EXECUTIVE SUMMARY
Recommendation to approve the release of three code enforcement liens with a value of $41,209.20
for payment of $3,000 in the code enforcement actions entitled Board of County Commissioners v.
Jessica Nicole Thompson and Jennifer Diane Thompson, relating to property located at 843 94th
Ave. North, Collier County, Florida.
OBJECTIVE: For the Board of County Commissioners to accept an offer to release three code
enforcement liens, with an accrued value of $41,209.20, for payment of $3,000 in relation to Code
Enforcement Board Case No's. CELU20180006133, CEV20180006947 and CEV20180009971.
CONSIDERATIONS: When the subject property was owned by Jessica and Jennifer Thompson, the
Code Enforcement Special Magistrate ordered the imposition of three code liens on the property, due to
various code violations. The first lien was for code violations consisting of outside storage of interior
furniture, lamps, rugs, plastic bags and containers, aluminum gutters, wood, and other debris at the
residence. The lien was recorded on November 7, 2018, at O.R. Book 5569, Page 2868. The current lien
amount is $23,711.85, based on 236 days of accrued fines ($100 per day from September 3, 2018,
through April 26, 2019) totaling $23,600, plus $111.85 in operational costs. The property was brought
into compliance with these violations on April 19, 2019. The second lien was for code violations
consisting of commercial vehicles with equipment and materials attached and extending beyond the
length of the vehicle parked at the residence. The lien was recorded on November 7, 2018, at O.R. Book
5569, Page 2866. The current lien amount of $223.80 is based on operational costs of $112.05, plus an
additional $111.75 in operational costs. The property was abated on August 3, 2018. The third lien was
for code violations consisting of commercial vehicles parked at the residence. The lien was recorded on
April 24, 2019, at O.R. Book 5621, Page 1691. The current lien amount is $17,273.55, based on 168 days
of accrued fines ($100 per day from September 3, 2018, through April 26, 2019) totaling $16,800 plus
$223.55 in operational costs and a civil penalty of $250.
Robert A. and Marion G. Gilkerson re-acquired the property via General Warranty Deed, foreclosure
recorded on July 10, 2019. Pursuant to Resolution No. 2012-46, a request for reduction of fines may be
considered, in part, when a lien encumbers property under new ownership and the new owner has
diligently pursued abatement and achieved compliance and/or when payment of the lien would impose a
severe financial hardship on the owner. The new owners took title to this property with uncorrected
violations after the satisfaction of mortgage was surrendered by the payors, Jessica and Jennifer
Thompson. There was a substantial amount of time and money spent for clean-up, repairs and legal
expense for the property. Mr. Gilkerson’s health is declining and a substantial amount of time is needed
to recover from the required treatments. The property is actively maintained, and the owner has paid
$3,000 in settlement of fines and requesting the remaining $38,209.20 in accrued fines be waived. There
are no known code violations remaining on the property.
FISCAL IMPACT: Payment of $3,000 in settlement of fines has been received. If approved by the
Board accrued fines in the amount of $38,209.20 would be waived.
GROWTH MANAGEMENT IMPACT: There is no growth management impact associated with this
action.
LEGAL CONSIDERATIONS: The County Attorney’s Office has reviewed this item and approved it
as to form and legality. Majority support is required for approval. This item conforms to the Board’s
policy contained in Resolution 2012-46. KN

We received a letter for the 1st. time from you on Novembe 7th, 2019 telling us that we failed
to take any action regarding the violations on the property at 839 94th Ave. North. We have
NEVER been notified until yesterday. We currently have hired a lawyer to help us with this
mess that the Jennifer and Jessica Thompson have left us with. Not to mention high lawyer
costs and an absolute mess ofthe interior and exterior of94th. We are working on clearing
the deed in Lue of Foreclosure and would like to clear this up as soon as possible.
My health is been failing me and I am a current patient of the Mottit in Tampa for my canser
treatments. I would like to make an offer of S3,00O dollars. lf that would be acceptable we
would certainly appreciate it.

Detail ilescription A month ago, I have noticed that the occupants have being hauling large quantity of items from
their two pickup trucks to the residence. I thought it was a one time occurrence. lt now has
been happening every week where they haul bedroom, kitchen living room etc. to the residence
and then on Fridays they haul the "leftovers" to the curb for pick up. I believe they are
operating some sort of business out of the residence. I do not want to confront them so I am
asking your department to check and see if they have a business tax receipt and/or a zoning
certificate to operate this business from the residence. lf you can get there today while the
huge pile is at the curb, it would be appreciated.

The tenant were not home and we explained
to her the variouse violations at the property.
She said that she has been trying to evict the
tenants but they have no lease and they are
not paying rent. ES-46 informed her that the
case has been removed from the CEB docket
for tomorrows hearing but that it will be
scheduled for the July 26th hearing. I advised
her to initiate the eviction process, which
would eliminate the need for a hearing and
the case would be closed. however, the case
will be heard if lhe tenants remain. We
exchanged contact information and the

The tenant were not home and we explained
to her the variouse violations at the property.
She said that she has been trying to evict the
tenants but they have no lease and they are
not paying rent. ES-46 informed her that the
case has been removed from the CEB docket
for tomorrows hearing but that it will be
scheduled for the July 26th hearing. I advised
her to initiate the eviction process, which
would eliminate the need for a hearing and
the case would be closed. however, the case
will be heard if the tenants remain. We
exchanged contact information and the
meeting was ended. Follow up continues. AF-

Based upon the foregoing Findings ofFact, and pursuant to the authority granted in Chapter 162,
Florida Statutes, and Collier County Ordinance No. 2007-44, as amended, it is hereby ORDERED:
A. Petitioner's Motion for lmposition of Fines/Liens is GRANTED'
B. Daily fines of$100.00 per day are assessed against the Respondents for 33 days for the period
from September 3, 201 8 to October 5, 2018, for a total amount of fines of $3,300'00
C. Respondents shall pay operational costs for the Imposition of Fines hearing in the amount of
