EXECUTIVE SUMMARY
Recommendation to approve an Easement Use Agreement (Agreement) for Lot 14, Block H,
Kensington Gardens, according to the plat thereof as recorded at Plat Book 29, Page 36 of the
public records of Collier County. (Petition EUA-PL20200000226).
_____________________________________________________________________________________
OBJECTIVE: To approve an Easement Use Agreement between the County, and the current property
owner of Lot 14, Block H, Kensington Gardens.
CONSIDERATIONS: The property is located at 3017 Gainesborough Court. There is an existing
screened pool deck on the subject property that encroaches 4.8 feet into a 10 -foot Lake Maintenance
Easement. The subject easement is dedicated to the perpetual use of the public. According to the plat,
the Kensington Park Master Association has the dedication with responsibility for maintenance of the
Lake Maintenance Easement. There are no drainage facilities within the easement, just a grassed area.
Development Review has reviewed the Agreement and Exhibits and recommend approval of the
Easement Use Agreement. The current owner purchased the property with the encroachment in place.
FISCAL IMPACT: There is no fiscal impact. The property owner will be responsible for the recording
fees.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: This item has been approved as to form and legality and requires a
majority vote for Board approval. SAA
RECOMMENDATIONS: To approve the Easement Use Agreement between the County, current
property owner of Lot 14, Block H, The Kensington Park Master Association and authorize the Chairman
to execute the Agreement. To direct the Clerk to record the Easement Use Agreement.

Good afternoon,
This correspondence will serve as a Letter of No Objection (LONO) for a minor pool cage encroachment into an existing
easement. The pool cage was permitted in 2002 and included a LONO from the HOA.
The current owner will be replacing the screen enclosure, therefore, based on the current regulations, will be required
to enter into an Easement Use Agreement. Stormwater Management has no objection to this encroachment based on
the following information:
. This is an existin8 pool cage that will be replaced
. The existing pool cage was permitted by Collier County
o The encroachment is considered minor, with the majority of the easement remaining clear of
obstructions
. The County does not have primary maintenance responsibility for the easement
o The HOA, which has maintenance responsibility, has issued a new LONO for the proposed screen
enclosu re.
