A. Code Enforcement Division update - [Mike Ossorio]
Ms. Davidson provided the report"Code Enforcement Division Monthly Report October 22,
November 2 1 , 20 l9 Highlights " " for informational purposes. She reported Investigator Steven
Athey encountered an older man living alone without electricity or water during his patrols. The
Division initiated an effort, including collecting donations to remediate the issue.
Mr. Dunnavant and Mr. Boughton orriyed at 3:08 p.m.
B. Public Utilities Division update - [Tom Chmelik or designeel
Mr. Fey submitted the monthly report on response time for "Letters of Ayailability, Utility
Deviations and FDEP Permits" for infbrmational purposes. He noted staff shortages continue to be
addressed and are affecting response times. The next Utility Standards Subcommittee meeting will
be convened in January.
C. Growth Management Department/Transportation Engineering and/or Planning - Uay Ahmad
or designeel
Ms. Lantz reported a study of Immokalee Road from Livingston Road to Logan Blvd. will be
conducted to determine the measures needed to improve traffic flow in the area. This includes
options such as improved signalization and timing, a Diverging Diamond, Continuous Flow
Intersections, etc. The recommendations from the study are anticipated to be presented to the Board
of County Commissioners (BCC) in the June of 2020 timeframe.
D. County Fire Review update - [Shar Beddow and/or Shawn Hanson]
Ms. Beddow reported:
o Tumaround times are as follows: Building Plan review - 2 days; Site Plan reviews - 2 days.
. The Florida Fire Marshall's held a conl'erence last month with the focus of ensuring the code
requirements are consistently apptied in all areas of the State.
o Investigation will occur to determine the feasibility ofconvening a "Hoarders Class"
workshop for any interested party.

o The Collier and Lee County Fire Marshall Association Charity Clay/Skeet Shoot will be held
this Saturday (December 7th) and there is space available for additional teams.
E. North Naples Fire Review update - [Capt. Sean Lintz or Daniel Zunzunegui]
Capt. Linz reported tumaround times are as follows: Building Plan review 488 @ 5 days; Site Plan
reviews 54 @ 3 days. A new policy has been estabtished whereby after the 2nd rejection, a meeting
is scheduled with the applicant to review the outstanding issues. An additional plan reviewer has
been added to staff.
The Committee requested Capl. Linz to review the potenlial for applicants viewing the application
status on the Department's "Mobilize" system-
Mr. l/alle arrived at 3: l9 p.m.
F. Operations & Regulatory Mgmt. Division update [Ken Kovensky]
Mr. Kovensky submitted the "Collier County November 2019 Monthly Statistics" which outlined
the building plan and land development review activities. The following was noted during his
report:
r Electronic submittals remain at 56 percent of activity.
. Staffis still in the testing phase for the credit card portal to be added to CityView.. Staff continues to monitor response times for applications as the Committee reported some in
the industry are expressing concems. Staffnoted the response time goal is 15 days from a
"completed application."
G. Development Review Division update [Matt Mcl,ean]
Mr. Mclean reported:
r The County is looking into opportunities to improve device communication for inspectors in
the field in some outlying areas, including installation of signal boosters.o Review of the requirements for acceptance of utilities continues with the County Attomey
providing input. Potentially, the preliminary phase of the process may be etiminated and the
Subcommittee will be reconvened, when necessary, to provide input on the item.
Mr. English arrived at 3:3 I p.m.
Ms. Spurgeon DeJohn atived at 3:32 p.m.
. It appears some Engineers ofRecord are not inspecting sewer videos before they are
submitted to the Division for review, leading to a waste of stafTtime. He requested those
parties to view the videos, as required, prior to submission to determine ifthere are any
issues needing to be addressed.
VI. New Business
A. Minor Structures in Easements [Matt Mcleanl
Mr. Mclean provided the " Permitting of Minor Structures in Utility, Drainage or Similar
Easements " and " Easemenl Use Agreement" for information purposes. He reported:o The Subcommittee met on the issue of uses in drainage and maintenance easements and staff
continues to work with the County Attomey on the matter.

