RESOLUTION NO. 99- 79
?ELATIIIG TO PETITION IIUMBER V-98-20,
FOR A VARIANCE ON PROPERTY HEREINAFTER
DESCRIBED IN COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapter 175,
Florida Statutes, has conferred on all counties in Florida the power to
establish, coordinate and enforce zoning and such business regulations cs
are necessary for the protection of the public: and
WHEREAS, the County pursuant thereto has adopted a Land De~e:cpme~:
Code (Ordi:1a.nc,,", :Ie. 'jl-102) ',;hid, establishes regulations for thiC ;:cni:iCj
of particular g~ographic di"/isions Gf t~~ Count'l, amon~ ~i~lich 15 ~~;~
granting of variances: and
WHEREAS, th~ Board of Zoning Appeals, being the duly elected
constituted Board of the area hereby affected, has held a public hearing
after notice as in said regulations made and provided, and has cG~sidered
the advisability of a lO.3-foot variance frOM the required 15-foG~ rear
yard ac~essory structure setback feet tG ~.7 feet as shown on th0
attached plot plan, Exhibit "A", in a "PUD" Zone for the property
hereinafter described, and has found as a matter of fact that
satisfactory provision and arrangement have been made concerning all
applicabl~ ~~tt~rs r~quired bJ said regulations and in accorda~ce i:::~
Section 2.7.~ of ~h~ Zoning ?~gulations of said Land D~velop~ent C~de f~r
the unincorporated area of Collier Co~nty; and
WHEREAS, all interested par~ies have been given opportunity to be
heard by this Board in public meeting assembled, and the Board having
considered all matters presented;

Book 9, Page 61" of the Public Records of Collier COl,nty,
Florida.

required 1S-foot rear yard accessory structure setback to 4.7 feet as

conditions:
1. Hedges, bushes and/or trees shall be planted along
the northeast portion of sub;ect Lot 18 in ~ mClnner
consistent with and similar to the vegetation planted
along the northwest portion of Lot 18.
