DOMESTIC ANIMAL SERVICES ADVISORY BOARD
LET IT BE REMEMBERED, that the Collier County Domestic Animal
Services Advisory Board in and for the County of Collier, having conducted
business herein, met on this date at 6:00 PM in REGTILAR SESSION at
Domestic Animal Services Training Room, Davis Blvd., Naples, Florida, with
the following members present:

IV. Approval of Minutes
Marjorie Bloom made a motion to approve the minutes of the July 16, 2019 meeting,
there was a second and the motion passed 7-0.
V. Director's Report
Darcy Andrade provided statistics from the last vaccine clinic. Ms. Andrade
announced that Domestic Animal Services was awarded a $24,000 grant for
spay/neuter surgeries that should cover 100 female dogs, 75 male dogs and 200
community cats.
Ms. Andrade also reported on the success of the Bite Prevention public meeting that
was held in July by the Field Operations Manager.
Ms. Andrade advised the Board that a temporary marketing position has been
approved. Mr. Rheaume asked if there was a way to track performance of this
position and was advised by Ms. Andrade that it can be tracked through social media
melrics, vaccine clinic attendance and adoption rates.
VI. New Business
A. Retail Sale of Dogs and Cats
Dan Rheaume stated that he had spoken with Michele from Hallandale and that there
is favorable case law in Florida to help prevent sales of puppies from puppy mills. He
stated that it is a public health issue because ofdiseases that are brought in and that
there is currently only one store that sells puppies in Collier County. He also stated that
there is a Board of County Commissioners meeting on September 24, 2019 and that
Michele stated that she would attend and give a presentation.
Mr. Rheaume also stated that he sits on the state legislative committee and would be
able to provide updates on animal issues.
Jim Rich read the relevant ordinance section on breeder permits and advised that he
contacted Florida Puppies Online and asked where their animals come from. He stated
that Petland started in 1967 and promotes spaying and neutering pets but sells unaltered
animals. Mr. Rich stated ftat he would support a county ordinance that bans the sale
ofpuppies and kittens unless they are from a shelter or rescue group.
Darcy Andrade discussed proposed language for an ordinance and stated that the
language has been pulled from existing language in other counties in Florida. she also
stated that Florida Puppies Online has a storefront but is only by appointment.

Sarah Baeckler-Davis confirmed that and stated that she was in favor ofpreventing
retail sales. Kyra Lynch advised that the language provides for a six-month period for
current businesses to close.
Public Speakers
Tom Kepp asked if the proposed language would stop online sales through Craig's List
and other sites and Darcy Andrade read the pertinent part ofthe language. Mr. Kepp
also asked if it outlines enforcement and was advised by Ms. Andrade that it follows
the current enforcement policy.
Mary Lundberg discussed puppy mills and stated that Naples is being used to sell
puppies throughout the country and that consumers are not getting what they
purchased.
Patricia Holley stated that Petland has already leased space in Naples and is due to
open in 60 to 90 days. Ms. Holley recounted an anecdote about someone who
purchased a dog with numerous health concems and discussed the finance and leasing
of dogs. Dan Rheaume stated that it is possible that the incident she described may
rise to the level of consumer fraud with the Attomey General's Office.
Chuck Danielian presented a packet of information to the Board showing complaints
from Florida residents and Humane Society ofthe United States investigations into
Petland.
Kelly Hyland distributed a pet store bill offacts and stated that the issue isn't with
Petland, it is with any pet store. Ms. Hyland asked what could be done to prevent the
store from opening.
Dan Rheaume stated that DAS goes to many public events and maybe DAS could
have a weekly adoption event.
Marjorie Bloom advised that maybe Haverty's would sponsor something.
Ms. Hyland asked Steve Carnell what could be done to prevent the store from
opening and Mr. Carnell advised that there is nothing on the record that would prevent
a store from opening.
Sarah Baeckler-Davis stated that the Advisory Board agrees with the ban and the
Board of county Commissioners is aware of the issue. She advised that people should
be contacting their commissioners.
Dan Rheaume remarked that ifpet stores are banned, it could open the county up to
lawsuits. He advised that everyone is on the same team, but this idea musOOZ+ Ue
pitched to the people that can decide on this.
Sarah Baeckler-Davis made a motion to send the proposed language to the Board of
County Commissioners, there was a second and the motion passed 7-0.

Heidi Liebwein said the Jim Rich brought up spay and neuter and stated that this
would put an increased risk on DAS because pet store animals are more likety to
develop behavior issues and be brought to a shelter.
Dan Rheaume stated that the new marketing position for DAS would promote Adopt,
Don't Shop.
Susie Mehas stated that she likes the ordinance language and she seconded Tom
Kepp's comments about online sales. She also asked Dr. Gordon about reaching out
to local veterinarians.
Dan Rheaume made a motion to close the public comments on this topic, there was a
second and the motion passed 7-0.
VIL OId Business
A. Citation Fee Collection
Kevin Noell, fiom the County Aftomey's Offrce described the process used for citations
and stated that when a violation/citation is issued and not contested, it is sent to
collections. He stated that the new Animal Control Ordinance states that it should be sent
to the Special Magistrate. He advised that there are costs to DAS to record orders and
liens against property and many violators lease, rather than own or are homesteaded. In
order to collect, the Board of County Commissioners would have to vote to foreclose on
the property.
Dan Rheaume asked ifthe property owner could be held accountable for renters and was
advised by Mr. Noell that they cannot because these violations are not against the
property. Mr. Rheaume stated that it seems like a law with no teeth. Mr. Noell advised
that there is always about 10% of the population who do whatever they want to do, but
we still must be good stewards of the county tar dollars and not spend the DAS budget
on this when it could be better spent in diflerent ways. Mr. Noell advised that possible a
lefter sent from the County Attomey's Office stating that you have xx number ofdays to
pay after the Special Magistrate hearing would be helpful.
Public Speakers
Tom Kepp discussed a previous case and asked why the failure to pay can.t be put
against someone's vehicle registration because time spent by the Animal control offrcers
is being wasted going to these problem locations. He also discussed Habitat for
Humanity and how mortgages in that community require people to follow all the rules
and laws.
chuck Danielian asked why wages can't be gamished and was advised that it is cost
prohibitive.
Kelly Hyland asked ifcitations can't be collected, is that also true for businesses?

