EXECUTIVE SUMMARY
This item requires that ex parte disclosure be provided by Commission members. Should a hearing
be held on this item, all participants are required to be sworn in. Recommendation to approve
Petition VAC-PL20190001056, to disclaim, renounce and vacate the County and the public interest
in a portion of the 25-foot Buffer Conservation Easement (B.C.E.), being a part of Tracts “I” & “N”
of Carlton Lakes Unit No. 1, Plat Book 26, Pages 65 through 72, a portion of the Wetland
Conservation Easement (W.C.E.) being a part of Tract “C3”, and a portion of the Upland Preserve,
being a part of Tract “UP1”, of Carlton Lakes Unit No. 2, Plat Book 30, Pages 52 Through 58, a
portion of the Wetland Conservation Easement (W.C.E.) located in Tracts “C5” & “C6” of Carlton
Lakes Unit No. 3, Plat Book 34, Pages 66 through 73 of the public records of Collier County,
Florida, located in the northeast quadrant of Immokalee Road and Livingston Road in Section 19,
Township 48 South, Range 26 East, Collier County, Florida and to accept Petitioner’s grant of a
conservation easement to replace the vacated conservation easements.
OBJECTIVE: To adopt a Resolution to vacate the County and the public interest in a portion of the 25-
foot Buffer Conservation Easement (B.C.E.), being a part of Tracts “I” & “N” of Carlton Lakes Unit No.
1, Plat Book 26, Pages 65 through 72, a portion of the Wetland Conservation Easement (W.C.E.) being a
part of Tract “C3”, and a portion of the Upland Preserve (Drainage Easement to remain) being a part of
Tract “UP1”, all of Carlton Lakes Unit No. 2, Plat Book 30, Pages 52 Through 58, a portion of the
Wetland Conservation Easement (W.C.E.) located in Tracts “C5” & “C6” of Carlton Lakes Unit No. 3,
Plat Book 34, Pages 66 through 73 of the public records of Collier County, Florida, in Section 19,
Township 48 South, Range 26 East, Collier County, Florida, being more specifically shown in Exhibit A,
and to accept Petitioner’s grant of a conservation easement to replace the vacated conservation easements.
CONSIDERATIONS: Petition VAC-PL20190001056 has been received by the Development Review
Division, Growth Management Department from James A. Carr, P.E., of Agnoli, Barber & Brundage,
Inc., as agent for the property owner, Carlton Lakes Master Association, Inc., to vacate a portion of the
25-foot Buffer Conservation Easement (B.C.E.), being a part of Tracts “I” & “N” of Carlton Lakes Unit
No. 1, Plat Book 26, Pages 65 through 72, a portion of the Wetland Conservation Easement (W.C.E.)
being a part of Tract “C3”, and a portion of the Upland Preserve (Drainage Easement to remain) being a
part of Tract “UP1”, of Carlton Lakes Unit No. 2, Plat Book 30, Pages 52 Through 58, a portion of the
Wetland Conservation Easement (W.C.E.) located in Tracts “C5” & “C6” of Carlton Lakes Unit No. 3,
Plat Book 34, Pages 66 through 73 of the public records of Collier County, Florida, in Section 19,
Township 48 South, Range 26 East, Collier County, Florida.
Portions of existing Conservation Easements in Tracts “C2”, “C3”, “C5”, “C6”, “UP1”, “I” and “N” of
Carlton Lakes are proposed to be vacated. Out of these tracts, a total of 0.3896 acres of preserve area will
be vacated, resulting in a remaining 45.84 acre preserve. The subject areas to be vacated are adjacent to
existing residential homes, where the proximity has made it difficult to maintain them as quality preserve
areas. As part of a master plan to relocate and re-configure preserves throughout the community, new
preserves are being created to offset the preserves being removed. These preserves are within a private
residential community where there is no significant public loss or benefit. The creation of new preserves
provides public benefit as the minimum required 55 acres total preserve is being maintained within the
Carlton Lakes PUD.
The Drainage Easement on Tract UP1 of Carlton Lakes Unit No. 2, Plat Book 30, Pages 52 Through 58
shall remain in place.
The Development Review Division has reviewed this petition and found no reason for objection.

FISCAL IMPACT: Growth Management Department, Development Review Division staff has
collected a $2,000 “Petition to Vacate” fee from the petitioner which covers the County’s cost of
recording and processing the Petition.
GROWTH MANAGEMENT IMPACT: There is no growth management plan impact associated with
this action.
LEGAL CONSIDERATIONS: Petitioner is requesting to vacate a portion of the 25-foot Buffer
Conservation Easement (B.C.E.), being a part of Tracts “I” & “N” of Carlton Lakes Unit No. 1, Plat Book
26, Pages 65 through 72, a portion of the Wetland Conservation Easement (W.C.E.) being a part of Tract
“C3”, and a portion of the Upland Preserve (Drainage Easement to remain) being a part of Tract “UP1”,
of Carlton Lakes Unit No. 2, Plat Book 30, Pages 52 Through 58, a po rtion of the Wetland Conservation
Easement (W.C.E.) located in Tracts “C5” & “C6” of Carlton Lakes Unit No. 3, Plat Book 34, Pages 66
through 73 of the public records of Collier County, Florida, as further described in Exhibit A to the
attached Resolution.
Pursuant to Resolution 2013-166 and Florida Statutes Section 177.101, the Board may adopt resolutions
vacating plats in whole or in part of subdivisions in Collier County, returning the property covered by
such plats either in whole or in part into acreage, when the following criteria are met:
1. The request is in the interest of the general public welfare, or no public detriment is established
2. The request does not invade or violate individual property rights
3. The Petitioner owns the fee simple title to the whole or that part of the parcel sought to be vacated
4. The vacation will not affect the ownership or right of convenient access of persons owning other
parts of the subdivision.
This item has been approved as to form and legality and requires a majority vote for Board approval. --

through 72, a portion of the Wetland Conservation Easement (W.C.E.) being a part of Tract “C3”, and a
portion of the Upland Preserve (Drainage Easement to remain) being a part of Tract “UP1”, of Carlton
Lakes Unit No. 2, Plat Book 30, Pages 52 Through 58, a portion of the Wetland Conservation Easement
(W.C.E.) located in Tracts “C5” & “C6” of Carlton Lakes Unit No. 3, Plat Book 34, Pages 66 through 73

34135, to Collier County, Florida, a political subdivision of the State of Florida
(hereinafter "Collier County" or "Grantee"). Grantor and Grantee may hereafter be
collectively referred to as the "parties."
WHEREAS, [Grantor] CARLTON LAKES MASTER ASSOCIATION, INC. is the owner
of that certain tract of land located in Collier County, Florida described in Exhibit "A"
[include a Plat Book and Page reference in Exhibit "A"] attached hereto (hereinafter
referred to as the "property"); and
WHEREAS , Collier County is requmng that this Conservation Easement
("Easement") be entered into and recorded in the land records of Collier County to bind
[Grantor] CARLTON LAKES MASTER ASSOCIATION, INC.; and
WHEREAS, the parties wish to establish their respective rights and responsibilities
relative to the use and maintenance of the conservation area described in the attached
Composite Exhibit "B" (the Easement Property).
NOW, THEREFORE, Grantor hereby conveys a Conservation Easement to Collier
County as follows:
1. [Grantor] CARLTON LAKES MASTER ASSOCIATION, INC., its successors, heirs,
assigns and/or transferees, hereby grants a non-exclusive easement to Collier County
over and across the property descr ibed as Exhibit "B" for the purpose of conservation.
Collier County shall have no responsibility for maintenance of the conservation
easement.
