CALL TO ORDER Steve Hruby called the meeting to order at 8:32 a.m. Steve led in in the Pledge of Allegiance, and read the procedures to be followed. 2. ROLL CALL – COMMITTEE MEMBERS AND STAFF There were 7 active members present, therefore a quorum was established. 3. APPROVAL OF AGENDA AND MINUTE 1.A.2 Packet Pg. 12 Attachment: AHAC Meeting Agenda - December 2, 2019 (11105 : Affordable Housing Advisory Committee - December 2, 2019) 2 a. A motion was made to approve the agenda by Mary Waller and seconded by Mary Waller. The motion passed by a vote of 7-0. b. A motion was made by Litha Berger to approve the minutes from the meeting of October 7, 2019 and seconded by Mary Waller. The motion was passed with a vote of 7-0. 4. INFORMATIONAL ITEMS a. Quarterly Apartment List Update – Cormac reviewed the quarterly apartment list with the group. CHS has been keeping this list for a little over 3 years now. New communities are being phased in with more new market rate units available. Mary Waller asked that the list be compared to the previous year. Cormac agreed and said that the next report will show the comparison. The Wells Fargo Opportunity Index put out by the National Home Builders was not done due to changes in the Fanny Mae numbers, may also have had some effect on the numbers. b. Update on Procurement Solicitations 1. Bembridge ITN – The developer agreement went to the BCC on October 22, 2019 and was approved. This included 82 units with housing for 60% of median income, seniors and veterans. 2. Housing/Marketing/Education/Outreach RFP – The contract went to the BCC and was approved. Quest Marketing will be working with us for a year and will attend the AHAC meetings. They will be working on promoting “Yes, in my backyard” (YIMBY) and holding round table meetings with builders, contractors and members of the community. Steve Hruby asked for a regular update to be put on the AHAC agenda. 3. Community Land Trust RFP – The contract with HELP of SWFL was approved by the BCC on October 22, 2019. HELP partners with Legal Aid and the Florida Housing Coalition. 5. PUBLIC COMMENT John Harney addressed the group and asked if the AHAC had an official position on increasing impact fees. 6. DISCUSSION ITEMS a. The county’s grant application will be released on January 4, 2020 and will be open for 5 weeks. The ranking and review committee should include a member of the AHAC. Justin Emens volunteered to serve on the committee. Steve Hruby motioned that Mr. Emens be appointed to the committee, Gary Hains seconded, and the group unanimously voted 7-0 in agreement. b. Cormac reviewed Ordinance 19-22 for the Allura RPUD. He said that Allura will give essential personnel preference to 54 units for 15 years and 31 units will be held for those with 80% of median income restricted for 30 years. This is the first development to meet the housing affordability goals of the Community Housing Plan. AHAC members discussed 1.A.2 Packet Pg. 13 Attachment: AHAC Meeting Agenda - December 2, 2019 (11105 : Affordable Housing Advisory Committee - December 2, 2019) 3 attending upcoming meetings for new projects to voice their position on the need for affordable housing. 7. UPCOMING MEETINGS a. Rivergrass Village will go to the CCPC on November 7th and Courthouse Shadows will have the BCC on Nov 12th. Rivergrass is a development of 2,500 houses and has not committed for any affordable housing yet. Courthouse Shadows is slated for 300 luxury apartments with no consideration for affordable housing. AHAC Members said they would like to be at these meetings to encourage them to include affordable houses. Mary Waller and Litha Berger committed to attend both meetings in support of affordable housing. b. The group talked about the revision of the AHAC ordinance to include more “at large” members from each district and possibly a delegation from the Sheriff and the School Board. c. Cormac was asked to invite the County Manager to the next meeting of the AHAC to discuss an overview of the items he talked about regarding the golf course property and other projects. He will also ask him to provide the PowerPoint about the sports park. Nick Casalanguida will attend the meeting in either December or January. 