EXECUTIVE SUMMARY
Recommendation to approve the Landowner Agreement with Collier Land Holdings, LTD and
CDC Land Investments, LLC, (Landowner) that will provide mitigation in the form of right -of-way
donations and stormwater management for portions of Immokalee Road and Big Cypress Parkway
and the construction of a possible future traffic signal in order to comply with Policy 5.1, the
Transportation Element of the Growth Management Plan as well as providing for an option to
purchase rights-of-way both north and south of the Rivergrass SRA.
OBJECTIVE: For the Landowner to donate right-of-way for the expansion of Immokalee Road and
allow purchase of right-of-way for the future construction of Big Cypress Parkway, and accept
stormwater retention along Immokalee Road and Big Cypress Parkway, along with the design, permitting
and construction of a traffic signal on Oil Well Road at the primary residential entrance to the Village of
Rivergrass, and provide for interconnections in order to comply with the Growt h Management Plan
Transportation Element.
CONSIDERATIONS: On October 28, 2003, the Board of County Commissioners (Board) approved a
Resolution related to the creation of the Big Cypress Stewardship District (Resolution 03 -380). A
requirement of the Resolution and the enabling legislation for the District required the District and Collier
County to enter into an Interlocal Service Delivery Agreement. The Agreement was to provide a fair
share capital construction funding contribution for the long-range traffic capacity improvements of county
arterial and collector roads within and proximate to the District. The Agreement was to be executed
within 90 days of the Act taking effect.
At the October 26, 2004, Board meeting, Agenda Item 10C, the Board entertained the approval of the
Interlocal Service Delivery Agreement with the Big Cypress Stewardship District. In this specific agenda
item, County staff pursued a right-of-way reservation for a “bypass” road between Oil Well Road to
Randall Boulevard, among other right-of-way reservations. It was acknowledged during the meeting by
both the County and representatives of Collier Enterprises, that there was disagreement as it related to the
“bypass” road. During the meeting, Tom Conrecode, representing Collier Enterprises stated, “We
understand the constraints at Oil Well and Immokalee Road. We understand how they need to be
addressed and aligned with the needs of Randall. It’s just not appropriate to be in this agreement. …Now,
the County will have plenty of opportunities to do that in the future. We’re not doing anything with the
land but farming it today. At some point in the future when we come back with a zoning action before
this county commission, staff will have the opportunity again to go after th at road and many, many more
to serve the needs of the area.” Mr. Conrecode went on to say, “What we haven’t been able to agree on is
the connection between Randall and Oil Well Road. The reason is, is that nobody has been able to study
it….If we take the time and agree to work together, work on a solution that solves that interconnection,
we’re going to come up with a better solution that serves all the transportation public in Collier County.”
Mr. Conrecode finished by stating, “The appropriate time is when there’s a zoning change requested of
the county. The county has all the power and the authority; that’s the appropriate time to enter into this.
And we’re willing to work with the county and talk with the county on that and many other corridors that
the county puts into its long-range plan. We’ve identified many of those.” The Board approved the
Agreement with staff’s proposed language; however, the District did not act on it. Ultimately, the District
did enter in a Land Donation Agreement with the County as it pertains to Oil Well Road, but not the
remaining items.
In 2016, Collier County began the Randall Boulevard and Oil Well Road Corridor Study. This study
evaluated several corridor alternatives to enhance traffic operations and safety conditions based on current

