RESOLUTION NO. 2006- 167
A RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDA, TO CORRECT A SCRIVENERS ERROR IN THE LEGAL
DESCRIPTION FOR PARCELS 122 AND 123 IN THE RESOLUTION NO. 2006-39,
AUTHORIZING CONDEMNATION OF RIGHT-OF-WAY FOR COUNTY BARN ROAD
FROM DAVIS BOULEVARD TO RATTLESNAKE HAMMOCK ROAD. (CAPIT AL
IMPROVEMENT ELEMENT NO. 33, PROJECT NO. 60101).
WHEREAS, the Board of County Commissioners of Collier County, Florida, adopted Resolution
No. 2006-39 on February 14,2006, upon presentation of Item lOC of the agenda, which authorized the
condemnation of right-of-way for the four-laning of County Barn Road from Davis Boulevard to
Rattlesnake Hammock Road; and
WHEREAS, the Board of County Commissioners intended to take the property depicted by the
sketches for Parcels 122 and 123 of Resolution No. 2006-39; and
WHEREAS, the legal descriptions for Parcel 122 and 123 do not reflect the property depicted by
the sketches; and
WHEREAS, the legal description for Parcel 122 (Page 34 of 61 of Exhibit "A" to Resolution No.
2006-39) was intended to describe the sketch of Parcel 122 , (Page 33 of 61 of Exhibit "A" to Resolution
No. 2006-39), it instead incorrectly described said parcel as "The East 25 feet of that parcel recorded in
Official Records Book 1245 Page 902 Public Records of Collier County;" and
WHEREAS, the deed recorded in Official Records Book 1245, Page 902, of the Public Records of
Collier County does not accurately describe the parent tract from which Parcel 122 must be acquired; and
WHEREAS, the correct legal description of Parcel 122 is The West 25 feet of the East 75 feet of
the South One Half (1/2) of the North One Half (1/2) of the North One Half (112) of the Northwest
Quarter (1/4) of the Southwest Quarter (114) of Section 8, Township 50 South, Range 26 East, Collier
County, Florida; and
WHEREAS, the legal description for Parcel 123 (Page 36 of 61 of Exhibit "A" to Resolution No.
2006-39) was intended to describe the sketch of Parcel 123, (Page 35 of 61 of Exhibit "A" to Resolution
No. 2006-39), it instead incorrectly described said parcel as "The East 25 feet of that parcel recorded in
Official Records Book 1072 Page 875 Public Records of Collier County;" and
WHEREAS, the deed recorded in Official Records Book 1072, Page 875, of the Public Records of
Collier County does not accurately describe the parent tract from which Parcel 123 must be acquired; and
WHEREAS, the correct legal description of Parcel 123 is the West 25 feet of the East 75 feet of
the North One Half (112) of the North One Half (112) of the North One Half (1/2) of the Northwest
Quarter (1/4) of the Southwest Quarter (1/4) of Section 8, Township 50 South, Range 26 East, Collier
County, Florida; and
WHEREAS, the location, the dimensions and the area of Project Parcel No. 122 remains
unchanged (containing 0.10 acres, more or less), and
WHEREAS, the location, the dimensions and the area of Project Parcel No. 123 remains
unchanged (containing 0.10 acres, more or less), and
WHEREAS, these scrivener's errors do not affect the validity of the Board's authorization to
condemn the property required for the construction of County Barn Road as given by Resolution No.
2006-39; and
WHEREAS, it is the Board's desire to clarify the record by correcting these scrivener's errors.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLLIER COUNTY, FLORIDA, that:
1. The County intended to take the property depicted by the Sketches for Parcels 122
and 123. (See Exhibit "A" attached hereto and made a part hereof).
2. The legal description of the Perpetual, Non-exclusive Road Right-of-Way, Drainage,
Utility and Maintenance Easement identified as Project Parcel No. 122 is The West
25 feet of the East 75 feet of the South One Half (112) of the North One Half (112) of
the North One Half (112) of the Northwest Quarter (1/4) of the Southwest Quarter
(1/4) of Section 8, Township 50 South, Range 26 East, Collier County, Florida (see
Exhibit "B" attached hereto and made a part hereof).
3. The legal description of the Perpetual, Non-exclusive Road Right-of-Way, Drainage,
Utility and Maintenance Easement identified as Project Parcel No. 123 is The West
25 feet of the East 75 feet of the North One Half (112) of the North One Half (112) of
the North One Half (112) of the Northwest Quarter (114) of the Southwest Quarter
(114) of Section 8, Township 50 South, Range 26 East, Collier County, Florida (see
Exhibit "C" attached hereto and made a part hereof).
4. Except as corrected and clarified herein, Resolution No. 2006-39 shall remain in full
force and effect as of the date of its adoption, February 14,2006.
This Resolution, adopted on this JS7.!!:.. day of TUL..j ,2006, after motion, second
and majority vote favoring adoption.
