EXECUTIVE SUMMARY
Recommendation to approve an After-The-Fact U.S. Department of Housing and Urban
Development Community Development Block Grant application submittal to fund the Peters
Avenue Sidewalk Project.
OBJECTIVE: To receive Board of County Commissioners (Board) approval for a U.S. Department of
Urban Development (HUD) Community Development Block Grant (CDBG) application for sidewalk and
related activities in the Bayshore area.
CONSIDERATIONS: On January 3, 2020, the Collier County Community and Human Services
Division (CHS) announced the FY2020-2021 HUD funding cycle and the Capital Project Planning,
Impact Fees and Program Management Division began responding to a grant requirement. The following
the application submitted is for the Peters Avenue Sidewalk Project. The project consists of installation
of a five-foot (5’) wide sidewalk on the west side of Peters Avenue and supplemental streetlights on
existing Florida Power and Light poles. The project scope is approximately 1,200 linear feet (.22 miles)
along Peters Avenue from U.S. 41 to Collee Court. Peters Avenue is located south of the intersection of
U.S. 41 (aka Tamiami Trail East) and Airport Pulling Road.
The Transportation Planning Section (TPS) hired the Jacobs Engineering to review the Peters Avenue
location and provide an estimate of construction cost. TPS will receive sidewalk development funds from
KRG Courthouse Shadows, LLC through the Planned Unit Development (PUD) Amendment process.
Identified in Section Thirteen of the PUD Ordinance under the Traffic Section, the developer “…shall pay
for the design and construction of a five-foot sidewalk along Peters Avenue up to the sum of $50,000,
which shall represent its payment in-lieu consistent with LDC (Land Development Code) Section 6.06.02
for the entire site…” These funds will be utilized to offset the design and construction cost for the
sidewalk.
The attached grant application is due to CHS on February 10, 2020. The timeline did not provide
adequate time for the execution of the County’s pre-approval process. Pursuant to CMA# 5330 the
County Manager is authorized to sign the application. The application is therefore being presented for
Board ratification.
FISCAL IMPACT: The total cost of the project is $544,718.88. Should Collier County receive
funding for the proposed project, funding would be awarded in the amount $389,084.91 for construction.
There is no required match, however the grant will not pay for the Design, Permitting and CEI which total
$155,633.97 and are required to complete the project. The developer contribution from the PUD of
$50,000, will be used towards the total design costs. The additional estimated project costs of
$105,633.97 would be funded locally. At this time, it is anticipated that the local funding source will be
Transportation Capital Fund (310) reserves. The Board of County Commissioners (Board) will have the
opportunity to accept or reject the funds if the grant application is approved.
GROWTH MANAGEMENT IMPACT: This project for transportation infrastructure improvements is
consistent with the Growth Management Plan (GMP). In addition, the application supports the Goals,
Objectives, and Policies outlined in the Transportation Element, Intermodal and Multi-Modal
Transportation Sub Section of the GMP.
LEGAL CONSIDERATIONS: The Board will have the opportunity to accept or reject the funds if the

grant is approved. Accordingly, this Office has no issue with respect to the legality of this request, which
is appropriate for Board action and requires a majority vote for Board action. - JAB

Collier County is an entitlement grantee and receives funds from the U.S. Department of Urban and Housing
Development (HUD) through three (3) federal programs: Community Development Block Grant (CDBG), HOME
Investment Partnership (HOME) and Emergency Solutions Grant (ESG). HUD requires the County complete a Five-Year
Consolidated Plan that includes a housing assessment, market analysis and assessment of community development
needs. The Consolidated Plan is meant to address the needs of low and moderate-income persons and families,
including homeless individuals. It establishes the County’s program priorities, goals and objectives for community
development programs and sets the framework for subsequent one year action plans that describe specific activities
that will be funded through the County’s grant program. It establishes the County’s program priorities, goals and