o The use agreement would be executed by the landowner and County outlining the
requirements for any use.
o Screening ofmechanical equipment (wing walls, etc.) will be allowed and another concept is
allowing uses in the blanket easements, except in areas where infrastructure is located (drain
pipes, etc.)
o Staffhopes to present the item to the Board of County Commissioners in January and he
requested feedback on the issue from the Committee.
During Committee discussion it was noted some items are still under review, such as landscaping
and roof overhangs. The Committee is not scheduled to meet in January and some form of a
recommendation should be crafted if the item is to be heard by the BCC before the DSAC convenes
again.
Mr. Mulhere moved to recommend the Board of County Commissioners approve the ,,Easement
Use Agreement" subject to the Subcommittee recommendations and grant permission lo the
Subcommittee lo meet one addilional time to delermine if any changes are necessdry to the
agreement before forwarding it to lhe BCC.
Mr. Brooker expressed concem on Section #5 of the Agreement which holds the County harmless
for certain liabilities, including personal injury or property damage during use ofthe easement by the
County. He recommended clarification be provided on what if any ramifications the County would
have if they damaged any structure, etc. allowed in the easement area while performing work; or if a
County employee injures themselves or others.
Mr. Mulhere amended the motion to authorize the Subcommiltee to meet with staff to provide
input on finali4ing the agreement and return it to the full Committee for a recommendation. In
the event the item is to be heard by the Board ofCoun$t Commissioners prior to convening a
meeting of the Development Services Advisory Committee, the Subcommittee recommendation
shall be broughtforth on behalf of thefull Committee, Second by Mn Valle.
Carried unanimously 14 - 0.
B. LDC Amendments [Jeremy Frantzl
LDC Section to be Amended: 2.03.09 (Open Space Zoning Districts)
The amendment eliminates seating limitation and expands the hours ofoperations for restaurants
within the Golf Course and Recreational Use District (GC) when located within the Golden Gate
City Economic Development Zone.
Mr. Frantz presented the proposed amendment noting:
o It's been developed at the direction of the BCC and removes the 150 seating limitation and
expands the hours of operation from l0:00 p.m. to 12:00 a.m. It is applicable to the Golden
Gate City area only.
. There was a public information meeting held and it was relayed the use ofthe property
should remain as a golf course and not converted to other uses.
o The Collier County Planning Commission reviewed the proposal and recommended the
amendment not be adopted.
During Committee discussion the following was noted:

o The restriction that the area was to be retained as "green space" was repealed by ajudicial
ruling.
o Though the neighborhood may desire a golfcourse use. the zoning provides for other
allowed and conditional uses.
. Concem the proposal may constitute spot zoning to accommodate a proposed use.
Mr- Brooker movedJor the Development Semices Advisory Committee recommend to the Board of
County Commissioners not adopl lhe proposed amendmenl. Second by Mr. Curl. Canied
unanimously l3 - 0. Mr. Mclean abstained.
Mr. French noted staff was directed to prepare the proposed amendment by the BCC and a feasibility
study is being developed for the property on which uses may want to be proposed for the site. These
may include housing, hospital facilities, etc. which may be processed as a PUD not requiring a Land
Development Code Amendment.

4. Old Business
a. Structures in Easements - Policy and Procedure easement.
Matt Mclean, Director, Development Review provided the Executive Summary
" Recommendation to establish policy and a standard template for an Easement Use
Agreement associated with minor encroachments in utility, drainage or similar easements
on behalf of the Board of County Commissioners " and " Easement Use Agyeement " for
consideration. He noted:
o The Subcommittee previously reviewed the proposed policy on November 22nd and staff
subsequently met to review possible changes based on the input from this meeting and
the December Development Services Advisory Committee meeting.
o The Executive Summary provides clarification on the proposed policy, which addresses
single-family residences on fee simple owned property.
o Multi-family and commercial uses will be addressed independent of the policy through
the Site Development Plan application process and the requirements will not apply to
common area tracts of land.
o Roof overhangs and landscaping will be exempted from the policy and are allowed in the
areas in question with associated letters of no objection.
o The list of allowed uses includes fences, A"/C pads, pool equipment, generators, sidewalks
and other minor structures as determined by Collier County Growth Management Staff.
o The allowed uses do not include masonry concrete walls for screening mechanical
equipment (or other uses).
o The item is scheduled to be heard by the Board of County Commissioners on January 14,
2020 on the Consent Agenda.
During Subcommittee discussion, the following was noted:
o Concem on excluding concrete masonry walls from the allowed uses given their sound
attenuation and non-combustible properties - Matt McLean reported the equipment may
be ploced outside of an easement area and staffdoes not support use of concrete walls in
these areas.
o The policy is not part of the Land Development Code, but will be implemented at the
direction of the County Manager/Board of County Commissioners.