and future travel demands. While the County was studying the corridor, the Collier Metropolitan
Planning Organization adopted an amendment (May 25, 2018) to the 2040 Long Range Transportation
Plan that added a new needed roadway that became known as Big Cypress Parkway between Golden Gate
Boulevard and Immokalee Road. The County continued forward with the Randall Boulevard and Oil
Well Road Corridor Study, which included coordination with Collier Enterprises as it related to their SRA
development at the time (Rural Lands West SRA). In May 2019, the Board adopted Viable Alternative
2+, which included the following improvements:
• Randall Boulevard (8th Street NE to Everglades Boulevard - 6 lanes)
• Randall Boulevard (Everglades Boulevard to Big Cypress Parkway - 4 lanes)
• Oil Well Road (Everglades Boulevard to Oil Well Grade Road - 6 lanes)
• Everglades Boulevard (Randall Boulevard to Oil Well Road - 4 lanes)
• Additional regional roadway needs to enhance access, safety, and mobility:
o Vanderbilt Beach Road (16th Street NE to Big Cypress Parkway)
o Everglades Boulevard (Vanderbilt Beach Road Ext. to Randall Boulevard)
o Big Cypress Parkway (Golden Gate Boulevard to Immokalee Road)
Consistent with the commitments previously made by Collier Enterprises for the Stewardship District,
staff is requiring a right-of-way reservation for Big Cypress Parkway within the limits of the Stewardship
District. This Landowner Agreement is intended to contain the rights -of-way necessary to accommodate
Big Cypress Parkway within the Stewardship District. This reservation is consistent with the Long Range
Transportation Plan, Randall Boulevard and Oil Well Road Corridor Study final alignment network, and
the commitments made to address the regional roadway network at the time of rezoning.
On January 8, 2020, a meeting was held with representatives from Collier Enterprises and County staff
(County Attorney’s Office, County Manager’s Office and Growth Management Department) where a
consensus as it relates to interconnectivity and Big Cypress Parkway right-of-way was developed. Below
is a synopsis of the modifications that have been addressed in the attached landowner contribution
agreement:
• Interconnection
o Provide one interconnection between Rivergrass and Longwater near the Garguilo
Headquarters (near Oil Well Road).
o Rivergrass residents north of Oil Well Road will have access to the Village Center via the
gated portion of Rivergrass south of Oil Well Road once the traffic signal is operational.
The Developer shall be required to install the traffic signal within one year of the first
certificate of occupancy.
• Big Cypress Parkway
o Right-of-way reserved from Immokalee Road to 6th Street SE for a period of 5 years from
the date of the approval of this developer agreement.
o During the five-year reservation period, if the applicant withdraws the petitions, the

reservation would remain. However, if a petition is denied, the applicable right-of-way
reservation would immediately expire.
o Right-of-way from Randall Boulevard to Vanderbilt Beach Road will be offered to the
County for purchase under the same terms as Rivergrass SRA upon the approval of the
Longwater SRA.
o Right-of-way from Vanderbilt Beach Road to 6th Street SE as well as the right-of-way
from Immokalee Road to the Rivergrass SRA northern boundary will be offered to the
County for purchase under the same terms as the Rivergrass SRA upon the approval of
the Bellmar SRA.
Staff's position has been consistent in requesting that the reservation of the complete right of way should
not expire nor should it be conditioned on approval of other developments in the future. These conditions
represent the limits of where the developer was willing to commit to at this time. While staff is
recommending approval, it is important to note that failure to approve the future SRAs, Longwater and
Bellmar, would negate the reservation and force condemnation should the County wish to proceed with
the construction of Big Cypress Parkway.
FISCAL IMPACT: The County will be responsible for impact fee road credits for the right-of-way
conveyance for the Big Cypress Parkway, less the right-of-way necessary for the site related left-turn
lanes on Oil Well Road and Big Cypress Parkway. Transportation impact fee credits will be from Impact
Fee District Five. The County shall incur additional costs for title work, recording, and the purchase of
land, either through impact fee credits or cash. Transportation Planning would make the cash payments
from Impact Fee District five.
LEGAL CONSIDERATIONS: This proposed Agreement was drafted by the County Attorney, is
approved as to form and legality, and requires majority vote for approval. -JAK
GROWTH MANAGEMENT IMPACT: The proposed Agreement will make the Rivergrass Village
consistent with the GMP.
RECOMMENDATION: To approve the Landowner Agreement that will provide mitigation in the form
of right-of-way donations and stormwater management for portions of Immokalee Road and Big Cypress
Parkway, the construction of a traffic signal in order to comply with Policy 5.1, the Transportation
Element of the Growth Management Plan, provide for interconnections as well as providing for an option
to purchase rights-of-way both north and south of the Rivergrass SRA.

notice to tenants and buyers, both residential and commercial, of the
planned roadway improvements with a statement that the County will
not construct any sound wall or other barrier of any kind to reduce the
