A RESOLUTION OF THE BOARD OF ZONING APPEALS OF COLLIER
COUNTY, FLORIDA, RELATING TO PETITION NUMBER SV-2006-AR-
9160, FOR VARIANCES FOR TWO GROUND SIGNS LOCATED IN THE
RIVERCHASE COMMONS OFFICE PARK LOCATED AT 1001
CROSSPOINTE DRIVE, NAPLES, FLORIDA. THE SIGN LOCATED AT
THE SOUTHWEST ENTRANCE OF THE PROPERTY REQUIRES A
SETBACK VARIANCE FROM 10 FEET TO 4.24 FEET; THE SIGN
LOCATED AT THE SOUTHEAST ENTRANCE REQUIRES A SETBACK
VARIANCE FROM 10 FEET TO 0.15 FEET; WITH BOTH SIGNS
REQUIRING A V ARIANCE FROM SECTION 5.06.03.A.3 OF THE
COLLIER COUNTY LAND DEVELOPMENT CODE, WHICH REQUIRES
ADDRESS RANGES TO BE DISPLAYED ON GROUND SIGNS.
WHEREAS, the Legislature of the State of Florida in Chapter 125, Florida Statutes,
has conferred on all counties in Florida the power to establish, coordinate and enforce zoning
and such business regulations as are necessary for the protection of the public; and
WHEREAS, the County pursuant thereto has adopted a Land Development Code
(Ordinance No. 04-41, as amended) which establishes regulations for the zoning of particular
geographic divisions of the County, among which is the granting of variances; and
WHEREAS, the Board of Zoning Appeals, being the duly elected constituted Board
of the area hereby affected, has held a public hearing after notice as in said regulations made
and provided, and has considered the advisability of granting sign variances for two ground
signs in the Riverchase Commons Office Park located at 1001 Crosspointe Drive, Naples,
Florida. The sign located at the southwest entrance of the property requires a setback variance
from 10 feet to 4.24 feet; the sign located at the southeast entrance requires a setback
variance from 10 feet to 0.15 feet, more particularly shown on the attached Special Purpose
Survey, Exhibit "A". In addition, both signs require a variance from the requirement of
Section 5.06.03.A.3, which requires address ranges to be displayed on the ground signs; and
WHEREAS, the Board has found as a matter of fact that satisfactory provision and
arrangement have been made concerning all applicable matters required by said regulations
and in accordance with Section 9.04.03 of the Zoning Regulations of said Land Development
Code for the unincorporated area of Collier County; and
WHEREAS, all interested parties have been given opportunity to be heard by this
Board in public meeting assembled and the Board having considered all matters presented.

NOW, THEREFORE, BE IT RESOLVED by The Board of Zoning Appeals of
Collier County, Florida, that Petition SV-2006-AR-9160, filed by Richard D. Yovanovich of
Goodlette, Coleman & Johnson, P.A., representing W.R. Development LLC, with respect to
the subject property described as Lots 4,5,6,7, and 8 of Riverchase Commons, according to
the plat thereof, recorded in Plat Book 32, Pages 20-21 of the Public Records of Collier
County, Florida, is hereby approved for variances to the property line setbacks for two
ground signs located in the Riverchase Commons Office Park. The sign located at the
southwest entrance or corner of the property is granted a setback variance from the required
10 feet to 4.24 feet; the sign located at the southeast entrance is granted a setback variance
from 10 feet to 0.15 feet, as more particularly shown on the attached Special Purpose Survey,
Exhibit "A", of the subject property wherein said signs are located, with the following
stipulations:
1. The variance is limited to allow only the two existing ground signs that encroach
into the required yards on the west, south and east sides of the property as
depicted on the applicant's boundary survey, to remain in place;
2. No further encroachments shall be permitted; and
3. The two ground signs shall be required to provide the range of address numbers
of the buildings in the office park, as approved by staff.
BE IT FURTHER RESOLVED that this Resolution relating to Petition Number SV-
2006-AR-9160 be recorded in the minutes of this Board.