o Air conditioner equipment and pool equipment pads witl be added to the list of allowed
uses.
o The language in Section 5 of the Use Agreement was discussed at the DSAC meeting
with concem expressed on indemnifuing the county from any liability - stalJ'noted they
reviewed the language in the agreement und it is standord wording contained in similar
Counry document.s.
o The DSAC delegated authority to the Subcommittee to provide a recommendation if the
item is to be heard before the next DSAC meeting in February and action should be taken
so staffhas input from the Committee.
Mr. Foley amended the motion for the Subcommittee, as delegated by the Development
services Advisory Committee, recommend lhe Board of county commissioners approve the
policy as proposed by staff subject to staff clardying the language air conditioner equipment
and pool equipment pads are included in the allowed uses and supports it as written with the
additional requirement allowing of concrete masonry walls for screening. The subcommittee
is silent on lhe "Easement use Agreement" bul recognizes the language is consistenl wilh
olher Counlt documents of this nature. Second by Mr. Curl
It was noted the recommendation ofapproval should not be contingent upon allowing
construction of masonry screening walls, but consideration be given to include them in the list of
exemptions.

Kathy Curatolo, Collier Building Industry Association suggested the recommendation outline
any concems raised so the BCC is aware of the issue.
Mr. Foley amended the motion for the Subcommittee, as delegated by the Development
services Advisory committee, recommend lhe Board of county commissioners approve the
policy as proposed by staff subject to staff clarifying the language air conditioner equipment
and pool pads are included in rhe allowed uses. They suggesr consideration be given ro
include concrete masonry walls as an ollowed use due lo their abitily to aid in sound
altenualion and resistance lo heat ameliordlion from the devices lhey screen. The
subcommittee is silent on the requirements of section 5 of the "Easement use Agreement. bul
tecognizes the language is consistent htith other County documents of this nature. Second by
Mr. Curl.
The following was noted during Staff and Subcommittee discussions:o The item will be on the Consent Agenda and concem the BCC will not consider the use
of masonry walls for screening but recognized this is the process in place for such items.t The policy may be changed ifnew issues arise, or further consideration is requested on
allowing concrete walls, however staff will not support this change ifrequestid.o The main benefit for allowing masonry walls is they are non-combustible and also act as
sound barriers for the noise created by the equipment.
Motion carried unanimously 5 - 0.

a. Discussion Regarding'Mixed-Use" Definition
Mr. Frantz reported:
o Staff continues to review potential standards for the definition of "mixed use."
o Determining the appropriate mix ofuses is currently done on a case-by-case basis, as
projects are reviewed.
o There are numerous methods for creating a definition of "mixed-use" and the method
used should be based on the development goals ofthe area.
. The Bayshore Gateway Triangle CRA is updating their Master Plan and may be
addressing the definition. It may be beneficial for the Subcommittee to provide input on
the issue to any interested party.
o The definition is applicable in all sections of the code, including areas outside ofthe
Bayshore Gateway Triangle CRA, and at this point will continue to be implemented on a
case-by-case basis.
. Staff will continue to review the definition as needed and provide updates as necessary.
Mr. Mulhere added that determining whether a project is considered mixed-used is important in
the Bayshore Gateway Triangle CRA because mixed-use projects are allowed additional height.
Additionally, RLSA Towns and Village Centers require mixed-use development.
Mr. Frantz noted that different areas would require different definitions of mixed-use. More
research, and more specific goals, would be needed before staff would consider an LDC
amendment.
Mr. Brooker suggested that staff should look at the issue further.

10.03.06 Public Notice and Required Hearings for Land Use
Petitions
The amendment establishes new development standards for special events conducted within
public rights-of-way. It addresses the process, permit requirements, and signage requirements
for special events held within public rights-of-way when the temporary or partial roadway
closure is deemed necessary.
Mr. Henderlong presented the proposed amendment and the following was noted during
discussions:
o Tourist Development funding is not required for an event to qualifu; however a
determination needs to be made if the activity promotes tourism.o There is a certification process for the "crowd manager" referenced in the
amendment.
o FDOT requirements are required to be met if the event impacts a State roadway.
The Subcommittee reviewed the proposed amendments and provided the following
comments:
Section 5.04.05.A.S.vii - Clarifu the Tourism Development Council would not review all
events in rights-of-way.
Section 5.04.05 A.5.d - Eliminate the first two sentences which state "Any event which
necessitates the use ofthe public rights-of-way ofan arterial or collector roadway, or
reword since any event could use the righl-of-v,ay. "