Susie Mehas stated that a lien can be placed on homestead properties. She also stated
that whatever changed that allowed DAS to take the dogs in the case mentioned by Mr.
Kepp should be done all the time.

Darcy Andrade advised the Board that DAS is taking a different route on the new
facility than what had been planned. Because there are so many permitting issues on the
cunent property, the county is looking to build a new facility at a new location.
Jim Rich made a motion to support a new DAS facility at a new location, there was a
second and the motion passed 7-0.
VIII. Advisory Board Member Comments
Daniel Rheaume stated that he brought in a little dog to DAS and was very impressed
because within minutes, the dog was receiving medication.
Marjorie Bloom stated that she was very excited that DAS would be getting a new
facility. She also stated that social media impact is amazing.
Dr. Gordon said that he appreciates everyone who attended the meeting to voice their
opinion.
Daniel Rheaume made a motion to adjourn, there ttas a second and the motion passed
7-0.

Kevin Noell advised that he will research attaching the unpaid fines to vehicle
registration and advised that the county can't take property without due process.
B. Shelter Update
The next regularly scheduled Advisory Board Meeting will be on Tuesday, November
19,2019 at 6:00 p.m. in the Domestic Animal Training Room, Davis Blvd., Naples,
Florida.

Dan Rheaume introduced the current Standards of Care.
Darcy Andrade provided background on the Standards of Care and several
definitions in the current standards, inctuding Animal Related Business, Animal
Related Organization, Commercial Breeder, Hobby Breeder and pet Dealer.

Mike Gonidakis asked for 'regular inspection' to be defined.
Luis Marquez from Petland asked how often organizations would be inspected.
Darcy Andrade discussed Article 4 which includes proper animal husbandry, state
records requirements and Florida State Statutes.
B. Standards of Care Amendment Discussion
Darcy Andrade posted proposed language on the projector. Language that was
proposed by Petland was shown in blue, language obtained from Palm Beach
County Ordinance was show,n in red. In Article II there was a discussion aboul the
difference between pet shops and pet stores.
Marjorie Bloom recommended mandatory sterilization for retaiI sale animals.
Sarah Baeckler-Davis asked the Chair what the expected end-product would be.
Mr, Rheaume stated that they should be making recommendations for future
ordinances. Darcy Andrade reminded the Board that they cannot make motions
or vote on an).thing during a Workshop Session.
Mr. Marquez asked if there is a cap on the 30-day provisional permit. Ms.
Andrade advised that they can grant further extensions based on circumstance.
Terry Miller from Petland asked ilthere is a specified penalty and was advised by
Ms. Andrade that the penalty is specified in the fee policy.
Mike Gonidakis inquired about major vs. minor violations and if they count once
completed and was advised that that the violation tums into a citation if
compliance is not achieved.
Ms. Baeckler-Davis inquired about access for exercise and space. Ms. Andrade
made a note to include that. Mr. Marquez asked for details on that and was
advised by Ms. Baeckler-Davis that the USDA has minimum requirements.
A discussion was held regarding temperature limits and Ms. Baeckler Davis
suggested a high-end temperatue of 80". Ms. Andrade advised that the current
high-end temperature is 85 ".
Mary Baker asked if the wording could be changed to require that a local county
Veterinarian must be used. Darcy Andrade responded she didn't know ifthat
would be possible.
Luis Marquez agreed that pet stores and pet shops could offer animals from local
rescue organizations for adoption.
Sara Baeckler-Davis asked for clarification on ,other source, ofacquiring
animals. Stated that they offer 'donations' for the transfers that come in from out
of state from other animal related organizations. Jim Rich stated that he doesn't

believe that it is an issue to pay transport fees for animal related organizations.
Ms. Andrade and Ms. Baeckler-Davis stated that they would explore it further.
Mike Gonidakis requested proposed language to hold the licensed vet responsible
for their own violations.
Luis Marquez discussed intemational importation as a growing concem to animal
welfare. Sara Baeckler-Davis advised that there are federal laws that govem this
and including it is redundant.
Mike Gonidakis wanted to know the timeline to review the proposed language
and was advised by Darcy Andrade that it is dependent on what is decided, but
may be ready by January.
Mike Gonidakis asked if electronic records are permitted and was advised that
they are. Sara Baeckler-Davis requested that pet stores be required to maintain
unredacted records.
There was a discussion about the source ofthe adoptable animals in pe1 stores and
the requirement that the informatin be posted on the kennels. Ms. Andrade
reminded everyone that these are only suggestions and she was asked to obtain
photos of the cage cards from Palm Beach County She was also asked to look at
Miami Dade.
Darcy Andrade addressed the request that a local Veterinarian be required.
Jeffrey Klatzkow advised that he would research it. Mr. Klatzkow also advised
that changes were becoming too broad and that they need to be limited to the topic
of regulating pet stores.
Marjorie Bloom recommended mandatory spay/neuter for all cats and dogs that
are sold. JC Planas stated that the Petland agreement specifies that animals are
not to be used for breeding. Luis Marquez offered to provide a voucher so that
clients could have animals spayed/neutered at Domestic Animal Services. Sara
Baeckler-Davis recommended requiring sterilization prior to sale. Dr. Gordon
mentioned that it is not always advisable on animals that young but mentioned the
possibility of taking deposits. Darcy Andrade stated that she would research that
Dan Rheaume asked Luis Marquez about the success of their agreement. And
was advised it is approx. 50%.
Ms. Baeckler-Davis commented that the state has already estabtished the intent to
require all adopted animals to be sterilized. JC Planas stated that people have the
right to have puppies.
Ed Sayers stated that he agreed with Dr, Gordon and that the pet store is for pets,
not for working animals. Mary Baker agreed that early sterilization is not ideal.
but it is important to sterilize. Luis Marquez stated that he will not sign offon
mandatory sterilization but is willing to pay DAS/HSN to perform sterilization for
his customers. Jim Rich stated that he likes the idea ofthe refundable deposit and

