EXECUTIVE SUMMARY
Recommendation to adopt a resolution authorizing the acquisition by condemnation, if necessary,
of those perpetual Utility Easements and Temporary Construction Easements necessary for the
construction of water mains to facilitate the I-75 / Collier Boulevard Utility Relocation Project
(Project No. 70229) with an estimated fiscal impact of $520,000.
OBJECTIVE: To adopt a resolution authorizing the acquisition, by condemnation if necessary, of those
non-exclusive, perpetual Utility Easements and Temporary Construction Easements required for the
construction, installation, and maintenance of water mains for the I-75 / Collier Boulevard Utility
Relocation Project (Project) commencing at the South County Regional Water Treatment Plant and
ending at the southern boundary of the Forest Glen Golf & Country Club. (Project No. 70229.)
CONSIDERATIONS: On July 9, 2019, Agenda Item 16.C.11, the Board approved Resolution 2019-
126/CWS-2019-03 authorizing staff to acquire by gift or purchase the necessary rights and interests for
this Project. Thus far, staff has been unable to secure all of the required parcels through negotiations, so
in order to meet the Project’s acquisition completion date of April 1, 2020, staff is requesting permission
to initiate condemnation proceedings at this time.
To date, staff has successfully negotiated with Laxmi of Naples, LLC, 850 NWN, LLC, White Lake
Commons Association, Inc., and IStorage PO, LLC. Negotiations continue with Toll Gate Naples, LLC
and Forest Glen Golf & Country Club, and staff is hopeful a negotiated settlement can be obtained prior
to condemnation. Initializing condemnation proceedings will ensure there are no project delays.
The Board is referred to the attached Route Study, dated February 6, 2020, prepared by Stantec. By its
review, concurrence and approval of this executive summary, the back-up documentation, and the
proposed resolutions, the Board will have determined that the easements (as depicted in the legal
descriptions attached to the resolutions) represent the most feasible location and must be acquired for
construction of the proposed improvements. The Board is further advised that it is necessary and in the
public’s best interest to acquire, by condemnation if necessary, the easements specified on each legal
description attached to the resolutions.
In addition to the direct cost of the easements required for construction, the County is also required to pay
severance damages and/or costs to mitigate damages to remaining properties (“cost-to-cure” expenses)
caused as a result of the loss of the part taken to construct the Project, business damages, all expenses for
title work, real estate appraisals, and those expenses related to condemnation when necessary, such as
property owner attorney fees and expert witness fees, according to Sections 73.091 and 73.092, F.S. To
the extent settlements are achieved in lieu of litigation, these costs may be reduced significantly.
FISCAL IMPACT: The fiscal impact associated with this item is estimated to be $520,000. Funding is
available in the Water User Fee Capital Fund 412, Project 70229. The source of funding is water user
fees.
GROWTH MANAGEMENT IMPACT: This project meets current Growth Management Plan
standards to ensure the adequacy and availability of viable public facilities.
LEGAL CONSIDERATIONS: This item is approved for form and legality and requires a majority vote
for Board action. - CMG

UTILITY EASEMENTS AND TEMPORARY CONSTRUCTION EASEMENTS NECESSARY
FOR THE CONSTRUCTION OF WATER MAINS TO FACILITATE THE I-75 / COLLIER
BOULEVARD UTTLITY RELOCATION PROJECT (PROJECT NO. 7 0229).
WHEREAS, the Florida Department of Transportation (FDOT) I-75 &. CR-951
Interchange Improvements Project will impact Collier County Water-Sewer District's existing
infrastructure and necessitate the relocation of water mains; and
WHEREAS, the Collier County Water-Sewer District's I-75 / Collier Boulevard Utility
Relocation Project which includes relocating the existing transmission water main to another
utility corridor (hereinafter referred to as "the Project") will commence at the South County
Regional Water Treatment Plant and end at the southern boundary of the Forest Glen Golf &
Country Club within an existing Florida Power & Light (FPL) utility easement corridor; and
WHEREAS, plans and specifications have been prepared for construction of the Project;
and
WHEREAS, construction of the Project will require the acquisition of perpetual easement
interests and temporary construction easements; and
WHEREAS, the location for the construction of the Project is collectively represented by
the legal descriptions comprising Exhibit "A", attached hereto and incorporated herein; and
WHEREAS, after consideration of the availability of alternate routes and locations, the
comparative costs of the Project alternatives, various impacts upon the environment, long range
planning options, and public safety considerations, the Board desires to exercise its right to
condemn property for public purposes.

NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, AS THE GOVERNING BODY OF
COLLIER COUNTY AND EX-OFFICIO THE GOVERNING BOARD OF THE COLLIER
COUNTY WATER-SEWER DISTRICT, that it has been determined by the Board that it is
necessary and in the public's best interest to acquire the perpetual easement interests and temporary
construction easements described in Exhibit "A" ("the Property") for the purpose of constructing
the improvements proposed as part of the Project in order to protect the health, safety and welfare
of the citizens of Collier County.
AND IT IS FURTHER RESOLVED that acquisition of the Property and construction of
the Project upon the Property is an integral part of the County's long range planning effort, and is
included in the Capital Improvement Plan of the Collier County Water-Sewer District Capital
Improvement Budget, as approved by the Board of County Commissioners.
AND IT IS FURTHER RESOLVED that the Board has reviewed the route study and
considered the presentation concerning altemative locations for the Project, various impacts to the
environment, public health, safety and welfare considerations associated with the design and
construction of the Project, and the costs associated with the design, property rights acquisition,
and construction of the Project; and the Board finds that after consideration of these issues, the
most feasible location for construction of the proposed improvements is collectively represented
by the legal descriptions comprising Exhibit "A", attached hereto and incorporated herein.
AND IT IS FURTHER RESOLVED that the taking of the perpetual non-exclusive utility
easements and temporary construction easements will provide the County with the right to
construct the project as designed and place andlor excavate materials for the purpose of

constructing, operating, and maintaining utility facilities within the easement areas. These
easements also include the right to remove and use any and all excavated material.
AND IT IS FURTHER RESOLVED that all property acquired pursuant to this Resolution
shall be put to public purposes.
AND IT IS FURTHER RESOLVED that the County Manager or his designee and the
Office of the County Attorney are hereby authorized and directed to immediately acquire by gift,
purchase or condemnation, in accordance with the provisions of Chapters 73, 74 and 127, Florida
Statutes, the Properly more particularly described in Exhibit "A", attached hereto and incorporated
herein.
AND IT IS FURTHER RESOLVED that no mobile homes are located on the property
sought to be acquired and therefore it will not be necessary to remove any mobile homes from the

1.0 INTRODUCTION
1.1 BACKGROUND
Collier County is constructing a redundant potable water transmission main to serve the South County
Water Service Area from the South County Regional Water Treatment Plant. The new water main will
begin at the South County Regional Water Treatment Plant (SCRWTP), then continue south to near
Forrest Glenn and Henderson Creek Canal, where it will connect to an existing 36-inch water main at
Point C (see Figure 1-1). The County previously completed a study to identify and evaluate potential
pipeline route alternatives available between these two locations, as reported in the SCRWTP Reverse
Osmosis Wellfield Expansion Well Site and Well Transmission Main Route Study Technical
Memorandum, prepared by Greeley and Hansen in August 2002 (attached as Appendix A). The following
three (3) route alternatives were identified in that memorandum: Alignment 1 – FP&L Corridor; Alternative
2 – LeBuffs/FP&L Corridor; and Alternative 3 – Beck Boulevard/CR 951, (Figure 2-1). These same route
alternatives will be considered in this review for the proposed alignment of the potable water transmission
main. However, it’s important to note that the proposed connection point for the potable water
transmission at the SCRWTP is at the north end of the plant, approximately where the FPL overhead
powerlines intersect with City Gate Boulevard North, whereas the well field transmission main enters the
SCRWTP property near the south end of the plant, approximately 250 feet north of City Gate Boulevard
South.
Consequently, additional route alternatives will be considered for the segment of potable water main
between Points A and C and will be discussed in further detail in Section 2.0. Several route alternatives
are considered: Alternative A – Along White Lake Boulevard/City Gate Boulevard South; Alternative B –
White Lake Boulevard; Alternative C – City Gate Boulevard(s)/Brennan Road; and Alternative D – Along
the existing FPL corridor/easement. These alternative routes, shown on Figure 2-1, may need to traverse
through additional privately-owned parcels located contiguous with the SCRWTP and within the existing
FPL easement, or along White Lake Boulevard or Brennan Road. This evaluation will consider these
alternative routes for this segment of the potable water transmission main as well.
Collier County is in the process of acquiring an additional 5-feet of easement parallel to and contiguous to
the east of the existing 15-foot easement for construction of the new 36-inch potable water transmission
main.