Collier County receives funds from the Florida Housing Finance Corporation (FHFC), to administer the SHIP program.
The SHIP program is governed by Chapter 420, Part VII, Florida Statutes and Rule Chapter 67-37 of the Florida
Administrative Code. FHFC requires the County to complete a Three-Year Local Housing Plan (LHAP). The LHAP is
meant to address the needs of extremely low, very low, low and moderate-income persons and families, including
those with Special needs (420.9075(5), F.S.)
The local affordable Housing Trust Fund (HTF) was established by Collier County Resolution 2018-82 to facilitate the
development of housing that is affordable for very low, to gap income residents in Collier County. The criteria for the
HTF is based on the Community Housing Plan and the Housing Element of the Growth Management Plan.
Funding Availability
The funding application anticipates the availability of CDBG, HOME and ESG funds from the U.S. Department of
Housing and Urban Development and SHIP funds from the Florida Housing Finance Corporation. Exact funding
amounts are still pending from HUD and FHFC.The local affordable Housing Trust Fund is eligible to receive deposits
from the sale of County owned property, repayment of Affordable Housing Density Bonus units, and defined revenue

streams.
CHS will allocate planning and administration and CHS Project Delivery for the allocations prior to funding the
remaining balances to projects for all four funding sources, as applicable.
Considerations Prior to Applying
CHS wishes to provide as much information to prospective applicants as possible so informed decisions can be made
about applying for grant funds. The application is just the beginning. Below is a snapshot of some of the items to
consider during that thought process. Additional specific regulations or requirements will apply based on the
particular project. This is not intended as a complete listing.
No project can begin without an approved environmental review, which can take from 30 days to 6 months or
more depending on level required
A number of policies and procedures will be required to be written and followed. Monthly pay requests are
required with auditable detailed backup appropriate for the type of project
If awarded funding for salaries, the organization will be required to submit substantial payroll and banking
information as backup for each pay request
Documentation for all expenditures is required
Attendance at quarterly Partnership Meetings is mandatory
Adherence to project schedule and spending of grant funds timely is critical – appropriate thought must go
into planning the timeline for your project
Monitoring will occur during and at closeout of your project, and possibly annually thereafter depending on
the nature of the project or program and whether beneficiaries have been achieved
Quarterly reports are required on the progress of project
Segregation of grant funds or demonstrated segregation in operation of funds is required
Adhere to federal and or local procurement regulations
All advertisements or publications associated with grant funded projects must contain the County logo and
acknowledgement of HUD funds in the project
If a construction project, specific additional regulations might apply such as Davis Bacon for wage
determination
Retainage from each payment request may be taken until all terms of the contract are met; and only released
upon a final clean monitoring report
Records and staff must be available for internal audit or HUD audits as needed
Annual reports will be required during the affordability and project use periods.
Funded entities will be required to retain all records and documents for 3 years after the grant closeout,
unless otherwise specified.
If the project generates program income, a program income reuse plan will be required for the life of the
grant and the compliance monitoring period.
If awarded under HOME, affordability periods will be required depending on the type of construction, new or
rehabilitation, single family or rental. Annual monitoring will be conducted by CHS to ensure affordability,
client targets of specific income limits depending of housing use.
If awarded under ESG, can fund only homeless services within specific income limits (30% of AMI)

This project will provide public facilities and infrastructure which will improve access, safety and the health of
community. The area surrounding the project is residential including low-income housing. The area is also adjacent to
commercial activity centers including the Collier County Government complex. This is a major employment center and

