EXECUTIVE SUMMARY
Recommendation to approve the document necessary to convey an easement to Florida Power &
Light (FP&L) Company over property owned by Collier County at the proposed Big Corkscrew
Island Regional Park site.
OBJECTIVE: To convey an easement for installation of electric infrastructure on Collier County
property required to power proposed facilities within the proposed Big Corkscrew Island Regional Park
site. The public purpose is to bring infrastructure into compliance with current Count y standards while
meeting demand, improving reliability, protecting public safety and providing environmental protection.
CONSIDERATIONS: On October 8, 2019, under Agenda Item 11D, the Board of County
Commissioners (Board) approved Contract Number 19-7615 for the construction of the proposed Big
Corkscrew Island Regional Park, Phase I.
The proposed project includes the installation of a new electric line and transformer to provide power to
the proposed facilities. This requires an easement to Florida Power & Light Company for the installation
of electric lines and fiber infrastructure including, but not limited to, conduit, poles, and transformer
boxes. The easement area measures approximately 51,136 square feet (1.17 acres) and is shown and
described on Exhibit “A” to the Easement. The County will not be compensated because the easement is
a requirement for FP&L to provide the electrical facilities necessary for the operation of proposed
facilities for the Big Corkscrew Island Regional Park.
FISCAL IMPACT: The total cost for recording and obtaining copies of the easement documents will
not exceed $50.00. Funding is available in the Parks Impact Fee Fund 346, in the Big Corkscrew Island
Regional Park, Project No, 80039.
GROWTH MANAGEMENT IMPACT: There are no Growth Management Impacts associated with
this action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires a majority
vote. - JAB
RECOMMENDATION: To approve the Easement, authorize the Chairman to execute the Easement,
and direct the County Manager or his designee to follow all appropriate closing procedures and record the
Easement in the Public Records of Collier County, Florida.

The undersigned, in consideration of the payment of $1 .00 and other good and valuable
consideration, the adequacy and receipt of which is hereby acknowledged, grant and give to Florida
Power & Light Company, its licensees, agents, successors, and assigns ("FPL"), a non-exclusive
easement forever for the construction, operation and maintenance of underground electric utility
facilities (including cables, conduits, appurtenant equipment, and appurtenant above ground
equipment) to be installed from time to time; with the right to reconstruct, improve, add to, enlarge,
change the voltage, as well as, the size of and remove such facilities or any of them within an
easement described as follows:
See Exhibit "A" ("Easement Area")
Together with the right to permit FPL to attach wires to any facilities hereunder and lay cable and
conduit within the easement and to operate the same for FPL's communications purposes; the right
of ingress and egress to the Easement Area at all times; the right to clear the land and keep it cleared
of all trees, undergrowth and other obstructions within the Easement Area; to trim and cut and keep
trimmed and cut all dead, weak, leaning or dangerous trees or limbs outside of the easement area
which might interfere with or fall upon the lines or systems of communications or power transmission
or distribution; and further grants, to the fullest extent the undersigned has the power to grant, if at
all, the rights hereinabove granted on the Easement Area heretofore described, over, along, under
and across the roads, streets or highways adjoining or through said Easement Area.