1.2 PURPOSE
Collier County Public Utilities Department’s Engineering and Project Management Division (EPMD) has
retained Stantec to review the alternative routes identified above and provide a supplemental desktop
evaluation to determine which of them would be most suitable for the new potable water transmission
main. The intent of this memorandum is to summarize the findings of this evaluation.
1.3 METHODOLOGY
The proposed potable water transmission main route evaluation has been separated into two
components. One for the segment of pipe that will be constructed between City Gate Boulevard North
and City Gate Boulevard South (Points A and C, respectively), which was not previously evaluated by
Greeley and Hansen, and the other for the segment of the potable water transmission main from City
Gate Boulevard South to where the proposed pipeline will connect to the existing 36-inch water main
(Points C and B, respectively).
Point A to Point C
Evaluation for the segment of proposed water main to be constructed between City Gate North and South
was completed using aerial imagery and the County’s GIS database that shows the locations, sizes, and
type of County owned utilities. This evaluation only considered non-cost criteria developed by Greeley
and Hansen.
Point C to Point B
Stantec’s desktop evaluation will review the Greeley and Hansen study, compare Google aerial imagery
of those routes from 2004 and 2019, and the County’s existing utility assets to re-evaluate those
alternative routes using non-cost-based criteria only. Impacts on system hydraulic design was also
excluded from this review.
The same Non-Cost Based Evaluation Criteria, Weight Factors and Rank Scale were used to evaluate
Route Alternatives A through D, as well as re-evaluate Route Alternatives 1 through 3. Refer to section
4.2 of the Greeley and Hansen Study (Appendix A) for further discussion of the Non-Cost-Identifiable
Route Evaluation Criteria.

3.0 FINDINGS
3.1 ROUTE ALTERNATIVE A – ALONG WHITE LAKE BOULEVARD/CITY
GATE BOULEVARD SOUTH
Pipeline construction along this route would require the pipe to be installed in the roadway because there
are an existing 8-inch gravity main and 16-inch water main located along the east side and west sides of
the White Lake Boulevard, respectively, as you approach City Gate Drive. Just north of City Gate Drive,
the 8-inch gravity main terminates at pump station 312.42, then a 4-inch discharge force main from that
station continues south of City Gate Drive before discharging into a manhole in White Lake Boulevard.
There’s also an 8-force main discharging from PS 312.41, located south of City Gate Drive, that parallels
a portion of the 312.42 discharge force main. The water main increases from 16-inch to 20-inch diameter
as you traverse from north to south along White Lake Boulevard. City Gate Boulevard South is also
bounded by an existing 8-inch force main and 16-inch water main located along the north and south
sides, respectively. Pipelines located in the roadway are typically more costly to construct because of
road restoration, but they’re also more difficult to operate and perform maintenance on because County
staff must work carefully near moving vehicles. Repair costs for pipelines in roadways, if necessary, are
also higher because of the maintenance of traffic and road restoration costs. These costs do not consider
social costs caused by inconvenience to businesses or the public. There are no wetlands located along
this route, but one minor roadway crossings would be necessary at the SCRWTP entrance.
3.2 ROUTE ALTERNATIVE B – WHITE LAKE BOULEVARD
Pipeline construction along this route would require the pipe to be installed in the roadway because of the
same existing utilities located along White Lake Boulevard described in Alternative A above. As you
travel along White Lake Boulevard, south of City Gate Boulevard South, the 8-inch force main
discontinues at the pump station 312.41, but there’s an 8-inch gravity main located along the east side of
the road that conveys flow to pump station 312.41 from the two properties south of it. The 20-inch water
main along the east side of White Lake Boulevard, then decreases in size to a 10-inch diameter along
White Lake Boulevard just as the road begins to turn from north-south to east-west. The 10-inch water
main then continues along the north side of White Lake Boulevard as it continues east.
The unpaved Right-of-Way along south side of the road is contiguous with the I-75 right-of-way, which
presents constructability challenges for building the water transmission main across the interstate. There
isn’t sufficient staging room along the White Lake Boulevard Right-of-Way to set up the necessary
equipment to construct the pipeline at the depth FDOT requires under I-75.
3.3 ROUTE ALTERNATIVE C – CITY GATE BOULEVARD(S)/BRENNAN
DRIVE
Brennan Drive is currently undeveloped, but the Right-of-Way is already congested with a 12-inch water
main along the east side edge of the Right-of-Way, an 8-inch gravity sewer along the middle of the road,
and an 8-inch force main that starts approximately mid-block and runs along the west edge of the Right-
of-Way. This force main then turns west and continues along City Gate Boulevard South, as described
above. The proposed location for the 36-inch potable water transmission main would be limited to within
the pavement, which is typically undesirable for the reasons previously stated above.