that something should be done, but his experience with voucher programs is that
they don't always work.
JC Planas stated that mandatory spay/neuter should be part ofthe licensing
process and fees, not in the pet store business.
Dan Rheaume asked if Petland has a Veterinarian on staffor if they use local
Veterinarians. Mr. Marquez advised that he franchises, but he personally uses
local Veterinarians.
Darcy Andrade showed proposed language from Humane Society Naples. Sara
Baeckler-I)avis reminded everyone that the Animal Services Advisory Board
(ASAB) unanimously voted to ban pet stores outright, but the Board ofCounty
Commissioners required them to hold this workshop regardless ofthe fact that the
ASAB does not support it in the first place. Ms. Baeckter-Davis stated that she
did some research and recommended that pet stores should only be allowed to
source puppies from breeding facilities that have five (5) breeding females or less.
She also suggested another workshop to continue discussions.
Mary Baker requested that board members receive a copy of the language
proposed by Humane Society Naples. Luis Marquez said that he would not be
able to comply with that requirement because all ofhis breeders have more than
five breeding females.
Sara Baeckler-Davis reminded everyone that the ASAB does not support pet store
in Collier County but understands that the workshop is intended to bring everyone
together to form an agreement.
JC Planas asked where the suggestion for five breeding females or less originated
from and was advised by Sara Baeckler-Davis that it was Cook County, Illinois.
Mr. Klatzkow mentioned that Board of County Commissioners would not
approve changes to the ordinance without agreement from all parties. Luis
Marquez stated that there are 57 breeders thal he uses and that they all have more
than five breeding females. He also advised that the Board members are welcome
to visit and inspect the breeding facilities.
Dan Rheaume asked about transparency and customer mutual release and ifnon-
disclosures are required for any settlements that are made. JC planas stated that
they have settlements once or lwice a month, but only recalled one time have they
requested a non-disclosure.

Jim Sparfz stated that he would like to see compromise and Marjorie Bloom
agreed. Mary Baker also agreed to compromise and expressed interest in a
second workshop.

VII. Public Comment
Chuck Danielian stated he doesn't agree with Mr. Planas, he has met several people
who stated that they signed non-disclosure agreements and won't come to meetings
because they are afraid. He stated that Collier County should be innovative and any
sterilization deposit should be a percentage ofthe purchase price ofthe pet.
Kelly Hyland asked about when there would be another workshop. She would like to
review everything from this meeting and prepare for the next. She stated that she is
concerned about lack ofregulation on the origin ofthe dogs and she asked ifthere is an
overall limit on the lotal number of dogs coming into the store.
Mary Baker commented that the number is limited by the Standards of Care.
Ms. Hyland read from the CDC repo( dared 12117119 which included information
about campylobacter.

Hobby Breeder means any person who intentionally or unintentionally causes or allows the breeding
or studding of one (1 ) or more domestic cat(s) or dog(s), producing one (1) to two (2) lifters per household
or premises per a one-year period, excepting service dog organizalions that are members of Assistance
Dogs lnternational.
Pet dealer shall mean any person who, in commerce, for compensation or profit engages in the sale
of a dog(s) or cat(s) for use as a pet but who does not engage in breeding dogs or cats. This definition
excludes humane societies, private nonprofit animal organizations, animal rescue organizations and animal
shelters.

Sec. 14-28. - Definitions.
The following words, terms and phrases, when used in this Ordinance, shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different meaning:
Animal-related businsss means any for-profit person or business required to hold a business tax
receipl that renders services to, for or by any domeslic animal, excepting commercial agricultural operations
and the offices or practices of State-certified and licensed veterinarians. Examples of animaFrelated
businesses include, but are not limited to, boarding facilities, doggie day cares, groomers, pet shops, pg!
stores. pefting zoos, pony rides, stables, and training fadl+tios.
Animal-related organization means any not-for-profit entity that maintains premises for the purpose of
rendering services to, for or by any domestic animal. Examples of animal-related organizations include, but
are not limited to, rescues that maintain premises as a central location for their activities, sanctuaries,
Rescue Orqanization. Animal Rescue Group, service dog organizations and animal shelters.
Cat means an animal of anv aoe that is a member of Felis Catus, or anv oenetic hvbridization of this
species. not under the iurisdiction of the state ,ish and wildlife conservation commission.
Commercial Breeder means any person or business required to hold a business tax receipt who
engages in the sale allfor intentional or unintentional breeding of three (3) or more litlers of dogs or cats,
per a one-year period or offers one (1) or more domestic cat(s) or dog(s) for breeding or slud purposes,
producing three (3) or more litters per year, excepting service dog organizations that are members of
Assistance Dogs lntemational. Commercial breeders are subject to agricultural zoning requirements of the
Land Developmenl Code.
Ooo means an animal of anv aoe that is a member of Canis Lupus Familiaris. or anv oenetic
hvbridization of this species. not under the iurisdiction of the state fish and wildlife conservation
commission.
collier county Animal control ordinance chapter 14, Article ll - language that pertains to chapter 14,
Article lV - Standards of Care Ordinance
Premises means the principle place of operation for all animal-related businesses, animal-related
organizations, commercial and hobby breeders, and rodeos, specifically where animals are housed on a
day-to-day basis.
Proper Enclosure for primary means of confinement for dogs means an enclosed or locked pen or
structure, designed to prevent the animalfrom escaping. Such pen or slructure shall be a structurally sound
enclosure, made of materials impervious to moisture and shall also provide protection from injury and the
elemenls. The square footage of a proper enclosure used as a primary means of confinement for a dog
must be equal to or greater than the length of the animal from the tip of the nose to the base of the tail,
doubled, then squared, and divided by 144. For example, a dog measuring 30 inches from the tip of the
nose to the base ofthe tail will require a 25 square foot enclosure (30 x 2 = 60; 60 x 60 = 3,600; 3,600/144
= 25). The height of the enclosure shall be equal to or greater than the length of the animal from the tip of
the nose to the base of the tail multiplied by 1.5.
Rescue Organization, Animal Rescue Group, Animalrelated organization shall mean a duly
incorporated non-profit organization that has tax exempt status in accordance with Section 501(c)(3) of the
United States lntemal Revenue Code, founded or chartered with the primary mission being the welfare,
care, and adoption/placement of stray, abandoned, or sunendered animals, and which does not breed dogs
or cats or obtain these animals for any form of payment or compensation from any source other than an
animal shelter. Such organizations make pets available on a cosl-recovery basis and/or foster animals or
enlist others to foster animals.
Standards of Care refers to a set of rules and regulations governing the care and feeding of animals
maintained in or by animal-related businesses, animal-related organizations, commercial breeders, hobby

