no other permitted uses associated with this
conditional use.