3.4 ROUTE ALTERNATIVE D – ALONG EXISTING FPL EASEMENT
Except for the overhead power lines, the existing FPL easement is primarily undeveloped and has been
cleared between Points A and C. There is little possibility that FPL will allow the underlying private
property owners to build or develop within their easement. Therefore, this property has no beneficial use
for long range planning purposes, except for underground utilities, since FPL is very restrictive in allowing
any new aboveground facilities and structures within their easements or Rights-of-Way.
3.5 ROUTE ALTERNATIVE A THROUGH D SCORING

3.6 NEW ALTERNATIVE ROUTES EVALUATION SUMMARY
Based on our evaluation of the four (4) Route Alternatives, Route Alternative D is the best option for the
proposed 36-inch potable water transmission main. We understand that if this route is selected by Collier
County, is in the process of acquiring a 15-foot wide easement parallel to and along the west side of the
FPL easement for construction of the new 36-inch potable water transmission main where there is no
existing raw water transmission main located within the FPL easement. For length of FPL easement
where the raw water main already exists, the County would acquire a 5-foot wide easement parallel and
contiguous to the east side of the existing 15-foot easement for construction of the new 36-inch potable
water transmission main.

4.0 RE-EVALUATION OF ROUTE ALTERNATIVES 1 THROUGH 3
The findings form Greeley and Hansen’s previous route alternative evaluation appear to still be valid
based on our desktop review of their study, the most current aerial maps available through Google Earth
(dated January 9, 2019), and Collier County’s Public Utilities’ GIS asset database. Below is an updated
synopsis and Alternative Pipeline Route Evaluation, Route Rankings for Route Alternatives 1 through 3.
See Table 4-1 for route alternative scores from Greeley and Hansen’s initial report and Table 4-2 for the
route alternative scores based on Stantec’s re-evaluation.
4.1 ROUTE ALTERNATIVE 1
No major development has occurred along Route Alternative 1 since the Greeley and Hansen’s study
was completed. The only change noted is the construction of the raw water transmission main and well
field, as recommended in their report. In anticipation of the well field construction needs, the County
acquired a 15-foot permanent easement and a contiguous 20-foot, parallel, temporary easement west of
the permanent easement. Both easements were cleared during construction of the raw water
transmission main, with the permanent easement clearing continuing to be maintained by County staff.
Land through the permanent easement was also filled in as necessary to provide County staff reliable
access to the transmission main and well sites during the wet season. These enhancements make it a
more viable pipeline route when evaluating the criteria for Permitting, Operation and Maintenance, and
Environmental Impact/Wetlands Mitigation. As a result of re-evaluating the Route 1 Alternative, it now
has a higher ranking (176) score than it previously did (165).
4.2 ROUTE ALTERNATIVE 2
Development along the majority of this route alterative remains unchanged except for some new
commercial development along the south side of Shaw Boulevard. There has are also some new
residences that have been built toward the south end of LeBuff’s Road. However, these subtle changes
are enough to affect the rank scoring for public inconvenience, long range planning, which has negatively
affected the evaluation criteria scoring because building a pipeline along this route would now have an
increase in public inconvenience and decrease in safety. Long-range planning (i.e. additional future
development and road building) are also factors that affected the scoring. As a result of re-evaluating the
Route 2 Alternative, it now has a lower ranking score (117) than it previously did (141).
4.3 ROUTE ALTERNATIVE 3
Since the 2002 evaluation was completed, CR 951 has been widened from two to three lanes in each
direction, reducing the unpaved area of right-of-way available. Additionally, more commercial
development has occurred along the west side of CR 951 between Davis Boulevard and the Cedar
Hammock subdivision. Additionally, there are future plans for a new CR 951/I-75 interchange at the
intersection of Beck Boulevard and CR 951. The only potential location for a pipeline along CR 951
would be under the pavement due to an existing lake along the property frontage of Forrest Glenn (east
side of CR 951) and existing federal government telecommunication utilities located along the west side
of CR 951, under the existing sidewalk. Pipeline construction under pavement is typically considered the
least desirable for option for a variety of reasons including: higher construction costs associated with
roadway restoration; inconvenience to the public during construction; reduction in safety to the public and
workers during construction and during the maintenance and operation; and increased liability in the

event of pipeline fails or leaks under pavement. There would also be increased constructability regulatory
challenges associated with the pipeline crossing the Henderson Creek Canal due to limited construction
equipment/material staging areas available. As a result of re-evaluating the Route 3 Alternative, it now
has a lower ranking score (89) than it previously did (99).