2. The Director is hereby granted authority to recommend Standards of Care for animal-related
businesses, animal-related organizations, commercial breeders, hobby breeders, and rodeos for
approval by the Board of County Commissioners. Standards of Care shall be approved by ordinance
of the Board and then codiried in the Collier County Administrative Code. As set forth below, a violation
of an approved Standards of Care shall be deemed to be a violation of this Ordinance.
3. The owner or operator of any animaFrelated business, animal-related organization, commercial
breeders, hobby breeders, or rodeo shall properly feed and care for each animal in their custody or
control and otherwise meet all relevant Standards of Care.
4. The Director shall inspect the premises of any animal-related business and any animal-related
organization on an annual basis. The Director shall inspect the premises of any rodeo prior to or within
twenty-four (24) hours of the commencement of that event. The Director will inspect the premises of

Refusal lo allow the Director to inspecl any premises, animal, or records associated with any animal-
related business, organization or rodeo, or any breeding operation, shall constitute a violation of this
Ordinance.
Should the inspection reveal a violation of this Ordinance or the relevant Standards of Care, a Notice
to Comply will be issued. The Notice to Comply shall specify the violation and shall contain a time
period not to exceed 15 days to enable the violator to come into compliance. The premises shall be
re-inspected promptly following the time period specified by the Notice to Comply. Failure to correct
the violation shall result in the issuance of a citation.

8. Every person or organization who sponsors or operates a rodeo shall, at least thirty (30) days prior to
the date of the event, make application to the Director for a permit to operate. The fee for such
application and permit shall be established and revised by resolutions of the Board of County
Commissioners. The Oirector shall issue a rodeo permit after receipt of this fee and inspection of the
event premises if he determines that the event will meet the established Standards of Care. That permit
shall be displayed at the event at a place where it is clearly visible to the public.
9. Commercial and hobby breeders must obtain the applicable breeder permit from the Director. A fee
will be charged for the permit. Permit fees shall be established and revised by resolulions of the Board
of County Commissioners. The Director shall issue the applicable breeder permit after receipt of this
fee and inspection of the breeder's premises if he determines that the breeder meets the established
Standards of Care. A breeder permit is valid for one (1) calendar year from date of issue nl

and convicted of charges of animal cruelty under any jurisdiction. Such automatic denial shall extend
to corporations, companies, partnerships, joint ventures, professional groups or associations which
include a person so described.
12. Animal-related organizations in good standing with animal services as contemplated herein and
rescue organizations qualified to adopt animals from animal services that are housing cats and dogs
days prior to expiration of the permit. Permits are not transferable or refundable. The Board shall bv

The purpose of this Ordinance is to create the Standards of Care authorized by Section Twelve of the
Collier County Animal Control Ordinance. This Ordinance is expressly limited to animal-related businesses,
animal-related organizations, commercial breeders, nen-eernme+eC hobbv breeders, and rodeos and is to
be read in conjunction with the Collier County Animal Control Ordinance.

Sec. '14-77 . General Standards of Care.
Anyone who owns or maintains an animal-related business, animal-related organization, commercial
breeder, Eg!:99!EEgfqe[ hobbv breeder, or rodeo must provide thal animal:
1. Freedom from hunger or thirst by ready access to fresh water and a diet to maintain full health
and vigor;
2. Freedom from discomfort by providing an appropriate environment including shelter and a
comfortable resting area;
3. Freedom from pain, injury or disease by prevention or rapid diagnosis and treatment;
4. Freedom to express normal behavior by providing sufficient space, proper facilities and company
of the animal's own kind: and
5. Freedom from fear and distress by ensuring conditions and treatment which avoid mental
suffering.

Sec. 14-78. Proper Animal Husbandry.
Anyone who owns or maintains an animal-related business, animal-related organization, commercial
breeder, €€n-€emm€rcial hobbv breeder, or rodeo must exercise properAnimal Husbandry, which includes

L Animal enclosures must be safe, sanitary, dry, and must protect the animals from the elements.
2. Temporarv Aanimal enclosures for housinq animals less than twelve (12) hours, shall be large
enough for each animal contained therein to stand up, sit down, lie down, and turn around
simultaneously.
3. Where an enclosure is used sequentially for more than one animal during the course of a day,
the enclosure will be cleaned, sanitized and dried between each animal.
4. Airline{ype containers normally used for shipping and transporting animals shall not be used to
permanently house animals.
5. Where animals are incompatible, they shall be contained separately in appropriate enclosures.
6. Housing facilities for animals must be clean and sufficiently ventilated at all times when animals
are present to provide for their health, comfort and welFbeing.
7. Housing facilities for animals must be sufficiently heated and cooled when necessary to protect
the animals from cold and hot temperatures and to provide for their health, comfort and well-
being.