most of the county services are located at this location including the Board of County Commissioners, the County
Courthouse, Jail, Juvenile Center, Public Health Department, Tax Collector, County Museum and the Collier Area
Transit (CAT) Transfer Center. At this location, passengers can board all transit buses and therefore have access to
larger employment and shopping areas and make regional connections to Lee County Transit (LeeTran). This project is
less that 1/2 a mile from Wal-Mart, several grocery stores and restaurants including major fast food chains such as
McDonalds, Wendy's and Sonic. There are numerous churches and non-profit organizations in this location such as St.
Matthew's House, the Salvation Army, various thrift stores and shelters. This project is approximately 1 mile from
Lorenzo Walker Institute of Technology (a local technical college), Lorenzo Walker Technical High School and East
Naples Middle School which is where these middle school age students would attend.
The local neighborhood is comprised of all ages ranging from elderly that purchased their homes 30+ years ago, 2-
parent families with school age children, empty-nesters and single parents, etc. The elementary, middle and high
schools in this school zone total 3,093 students of which 79% are considered economically needy. According to the
American Community Survey - 5-year estimate (2013-2017) (ACS) 11.4% of the individuals in the area of Peter's Ave.
live below the poverty level. The median household income is $52,478. Approximately 38% of the residents in the
area are employed in the retail trade and/or entertainment, accommodations and food services industry. In most
instances, the family income depends on tips and steady employment, which is not always dependable since Naples is
a highly seasonal and tourist destination where some of the service work is seasonal.
According to the ACS, the population in this area consists of approximately 20% Hispanic or Latino. The Collier County
Public Schools all have websites and demographic information for the 2019-2020 school year. The three schools zoned
for this area's websites combined indicate that 58% of the students are Hispanic. Traditionally, this is a culture that
walks or bikes. The websites also indicate that 52% of the total students speak Spanish at home ant almost 14% speak
Haitian Creole.
This project will create a sidewalk infrastructure that will help improve the lives of the community members by
creating a safe, walkable and healthier community. Many of the streets in this area were built without sidewalks.
Providing safe sidewalks and facilities will increase the number of trips made by walking. People who have to walk for
their basic necessities will be safer with a sidewalk and infrastructure.
Historically, when this neighborhood was developed, the developer/builder was not required to install sidewalks as
part of their subdivision development. Peters Ave. is located in East Naples and the homes range from 30 to 50 years
old. Most residents are forced into the street to avoid deep swales but are then placed in direct conflict with vehicle
traffic.
The MPO's Bicycle and Pedestrian Master Plan, adopted in 2019, identified Peters Ave. as a high priority because of its
proximity to a school and because it is in a very high environmental justice area. The BGTCRA Redevelopment Plan as
well as the Bayshore Beautification MSTU Master Plan identifies walking and biking as predominant forms of direct
transit within the MSTU area. The MSTU Master Plan proposed multiple modes of transportation within the district
including sidewalks, bikeways, multimodal paths, greenways and public transit routes as well as opportunities at a
regional scale.
Based on the current County budget, Collier County Transportation Planning only receives $250,000 annually for all of
the sidewalk needs within the county. This funding stream is used predominantly to leverage or match other grants
and is not used to implement projects. This current funding opportunity will help a project that has been listed as a
community need but would not receive funding from another source. In addition, the largest source for funding
opportunities is derived from the Collier MPO. The Collier MPO issues a call for projects every two (2) years and funds
them based on the Florida Department of Transportation's Work Program 5 years into the future. The next call for
projects from the MPO is expected in 2021 for funding in 2026. Therefore, if this project did not receive funding from
the CDBG grant, the next potential opportunity for this project would be in 2021 for implementation in 2026.

This project will provide public facilities and infrastructure improvements to residents, local schools, non-profits and
commercial areas.
This project is located within the Bayshore Gateway Triangle Community Redevelopment Area (BGTCRA) and also
located in a low and moderate income area. This area of BGTCRA meets HUD criteria outlined in 24 CFR 570.280 (a)
(1) (l):
"...An activity, the benefits of which are available to all the residents in a particular area, where at least 51 percent of
the residents are low and moderate income persons..."
Peters Ave. is a residential street south of the intersection of Airport Pulling Road and U.S. 41 (aka Tamiami Trail East)
and immediately west of the Courthouse Shadows PUD. In addition, the U.S. Census shows this area in Census Block
107.01. This census block is located on the LMA Map for Collier County.
This community has neither the private resources nor the economic capacity to construct the needed sidewalk
improvements in this location. The CRA community has no neighborhood association to pay for the improvements
and the residents are economically distressed.
Sidewalks form the backbone of the pedestrian transportation network. Sidewalks also reduce pedestrian injuries
from collisions with automobiles. Without sidewalks, public rights-of-way are inaccessible to all pedestrians, including
people with disabilities. When sidewalks are not available, pedestrians are forced to share the street with motorists,
access to public transportation is restricted and children might not have safe places to play. Federal regulations do not
require agencies to build sidewalks, the decision is left to States and local agencies.

