EXECUTIVE SUMMARY
Recommendation to approve and execute documents necessary for the conveyance of a utility
easement on County property located at the Naples Zoo, 1590 Goodlette-Frank Road, to the City of
Naples, at no cost to the County.
OBJECTIVE: To convey a utility easement to the City of Naples for potable and irrigation water
infrastructure installed on County property.
CONSIDERATIONS: On June 12, 2012, approval was given by the Collier County Board of County
Commissioners (Board) under Agenda Item #16D8, to proceed with the construction of an expansion of
the Naples Zoo. Within the projected scope of work, the project included the installation of a new fire line
fed by irrigation water and a new potable water line and meter. The utility facilitie s constructed are
located within the Naples Zoo leased property owned by Collier County and consist of new connections
to the existing potable and irrigation water mains owned and maintained by the City of Naples.
The City of Naples Utilities Department currently provides the water and irrigation water utility services
in the area and will be providing the additional utility services to the newly installed fire and potable
water lines at the Naples Zoo. As a condition to providing these services, the water line facilities need to
be conveyed to the City of Naples for service and maintenance on the lines.

FISCAL IMPACT: The costs associated with the infrastructure installed and the related construction has
been paid by the Naples Zoo. The total cost for recording the utility easement will be paid by the Naples
Zoo. The Naples Zoo will also be responsible for future related water and irrigation water utility charges.
GROWTH MANAGEMENT IMPACT: The Naples Zoo is inventoried in the Collier County Growth
Management Plan. The conveyance of these facilities is consistent with the Growth Management Plan.
LEGAL CONSIDERATIONS: The Utility Easement document has been reviewed and approved for
form and legality and requires a majority vote for Board action. -JAB
RECOMMENDATION: To approve the Utility Easement and authorize the Chairman to execute the
aforementioned document; and also, for the Board to direct the County Manager or his designee to
proceed to follow all appropriate closing procedures and record the aforementioned documents in the
Public Records of Collier County, Florida.

20'19, by COLLIER COUNTY, a political subdivision of the State of Florida, whose post office
address is 3335 Tamiami Trail East, Suite 101, Naples, Florida 341'12, hereinafter referred to
as "Grantor", to the CITY OF NAPLES, a municipal corporation of the State of Florida, its
successors and assigns, whose post office address is 735 8th Street South, Naples, Florida
34102, hereinafter referred to as "Grantee".
WITNESSETH:
Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable
consideration paid by the Grantee, the receipt and sufficiency of which is hereby acknowledged,
hereby conveys, grants, bargains and sells unto the Grantee, its successors and assigns, a
perpetual, non-exclusive easement, license, and privilege for utility purposes, on the following
described lands located in Collier County, Florida, to wit:
See attached Exhibit "A" which is
incorporated herein by reference.
Subject to easements, restrictions, and reservations of record.
TO HAVE AND TO HOLD the same unto the Grantee together with the right to enter
upon said land, excavate, and place or remove materials for the purpose of constructing,
operating, and maintaining utility facilities thereon. Grantor and Grantee are used for singular
or plural, as the context requires.