Food storage containers shall be clearly and properly labeled as to contents.
13. Any poisonous plants growing in or near where herbivorous animals are being housed should be
removed.
14. All chemicals, pesticides, cleanang solutions and disinfectants shall be stored and used in
accordance with manufacturers' instructions, properly labeled as to content and kept away from
contact with animals and animal food.
15. All animal feces shall be removed and disposed of properly. Livestock manure which has been
removed from animal enclosures shall be maintained the maximum feasible distancefrom animal
housing. Animal feces shall not be allowed to contaminate surrounding waters.
16. Food dishes and water bowls shall be cleaned daily.
17. When communal feeding containers are used, there shall be sufficient space to feed all the
animals simultaneously.

'18. Animals shall be provided with food of sufficient quantity and quality to allow for normal growth
and maintenance of a healthy body weight.
'19. Fresh water shall be available to all animals daily and shall be maintained in a container in such
a manner that animals cannot turn the container over.
20. Food and water shall be fresh, appropriate for the animal, and free from contamination.
21. Animals must be given exercise appropriate for their species, breed, and size.
22. The responsible party must follow veterinary instructions for any sick or injured animal. Proof of
adequate, timely veterinary care and follow-up must be provided to animalservices upon request.
23. Animals having a known or suspected communicable animaFto-human disease shall be
maintained in isolation where they cannot directly or indirectly come into contacl with any other
animals or the public. Applicable county and state health regulations must be followed when
caring for any animal harboring an animal-to-human disease.
24. Any animal that cannot stand on its own or that has a life{hreatening disease must be
hospitalized, housed under the direction of a licensed veterinarian or humanely euthanized in
accordance with F.S. S 828.058.
25. Animals shall not be worked in a sick, diseased or injured condition.
26. Animals shall not be abused, mistreated, tormented or in any manner made to suffer by any
person or any means.
27. Any enclosure used as a primary means of confinement for a dog must meet the definition of
proper enclosure as defined in the Collier County Animal Control Ordinance.

Sec. '14-79. Regulations for Animal-Related Businesses and Organizations.
A. Postng of Pemit. Each animal-related business and organization will prominently display a current,
valid county animal services-issued operalional permit.
B. Safefy.
L Each anamal-related business and organization which accepts privately owned animals into its
custody shall report to animal services any obvious case of neglect or animal abuse pursuant to
the Collier County Animal Conkol Ordinance, these Standards, or F.S. ch. 828, "Cruelty to
Animals." Animal services' phone number shall be posted in a prominent location.
2. Each animal-related business and organizalion will post emergency contact information tn a
prominent place visible from the exterior of the main entrance to the premises. lf an animal-related
organization is located in a premises used primarily as a residence, this contact information does
not need to be prominently posted, but must be kept current and on file with animal services, the
local law enforcement entity, and the local fire department. This contact shall be available at all
hours in case of emergencies or other enforcement-related matters.
3. Each animal-related business and organization shall have a written disaster plan to address both
immediate and noticed evacuation of all animals in case of an emergency to include a diaoram to
evacuate all anima ls in cas eof a re or other emerqencv or disaster This plan shall be posted in

a prominent location.
Each animal-related business and organization shall have a working telephone available at all
times in case of an emergency. The name of the establishment's veterinarian and the
veterinarian's phone number shall be posted in a prominent locataon.
Each animal-related business and organization shall provide for adequate rodent and insect
control.
C. Records.

4. Where the animaFrelated business and organization has a right of ownership in the animal,
records shall indicate where the animal was obtained.
5. A copy of a current (within the previous twelve months) negative Coggins test (equine infectious
anemia) shall be on record for each equine (except nursing foals). No equine shall be accepted
for board unless a current (within the past twelve months) negative Coggins test record is
produced by the owner.
6. All records as described herein shall be kept for a period of two years.
7. All records shall be made available to the inspecting officer upon request.
8. Animal-related businesses and orqanizations whrch fail to obtain licensed veterinarv care or show
proof of same. for anv sick or iniured animal found in the establishment's custodv mav be charoed

D. Groomers
1. Clippers, combs, brushes and any other equipment shall be sanitized after each animal grooming.
2. Animals shall not be left unattended while tethered to grooming stations.
3. Clean, separate drying towels shall be used for each individual animal groomed.
4. Tepid water must be used for the purpose of washing dogs and cats. Cold water is not acceptable.
5. Grooming bathtubs shall be sanrtized after each animal grooming. Grooming bathtubs shall be
maintained free of mold and mildew.
6. Clippers, dryers, combs, brushes and any other grooming equipment shall be maintained in good
repair so that they are appropriale for the intended safe use per the manufacturers' or suppliers'
instructions.
E. Long-tem Nonresidential (lnstitutional) Housing of Dogs.
'1. Dogs maintained in a nonresidential setting for a period longer than three months shall be
afforded protective measures. The responsible party shall notify animal services regarding all
dogs maintained in a nonresidential setting for longer than three months and shall comply with
the following requirements:
a. A veterinarian will examine the animal once every six months. Dogs not maintained on a
heartworm preventative program shall be given an occult heartworm test and started on
preventative or treated for same.
b. A professional behaviorist or trainer will evaluate the animal once every three months and
recommend a behavioral enrichment program.
c. The dog will receive a minimum of fifty minutes of play, interaction, grooming and/or training
each week or the care stipulated by the recommended behavioral enrichment program,
whichever is more stringent. Dogs with medical conditions prohibiting play or training

For the purDose of this section. the word doq means a dog of any aqe and the word cat means

Failure to obtain adeouate, timelv care from a licensed veterinarian for anv diseased or iniured
animal found in the custodv of anv establishment shall be a violation of this chapter and/or Florida
Statutes Ch. 828. "Crueltv to Animals". Proof of adeouate and timelv veterinarv care must be
provided to the Division uoon request.
All animals that show sions or svmptoms of iniurv, contaoious or infectious disease shall be seen
bv a veterinarian within twentv-four (24) hours and at least one (1) other time orior to beinq sold
to certifv that thev are free from rllness or iniurv.
All animals other than doos and cats (i.e.. rabbits, oerbils, hamsters. ouinea pios, all other rodents.

