EXECUTIVE SUMMARY
Recommendation to approve Change Order #2 to Agreement No. 18-7240, “Marco Executive
Airport New Terminal & Associated Improvements,” with West Construction, Inc., for a net
decrease of $1,896.68.
OBJECTIVE: To allow the contractor to invoice for modifications to the plans and specifications during
construction of the new terminal building and associated improvements at the Marco Island Executive
Airport (“MKY”) arising from the issuance of a deductive change order.
CONSIDERATIONS: Change Order #1 to Agreement No. 18-7240 with West Construction, Inc.
(Contractor) for a net decrease of $56,945.15, decreasing the contract amount from $9,396,263.10 to
$9,339,317.95, was approved by the Contractor and staff on November 25, 2019.
As a result of conditions revealed in the field during construction, minor revisions to the plans and
specifications, as further outlined within the Change Order and supported by Contractor submittals,
requests for information and the issuance of Work Directives, were necessary. Those revisions will result
in an additional decrease to the project of $1,896.68, per the attached Change Order #2.
The Contractor has delayed the authorization of the further deductive change in Change Order #2 by
contesting that the time impact relating to this Change Order is “not yet determined,” which is contrary to
the requirements set forth within Agreement No. 18-7240, requiring the contractor to provide an
itemization of cost or time increases/savings it foresees as a result of the change. Nonetheless, staff is
seeking Board approval, in its capacity as the Collier County Airport Authority pursuant to Collier
County Ordinance No. 04-03, as amended, of the Work Directives memorialized in attached Change
Order #2 so as to allow the Contractor to invoice for the changes specified in the Change Order to avoid
additional construction delays that could arise from non-payment.
FISCAL IMPACT: This change will result in decrease of $1,896.68 to Contract No. 18-7240, reducing
the contract from the current amount of $9,339,317.95 to $9,337,421.27.
GROWTH IMPACT: There is no growth impact associated with this Executive Summary.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote
for Board approval. -SRT
RECOMMENDATION: To approve Change Order #2 to Contract No. 18-7240 with West Construction,
Inc., to decrease the contract from $9,339,317.95 to $9,337,421.27, and authorize the Chairman to sign
the attached Change Order.