LDC Section to be Amended: 9.03.03 Types of Non-conformities
The amendment clarifies the calculation of density for single-family, two family or duplex
dwelling units and multi-family units, on legal nonconforming lots of record in the RMF-6
District.
Mr. Henderlong presented the proposed amendment.
Section 9.03.03 A.6 - The Subcommittee noted investigation should occur to ensure the
wording "Agreement for Deed Executed" is appropriate for the section.
Mr. Mulhere movedfor the Development Semices Advisory Committee to recommend the
Board of County Commissioners adopt the proposed amendment subject to the County
Attorney's Ofjice reviewing the language "Agreement for Deed Executed,, to ensure it is
the appropriate termfor use in the proposed amendment. Second by Mr. Curl. Carried

The LDC amendment (LDCA) serves to implement several policies of the recently adopted
Golden Gate Area Master Plan (GGAMP) by creating the Golden Gate parkway overlay
District (GGPOD). The GGPOD will be comprised of two new subdistricts - the Activity
center subdistrict (GGPODAC) and the Downtown subdistricr (GGpoD-DT). The GGpoD
will supersede the provisions of the Golden Gate Downtown Center overlay District and the
Golden Gate Parkway Professional Office Commercial Overlay.
Mr. Johnson presented the proposed amendment and " DSAC-LDR I 2- I 7-l 9 powerpoint
Presentation" and provided a briefoverview on the history ofthe proposed overlay district.
During the meeting, Mr. Johnson distributed an updated version of thi GGpoD toihe
DSAC-LDR, containing changes proposed to the following sections:

The Subcommittee reviewed the proposed amendment by section with the following
comments:
Section 2.03.07 F.1.a - Consider including the term "surrounding'-' or "economic
development zone" when describing or the referring to the "community" given this area
could serye as a focal point.
Section 2.03.07 F.l.e - Include the terms "structures and sites".
Section 2.03.07 F.2.4 - Consensus on staff s recommendation to eliminate"Additive
Manufacturing" and"Advanced Manufacturing" from the definitions as the intent will be to
utilize performance standards where applicable.
Section 2.03.07 F.2.c - Discuss with the County Attorney on how to handle any PUD's
which may straddle the boundaries of the impacted areas.
Section 2.03.07 F.2.b - Consider removing the "and/or " wording and simply reference the
"underlying zoning district."
Section 2.03.07 F.2.4 - Determine how to address statutory changes in the Targeted
Industries.
Section 2.03.07 F.6 - Table - Eliminate the headers in the table, such as "R," "M," and "C"
as they may be unnecessary and lead to confusion with the references to "P" Permitted Uses
and "C" Conditional Uses in other sections of the table. Also, staff should look into
numbering for each use (row) in the table.
Section 2.03.07 F.6 - Table Re-review the language "Any other residential use which is
compatible in nature with the foregoing uses, consistent with the list of permitted uses ond
the purpose and intent of the GGPOD" - define compatible or identifr standards; remove
"C" as the section only references permitted uses (or reword).
Section 2.03.07 F.6 - Table - Display headers on each page for ease of the user.
Section 2.03.07 F.6 - Table - Consider allowing "Drinking places" as a permitted use.
Section 2.03.07 F.6 - Table - Review the rationale for categorizing " Health services " as a

New “Reviewed for Code Compliance” Stamp
Effective Date February 1, 2020
Florida Building Code, 6th Edition 2017
[A] 107.3.1 Approval of Construction Documents.
When the Building Official issues a permit, the construction documents shall be
approved, in writing or by stamp, as “Reviewed for Code Compliance.” One set
of construction documents so reviewed shall be retained by the Building Official.
The other set shall be returned to the applicant, shall be kept at the site of work
and shall be open to inspection by the Building Official or a duly authorized
representative.
Effective February 1, 2020, all plans reviewed by our licensed plan
reviewers will have one of these new stamps affixed to them upon
approval of the permit. The stamp with the fire emblem will be applied
to all commercial permits that require a fire review per the FFPC. The
other stamp will be applied to all one and two family permits and any
commercial permits that fire reviewers deem not applicable at
first review.