The examining veterinarian's license number.
The examining veterinarian's signature.
The age, breed, sex, color and any distinguishing marks of the animal.
The heatth record of the animal.
Any tests performed and their results, and any vaccinations or olher treatments
administered, including vaccine type, lot number, expiration date, and date of administration,
including those not specifically enumerated below.
A statement that the examining veterinarian wanants, to the best of his knowledge, that the
dog or cat has no sign of contagious or infectious diseases and has no evidence of internal
or external parasites, including coccidiosis and ear mites, but excluding fleas and ticks.
A statement concerning whether or not the examining veterinarian has detected any physical
abnormalilies in the dog or cat, including bul not limited to a heart murmur, and umbilical
hernia, entropian, and inguinal hernia, and cryptorchidism.
Contain the printed or typed names and addresses of the person or business from whom the
doo or cat was obtained. the consionor or seller. the consionee or ourchaser, and the
examininq veterinarian.
i. Be completed in a leqible manner
The OCVI must document that the following inoculations, tests, and treatments have been
administered, unless the veterinarian certifies on the OCVI that to inoculate or deworm the animal
is not in the best medical interest of the animal, in which case the vaccine or anthelmintic may
not be administered to that particular animal:

i. Vaccination against canine distemper, leptospirosis, bordetella, paraanfluenza,
hepatitis, and canine parvovirus. A rabies inoculation must be provided for any dog over
three months of age.
ii. Diagnostic tests to detect the following internal parasites: hookworms, roundworms,
whipworms, tapeworms, coccidia and giardia. Heartworm detection must occur for dogs
six months of age or older. Appropriate treatment for all positive findings must be
documented.
b. For cats or kittens:
i. Vaccination against panleukopenia, feline viral rhino tracheitis, and calici virus. A rabies
inoculation must be provided for any cat over three months of age.
ii. Diagnostic tests to detect the following internal parasites: hookworms, roundworms,
tapeworms and coccidia. Appropriate treatment for all positive findings must be
documented.
iii. Diagnostic test to detect Feline Leukemia with the result listed on the OCVI.
lf the animal is less than four months of age, the tests, vaccines, and anthelmintics required above
must be administered no more than twenty-one days before sale within the county. lf the animal
is four months of age or older, the tests, vaccanes, and anthelmintics required above must be
administered at or after three months of age, but no more than one year before sale sell. trade

7. The sale, sell. trade. receive anv compensation of the dog, cat, puppy, or kitten shall take place
no more than thirty days after the OCVI has been issued.
8. lf a dog, cat, puppy, or kitten is not sold within thirty days of the issuance of the OCVI, then a new

It shall be a violation of this chapter to falsifv anv information orovided in anv OCVI.
All doos and cats otfered for sale and copies of OCVI'S held bv a oet shop. pet dealer or veterinarian
are subiect to inspection bv anv aoent of the Division. the Deoartment of Aoriculture and Consumer
Services, any aoent of the United States Deoartment of Aoriculture. anv law enforcement officer. or
anv aoent apoointed under Florida Statutes q 828.03.

C. Records.
2. Pet shops shall maintain records of each animal acquired for sale. Such records shall include the
name af,d address, telephone number. and email address of the source of the anim al, the
animal's date of birth, and date the animal was received for three vears followinq the date of
acoursition.
3. Pet shops shall maintain a separate record of each animal sold or otherwise conveved, containing
the breed, sex, color, and identifying marks of the animal; all OCVIs and medical records for each
animal; the name and address of the purchaser or new owner; and the number of the microchip
implanted in the animal. lf the disposition of the animal is not through sale, the records shall
indicate the type and date of disposition, including the name and address ot any subsequent
owner, if one exists.

the health of the doo or cat at the time of sale or is likelv to adverselv affect the health of the doq
or cat in the future.
4. lf a dog or cat dies while in the possession of a pet shop, the pet shop-shall secure the services
of a licensed velerinarian to determine the cause of death or suspected cause of dealh. The
veterinarian shall document the date of death and known or suspected cause of death on an
OCVI or death certificate.
5. Records indicating the disposition of all animals shall be forwarded to animal services on a qEEEU
monthlv basis bv the fifteenth of the month for each doq and cat sold. disposed of or that died
durino the previous month:

E. Pet Lemon Law.
A doo or cat that is ourchased from a pet shoo or pet dealer shall be considered unfit for ourchase
if anv of the followino apolv:
Within fourteen (14) davs followino the sale of a doo or cat bv a pet shop or oet dealer a licensed
veterinarian of the purchaser's choosino cerlifies that. at the time of the sale. the doo or cat was
unfit for purchase due to illness or disease. the Dresence of svmotoms of a contaoious or infectious
disease. or the presence of internal or external oarasites. excludino fleas and ticks.
Within one (1) vear followinq the sale of a doo or cat. a licensed vetennarian of the Durchaser's
choosino certifies such doo or cal to be unfit for Durchase due to a conoenital or hereditary disorder
that adverselv atfects the health of the doo or cat.
Within one (1) vear followinq the sale of a doo or cat. the breed. sex. or health of such doo or cat
is found to have been misrepresented.
lf a doo or cat is unfit for ourchase for anv of the above-cited reasons, the oet shop or oel dealer
shall afford the ourchaser the rioht to choose the followinq options:

tax, and reimbursement for reasonable veterinarv costs directlv related to the veterinarian's

