Located at 120 Andrea Ln, Naples, FL 34114: Folio: 738680006. Service was given on October 24, 2019. I would now like to present case evidence in the following exhibits: 2 Photographs from October 24, 2019 and 2 photographs from January 23, 2020 all taken by myself. An aerial of the property. On October 24, 2019 while patrolling the area, I observed the vehicle with no license plate. A notice of violation was posted on the same day. On November 8, 2019 I received a call from Amber Celler stating that the vehicle was hers and that she would move it. I returned on November 12, 2019 and observed the van remained with no license plate. The case was then prepared for a hearing. As of today, the violation remains. **Side note: The owner of the vehicle previously lived there. She has no ownership/interest in the property. The owner of the property is deceased, and I have had no contact with anyone else from the property. It is noted that the property contains wetlands or other surface waters as defined in Chapter 62-340 F.A.C. Specifically the site supports wetlands, characterized by the following: Vegetation: Taxodium, Persea palustris, Quercus laurifolia, Acer rubrum, Blechman serrulatum, Boehmeria cylindrical, Brazilian pepper Hydrologic Indicators: watermarks, elevated lichen lines, active cypress knees Soils: stripped matrix; Hallendale and Boca fine sand Works in the area would require an Environmental Resource Permit (ERP). Information regarding dredging and filling in wetlands, sample drawings and an ERP application form are enclosed for your reference. To qualify for permitting in wetlands, the impacts generally need to be minimized to the fullest extent practicable. Mitigation may also be necessary to offset authorized impacts. If you would like to apply at this time, please complete sections A, C, and D of the ERP application and submit them to our office, along with appropriate drawings and site plans with any areas of proposed dredging or filling dimensioned and clearly indicated (by crosshatching). Please indicate any areas that are to remain undisturbed. Upon receipt of your application and site plans the Department will determine if a permit would be required. To expedite our review, please include copies of this and any other correspondence with the Department and any consultant reports describing the property. An even bigger issue could involve damage to wetlands. In March 2005 the DEP did a Wetland Determination and identified 2 the site as containing Wetlands within the front 200', observing strong lichen marks and water marks in the front 30’. DEP made no determination past 200', so it’s unknown now if wetlands extend beyond that point. Try to measure or estimate how far into the lot the clearing/campsite sits, and get a rough idea of the size of the cleared areas.