8. ADJOURN a. The period of time the rental unit will be reserved and advertised for ESP persons will be a minimum of 60 days from the date the unit is first advertised and 45 days thereafter when a unit becomes available. If an ESP renter is not committed to a lease within the initial 60, or subsequent 45-day period, the unit may be offered for rent to a non-ESP renter. Throughout the last four (4) years the AHAC and the Board appointed Housing Stakeholders committee spent countless hours researching, drafting, and implementing the Community Housing Plan which was accepted by the Board in October 2017. AHAC and the Stakeholders recognize the need for housing that is affordable for a wide range of county residents both in the present and in the future as our community continues to grow and develop. The BCC adopted the Housing Demand Model, which is updated annually, as an indicator of the current and future needs of housing that is affordable. In addition to future growth of an expanding workforce, our community also recognizes the need to address housing for seniors, veterans, and other special needs populations. Throughout the 2017 Community Housing Plan (CHP), statistics demonstrate the numbers of households that are cost burdened and severely cost-burdened within Collier County, as well as the numbers of employees that commute from surrounding areas into Collier to work each day. This subsequent traffic congestion and the lack of housing that is affordable to working families and our special needs populations negatively impact the quality of life in our community for all of us. The CHP included over 20 land use and transportation recommendations of which eleven (11) have been implemented to date. However, even with these successes, much work remains as the county continues towards build-out. Much of the remaining build-out of Collier County will occur in the “Rural Lands” of the RLS and RFMUD areas. AHAC members recommend that all future developments of towns and villages be required to address the housing affordability demand that will be created as a result of new employment and housing created in rural, eastern Collier. In years past, such an analysis was a requirement built into State Law which provided a safeguard for local governments, as well as a check and balance on development (Development of Regional Impact- DRI). However, those regulations were removed by the State during the economic recession, leaving each jurisdiction to analyze and approve or deny large scale development according to local regulations and requirements. The AHAC and the Board have already successfully incorporated regulations into our local Plans and Codes that encourage and require new developments to address housing affordability. However, without a Housing Needs Analysis, it cannot be determined if future growth will meet those applicable Sections of our Growth Management Plan and Land development Code, specifically as highlighted below: 1.A.2 Packet Pg. 17 Attachment: AHAC Meeting Agenda - December 2, 2019 (11105 : Affordable Housing Advisory Committee - December 2, 2019) Housing Element of the Comprehensive Growth Management Plan Goal 1: To create an adequate supply of decent, safe, sanitary, and Affordable Housing for all residents of Collier County. Objective 1: Provide new affordable housing units in order to meet the current and future housing needs of legal residents with very-low, low, moderate and affordable workforce incomes, including households with special needs such as rural and farmworker housing in rural Collier County. Objective 2: Increase the number of affordable housing units, by the methods contained in Objective 1 and subsequent Policies, for very-low, low, moderate and affordable workforce income residents with the assistance of for-profit and not-for-profit providers of affordable housing, within the County and its municipalities. Policy 2.2: Partnerships shall be encouraged between private developers, non-profit entities, local governments and other interested parties to ensure the development of housing that meets the needs of the County’s very-low, low, moderate and affordable workforce income residents. Future Land Use Element of the Comprehensive Growth Management Plan Policy 4.7.2: Villages are primarily residential communities with a diversity of housing types and mix of uses appropriate to the scale and character of the particular village………Design criteria for Villages shall be included in the LDC Stewardship District. Land Development Code 4.08.07 - SRA Designation J. Design Criteria. 3. Village Design Criteria. a. General criteria. iv. Offer a range of housing types and price levels to accommodate diverse ages and incomes. Accessory dwelling units shall not count towards the maximum allowed density. AHAC Policy Recommendation The Affordable Housing Advisory Committee strongly recommends, as do the ongoing RLSA re-study recommendations, that the Board require all future towns and villages to prepare a Housing Needs Analysis to determine the impact their developments will have on the need for additional housing that is affordable for all community members and to determine compliance with existing polices and codes. Absent of a Housing Needs Analysis, the Board should seek developer commitments to address Housing Affordability in these new towns and villages in order to ensure compliance with our existing policies and codes.