Reimbursement for veterinarv costs mav not exceed the ourchase orice of the doo or cat. The cost
of veterinary services is reasonable if comoarable to the cost of similar services rendered bv other
licensed veterinarians in proximitv to the treatino veterinarian and the services rendered are
agpropriate for the certification bv the veterinarian.
The refund or exchanoe reouired bv this chapter shall be made bv the oet shoo or pet dealer not
later than ten (10) buslness davs followino receiot of a siqned veterinarv certification as required in
this chaoter. The purchaser must notifv the pet shop or oet dealer within a reasonable time after
the veterinarian's determination that the animal is unfit and must orovide the oet shop or oet dealer
not later than 3 business davs followinq receipt thereof bv the consumer.
A doo or cat mav not be determined unfit for sale on account of an iniurv sustained or illness
contracted after the ourchaser takes Dossession of the doo or cat. A veterinarv findino of intestinal
or external parasites is not qrounds for declarino a doo or cat unfit for sale unless the doq or cat as
clinicallv ill because of that condition.
lf a oet shoD or Det dealer wishes to contest a demand for veterinarv exDenses. refund. or exchanqe
made bv a Durchaser under this section. the Det shop or oet dealer mav require the Durchaser to
Droduce the doo or cat at a mutuallv aoreed upon time and olace for examination bv a licensed
veterinarian desaonated bv the oet shoD or Det dealer. Upon such examination. if the purchaser and
the oet shoo or pet dealer are unable to reach an aoreement that constitutes one (1) of the oDtions
set forth in this chaoter within ten (10) business davs followino examination bv the pet shoo or pet

aoreement to waive anv of the riohts provided bv this chaDter. Anv contract or aoreement in which
a ourchaser aarees to waive anv riqhts provided under this chapter shall be null and void and
unenforceable.
This chapter does not in anv wav limit the riohts or remedies that are otherwise available to a
Durchaser under anv other law.
1. All pet shops must comply with any applicable provisions of F.S. S 828.29 Dogs and cats
transported or offered for sale; health requirements; consumer guarantee. Where any conflict
exists between these standards and this section, the more restrictive shall apply.
No pet shoo or Det dealer shall reouire the Durchaser of a doo or cat to use the oet shoD's
veterinarian in order to receive a refund or exchanqe reouired bv this chaoter.
lf a purchaser reouests a refund or requests to return or exchanoe a doq or cat pursuant to this
chapter, each oet shop and pet dealer shall maintain all records related to the Durchaser's reouesl
for a Deriod of two (2) vears from receiot of such records and shall provide a coov of the
ourchaser's request to the Division in the monlhlv disDosition report.
2. This section does not in any way limit the rights or remedies that are otherwise available to a
consumer under any other law.
Additional Housino reouirements
Pet shops must provide each of the followinq:
a. Floorino of orimarv enclosures for doos. cats. ouppies. and kittens that is constructed of a solid
surface or rubberized or coated material (e.o., Tenderfoot) to offer proper health and cleantno
orocedures. Ex. No wire or material that can affect the animal's feet.
b. An insolation enclosure with seoarate ventilation that allows a doo. cat. ouppv. or kitten to be
kept seoaralelv from other animals. while under veterinarian-directed observation.
c. Climate controls that ensure temoeratures in animal enclosures are keot between 67 to 78
deorees at all times. Pet shoos must keep dailv loos of temperatures in animal enclosures. lf. for
whatever reason. temperatures fall oulside the required ranoe, a corrective action detailino steos
taken to adiust temperatures must be kept.
d. A Florida licensed veterinarian that visits the oet shop at least three times a week to check on
the health and overall well-beino of the animals.
e. A doo trainer that visits the pet shoo at least once a week to assist with anv behavioral or traininq
issues.
f. Socialization and enrichment of puopies at least two times a dav for thirlv minutes each. and a
loq must be kept of the dailv activities per oupov.
Animals havino a known or susDected communicable animal-to-human or animal-to-animal disease
shall be maintained in individual caoes in an isolated location where thev cannot directlv or
indirectlv come into contact with other animals or the public.
State and Countv heatth requlations must be followed when carino for anv animal harborino an
anrmal-to-human disease.

Sec. 14-80. Regulations for Rodeos.
A. Posting of Permit. The operator of a rodeo will prominently display a current, valid county animal
services-issued operational pelmit.
B. Safety.
1. The operalor of a rodeo shall report to animal services any obvious case of neglect or animal
abuse pursuant to the Collier County Animal Control Ordinance, these Standards, or F.S. ch. 828,
"Cruelty to Animals." Animal services' phone number shall be posted in a prominent location.
2. The operator of a rodeo event shall meet all fire safety requirements in accordance with the local
fire and zoning regulations.
3. The operalor of a rodeo shall have a written emergency plan to address, as is necessary,
inclement weather, velerinary medical emergencies, attendee safety, and crowd control. This
plan shall be posted in a prominent location.
C. Public Awareness. The operator of a rodeo event shall make available to attendees literature to be
provided by animal services outlining the provisions of the Collier County Animal Control Ordinance.
O. Rodeo Regulations.
1. The opentor of a rodeo shall provide animal sevices with:
a. A diagram of the arena, showing location of the chutes, catch chutes, and pens; a list of all
proposed events and acts; and a copy of the rules and regulations which will govern the
conduct of the contestants and events;
b. The name and contact information of a veterinarian who will be available for all shows; and
c. Evidence of testing for infectious equine anemia within the previous immediate twelve (12)
months, Wth negative results for all equine.
2. The operator of a rodeo shall ensure that:
a. A licensed veterinarian shall be available for all shows.
b. An ambulance and medical attendants shall be available on the grounds for emergency
purposes;
c. Any tack, equipment, device, substance or material that is injurious or could cause
unnecessary cruelty is prohibited;
d. All stock is strong, healthy, and physically sound in order to perform in the assigned events;
e. Chutes are so constructed as to prevent injury to the stock, and that the arena is free of
rocks, holes, and all obstacles vvhich could cause injury to animals or contestants;
f. All flank straps and equipment is removed from stock in catch chutes as soon as possible
and that injured animals remain in the catch chute until examined and released by the
attending veterinarian; and

F. Exemptions. Animal services, humane societies, and 501(c)3 rescue organizations shall be
exempt from the provisions of this section.