5.0 SUMMARY
Stantec evaluated several route alternative for constructing a new 36-inch diameter potable water
transmission main from the north end of the SCRWTP (Point A) to Point B (a proposed connection point
to the existing 36-inch diameter water transmission main located along the east side of the Henderson
Creek Canal, south of Forrest Glenn. Stantec identified 4 new pipeline routes between Points A and C
the location where the existing raw water transmission main enters the FPL corridor/easement, near the
southeast corner of the SCRWTP, and evaluated them using the same non-cost-identifiable criteria
previously used by Greeley and Hansen in 2002 for a raw water transmission main and well field route
evaluation between Points C and B. The best route between points A and C based on this evaluation is
Route Alternative D, along the existing FPL corridor/easement. The best route between Points C and B is
along Route Alternative 1, also along the existing FPL corridor/easement.

This wellfield expansion will be the source of supply for the 12-Million Gallons per Day Reverse
Osmosis expansion at the South County Regional Water Treatment Plant and it is part of 2003
Water Master Plan Update adopted by the Board of County Commissioners on May 25, 2004 as
agenda item 10 D. This project is needed to meet future potable water demand.
The proposed pipeline and well locations are within and adjacent to a Florida Power and Light
(FPL) easement along the east side of Collier Boulevard (CR 951). The wellfield will extend from
Beck Road to Rattle Snake Hammock Road. Twenty-three Hawthorn Aquifer wells are required.
Greeley and Hansen is the design consultant and Water Resource Solutions is their
hydrogeological sub-consultant. Their scope of services is well field testing, preliminary design,
transmission route study, permitting, and final design and construction management.
Subsequent to project approval by the Board, Greeley and Hansen and Water Resource
Solutions conducted a regional investigation to identify the preferred wellfield areas adjacent to
the South County Regional Water Treatment Plant (SCRWTP) from a water production and
water use permit perspective. This investigation comprised the following principal elements:
Acquire and develop basic data for the pipeline route and well site selection process
Develop alternative configurations
Evaluate and compare the alternatives
Develop recommended well locations and the best transmission pipeline configuration
based on the results of this investigation
The methodology employed to identify the best well sites and water transmission pipelines
configuration consists of the following major elements:
Focus on areas that are hydrogeological and environmentally advantageous
Identify potential well sites and pipeline route alternatives

Develop engineering, regulatory, long range planning, safety, public impact and other
non-cost identifiable criteria against which the alternative pipeline routes and well sites
are evaluated and compared
Evaluate the permitability and constructability of the alternatives in the field
Prepare preliminary estimates of project cost for purposes of comparing the alternatives
Select and weight the non-cost identifiable criteria for this project and
Identify the best pipeline routes and well sites, considering all of the above
The best configuration may not necessarily be the least expensive in situations were
environmental protection, safety or other considerations override cost.
To provide the necessary water supply volume with the appropriate reliability it was determined
that 23 productions wells will be required. Alternative well sites were developed for each of
these wells along with three alternative pipeline routes. The present well locations and pipeline
routing were determined after applying the pre-established criteria.
Test wells drilling and analysis were completed and a Siting Evaluation Report issued by Water
Resource Solutions on March 11, 2004. This report has verified the well and transmission line
alignment and indicates that the wells are excellent in raw water production and quality.
The Board has issued a resolution for easements to be acquired by gift or purchase. Greeley
and Hansen have conducted the necessary survey work and provided the legal descriptions.
Construction of wells and transmission lines will take two years after permits are issued by
SFWMD and FDEP.
A new contract has been negotiated with Greeley and Hansen for the design of the new wellfield
and is included under the “Wellfield Reliability Improvements and Expansion, RFP 04-3593”
project managed by Dresser, Camp and McKee.