As part of the Collier County Government Agency, Transportation Planning is a section within the Capital Project
Planning, Impact Fees and Program Management Division and reports to the Growth Management Department.
Transportation Planning's day-to-day responsibilities include the planning of a multi-modal transportation network in
coordination with the Collier Metropolitan Planning Organization. This network must address deficiencies as well as
forecast growth to ensure that the quality of life of the County's residents and visitors are enhanced by the
improvements. Transportation Planning closely works with the Transportation Engineering Division to maintain a safe
transportation network, implement multiple capital projects which are funded through various means such as federal
and state grants.
The Transportation Planning Manager, Trinity Scott will oversee this project and has almost twenty (20) years
experience in transportation design, construction, studies, and traffic modeling. The Transportation Planning Principal
Planner, Lorraine Lantz has over fourteen (14) years experience with transportation planning activities, project
management and grant coordination and implementation.
Transportation Planning will partner with other divisions within Growth Management for land use and development
issues and property acquisition (if necessary), procurement services division for bidding and purchasing items, the
Office of Management and Budget (OMB) for financial support, County Attorney's Office for legal issues along with
the County Manager's Office for program assistance and administration. The OMB and the County Clerk's Office
provide accountants and fiscal technicians that have a great depth of experience in managing federal grants.
Transportation Planning staff have met with Community and Human Services for assistance. Grant administrative staff
have received training from the OMB Division, Clerk of the Court's Office, Procurement Division in grants
administration through various locally administered sessions.

The Collier County floodplain is very broad and except for areas near the coast which are subject to tidal surge flood the
floodplain is generally very shallow. This broad, shallow floodplain is created by sheetflow which is created during
extremely heavy rainfall events such as the theoretical 100-year rainfall as shown on the flood insurance rate map
published by the Federal Emergency Management Agency.
In the Bayshore area, existing canals, ditches and natural sloughs are mapped as the AE flood zone. This designation
identifies that the depth of flooding is expected to be greater than three (3) feet during the peak flooding from a 100-
year rainfall event. Much of the Bayshore area is mapped within the AH flood zone which identifies that the depth of

issued and the work can begin.

Transportation Planning has spent approximately $5,000 in staff time evaluating the location and needed project,
working with the consultant engineer to provide a cost estimate and feasibility/constructability analysis of the project
and developing concept plans for the project. The KRG Courthouse Shadows LLC developer is required to contribute
$50,000 toward the design and construction of the sidewalk along Peters Ave. The Transportation Planning staff time
and the developer's contribution will be used as leverage for this project and will be outside the scope of the request
for funding.
Collier County has the financial stability with a checks and balances system to sustain payment to vendors through the
established County financial system and the ability to wait for reimbursement from the funding grant.
Should Collier County receive funding for the proposed project, funding would be awarded in the amount of
$389,084.91 for construction). The design and permitting for the project is estimated to cost $97,271.23. The CEI is
estimated to be $58,362.74. The developer contribution of $50,000 discussed earlier will be used towards the total
design costs. The additional estimated project costs of $105,633.97 will be paid for with local funds.

The outcome of the sidewalk improvements provide for pedestrian accommodations separated from the roadway and
have been identified in MPO and Bayshore CRA and MSTU needs plans. Sidewalks provide many benefits including
safety, mobility and healthier communities.
The performance measure for this project will be increase public safety and the reduction of pedestrian/bicyclist
crashes. Florida Department of Transportation adopted a "Vision Zero" performance measure creating a statewide
planning focus on eliminating fatalities and reducing serious injuries on all public roads. Increasing the number of
sidewalks with infrastructure improvements is one of the strategies designed to eliminate severe and fatal crashes.