a. For dogs or puppies:
i. Vaccination against canine distemper, leptospirosis, bordetella, parainfluenza,
hepatitis, and canine parvovirus. A rabies inoculation must be provided for any dog over
three months of age.
ii. Diagnostic tests to detect the following internal parasites: hookworms, roundworms,
whipworms, tapeworms, coccidia and giardia. Heartworm detection must occur for dogs
six months of age or older. Appropriate treatment for all positive findings must be
documented.
b. For cats or kittens:
i. Vaccination against panleukopenia, feline viral rhino tracheitis, and calici virus. A rabies
inoculation must be provided for any cat over three months of age.
ii. Diagnostic tests to detect the following internal parasites: hookworms, roundworms,
tapeworms and coccidia. Appropriate trealment for all positive flndings must be
documented-
iii. Diagnostic test to detect Feline Leukemia with the resutt listed on the OCVI.

consumer guarantee.
2. The above information must be provided to prospective purchasers upon request.
E. Pet Lemon Law.
'1. All breeders a6d+€t-€h€p8 must comply with any applicable provisions of F.S. g 828.29 Dogs
and cats transported or offered for sale; health requirements; consumer guarantee. Where any
conflict exists between these standards and this section, the more restrictive shall apply.
2. This section does not in any way limit the rights or remedies that are otherwise available to a
consumer under any other law.
F . Exemptions. Animal services, humane societies, and 501(c)3 rescue organizations shall be
exempt from the provisions of this section.

Failure to abide by this Ordinance may result in penafties as set forth in Section Thirteen of the Collier
County Animal Control Ordinance (S_LLgg herein) or denial, revocation, or suspension of an entity,s
County-issued license as provided in Section Twelve of the Collier CountyAnimal Control Ordinance (S 14-
37 herein). Anyone who receives a citataon, has been denied a permit or whose permit has been revoked
or suspended may appeal this action in a court of competent jurisdiction within thirty calendar days from
the date of notice.

Section 17-804
b. No pet shop shall release to a consumer a dog or cat that has not been sterilized by a licensed
veterinarian; provided, however, that such requirement shall not apply to a consumer who presents to
the pet shop a letter from such consumer's licensed veterinarian, dated within the immediately
preceding ten days, stating the reason(s) why, in the opinion of such veterinarian, such dog or cat should
not be sterilized until a later specified date, not to exceed four months following the date of such letter.
Such letter shall state that such veterinarian will cause such dog or cat to be sterilized at the request of
such consumer on or before such later specified date. Such veterinarian shall also provide to the pet
shop a certificate, in such form and manner as determined by rules promulgated by the department,
stating the date on which such sterilization was performed. Any consumer who provides a pet shop with
a letter with respect to a later sterilization of a dog or cat must ensure that such animal is sterilized by
the date indicated in the letter.
c. Every pet shop, in accordance with rules promulgated by the department, shall maintain records of
dog and cat sales, sterilization procedures performed at the request ofthe pet shop, and veterinarian
letters and certificates received, and shall retain such records, letters and certificates for a period of two
years. Such records, letters and certificates shall be made available to the department according to rules
promulgated by the department.

Sec. 5-10.1. - Prohibition of pet leasing and pet-collateral transactions.
(b) No contract for the sale or transfer of a dog or a cat or the financing of such sale or transfer shall
include any provision that authorizes the use of a dog or a cat as collateral, by which such dog or cat
may be repossessed if the purchaser defaults under such contract. Any such contract or financing
arrangement entered into after the effective date of the ordinance [from which this section derivesl
shall be void as against public policy, and the person who took possession of the dog or cat under such a
contract shall be deemed to remain the legal owner of the doB or cat regardless of any default.
(c) Any seller or transferor of animals who violates the provisions of this section shall be subject to a civil
penalty. Each prohibited transaction shall subject the violator to a separate civil penalty.
(a) ltshall be unlawfulto leaseadogorcat. Anysuch contract entered into afterthe effective dateof
the ordinance [from which this section derives] shall be void as against public policy, and the person
who took possession of the dog or cat under such a contract shall be deemed the legal owner of the dog
or cat.
(d) Nothing in this section shall be construed to prohibit:
(1) The purchase of a dog or cat through an unsecured personal loan; or
(2) Adoption or sale contracts involving public or private animal shelters, animal rescue organizations,
pet dealers, breeders, or other persons or entities that provide that animals may be reclaimed because
the adopter or purchaser is not providing appropriate care for the animal or because the animal was lost
or stray and the original owner has b€en located and wishes to reclaim the animal, provided that such
reclamation provisions are clearly set out in the agreement.
(e) Exemptions. This section shall not apply to agreements involving provision of animals for lawful
breeding purposes; lawful use in professional shows and exhibitions; and working purposes, such as
service animals, guard dogs in compliance with Section 5-13.1, or law enforcement dogs.

for sale any dog, cat e++abbit obtained from a breeder unless
the following requirements are met:(i) The breeder holds a valid USDA class "A" license as
defined by the Animal Welfare Act, as found in the Code
of Federal Regulations, listing all site addresses where
regulated animals are located; and(ii) The breeder owns or possesses no more than five
female dogs, cats er+abbits capable of reproduction in
any 12-month period; and
(iii) No more than five female dogs, cats or rabbits capable
of reproduction are housed at the site address where the
retail animal was born or housed, including animals
owned by persons other than the breeder; and
(iv) ln addition to any disclosures required by subsection (c)
or othenruise required by law, the following information
shall be maintained and provided for each animal:
(a) The active USDA license number(s) of the animal's
breeder;
(b) Any previous USDA license number(s) held by the
animal's breeder in the last five years;
(c)The name, mailing and site address location(s) of the
breeder as they appear on the breeder's active USDA
license;
(d) All names the breeder is doing business as;
(e) The total number of female dogs, cats or rabbits
capable of reproduction owned or possessed by breeder;
(f) The sire and dam of the animal;
(g) The name and address of the location where the animal
was born; and
(h) The name(s) and address of any other location(s)
where the animal was housed by the breeder after birth.
