RELATWG TO ?ETITION NUMBER V-97-14,
FO? A VA?r;..t:::: ON PROPERTY HEREINAFTER
DESCRIBED I,.J COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 125,
Florida Statutes, has conferred on all counties in Florida the power to
establish, coordinate and enforce zoning and such business regulations as
are necessary for ~he protection of the public: and
WHEREAS, the County pursuant thereto has adopted a Land Development
Code (Ordinance llo. 91-102) which establishes regulations for the zoning
of particular geographic divisions of the County, among which is the
granting of 'larianCesi and
WHEREAS, th~ Board of Zoning Appeals, being the duly elected
constituted Bc~rd of the area hereby affected, has held a public hearing
dfter notice as in said regulations made and provided, and has considered
the ad'lisabilitj of a 4)-f~ot variance from the required 50 foot yard
setback require~ent to 10 feet to permit a cover structure to be
constructed o';er two (2) parking spaces as shown on the attached plot
p:an, Exhibit "A", in d Fun zone, and consistent with the architectural
style as shown in Exhibit "BN, for the property hereinafter described,
and has found as a ma~ter of fact that satisfactory provision and
arrangement h,:ve been made concerning all applicable matt~rs required by
said ~egulations and in accordance with Section 2.7.5 of the Zoning
Pegulations of said La~d D~velopment Code for the unincorporated area of
Collier CountYi and
WHEREAS, all inter~sted parties have been given opportunity to be
heard by this Board in public meeting assembled, and the Board having
considered all matters pr~sentedi
NOW THEREFORE BE IT RESOLVED BY THE BOARD Of ZONING APPEALS of
Collier County, Florido, that:
The Petition V-97-14 filed by John Hobart, ArChitect, representing
First National Bank cf 1:aples, with respect to the property hereinafter
described as:
A portio~ of Parc~l "OneN, Oakmont Parkway Extension, as
record~~ ;n Plat Bock 21, Pages 77-7e, of the Public Rp-cords of
Collier County, Flor~da.

be and the samp. hereby is approved for a 40-foot variance from the
required 50 foot yard setback requirement to 10 feet as shown on the
attached plot plan, Exhibit "A", of the PUD zoning district, and
consistent with the architectural style as shown in Exhibit "B" wherein
said property is located.
BE IT RESOLVED that this Resolution relating to Petition Number
V-97-14 be recorded in the minutes of this Board.
This Resolution adopted after motion, second and majority vote.
