EXECUTIVE SUMMARY
Recommendation to approve the Fourth Amendment to Agreement No. 17-7198 for
Construction Management at Risk (“CMAR”) contract Phase 1B - Guaranteed Maximum
Price (“GMP”) No. 3 Horizontal and Vertical Work Package to Manhattan Construction
for the next phase of the Sports Complex and Events Center (“SCEC”) in the amount of
$19,665,469.
OBJECTIVE: To continue the construction of the Board approved SCEC through a planned amendment
to the existing CMAR contract to incorporate the next construction phase.
CONSIDERATION: On February 13, 2018 (Agenda Item 16.D.21), the County entered into an
Agreement with Manhattan Construction, Inc., for CMAR services for all preconstruction phases for the
Collier County Sports and Special Events Complex. The process contemplated using individual contract
amendments for each subsequent GMP construction phase. Each phase will clearly identify the terms and
conditions specific to that phase including the fees charged by the construction manager. This phased
approach allows the County to accelerate the project and carefully manage the project within the budget
parameters adopted by the Board. It also maintains strict controls over the relationship between the
owner, construction manager, and design team.
The CMAR process continues to be the most transparent and effective way to manage a complex multi-
phase project of this size and scope. In this process, the contractor participates in design meetings and
identifies high value items that need to be scope managed and features that the design professional desires
but may be unaffordable to the project budget. More importantly, the CMAR approach is an “open book”
delivery system where the owner (the County) sees all transactions and pays only the actual costs paid by
the construction manager. Additionally, the construction manager provides a guaranteed maximum price
for the job. In this project, both the hard construction costs and soft costs are capped independently within
the GMP. The contractor has the flexibility within each cap to adjust values but may not transfer funds
between hard costs and soft costs.
On September 25, 2018 (Agenda Item 11.B), the County entered into the First Amendment to Agreement
No. 17-7198 with Manhattan Construction for work for Phase 0 that included the preparatory work
required in anticipation of Phase 1 where the infrastructure and fields will be installed on the City Gate
parcel owned by the County. Phase 0 included the preponderance of land clearing, full lake excavation, a
construction access road, and preliminary drainage work.
On March 26, 2019 (Agenda Item 11.C), the County entered into the Second Amendment to Agreement
No. 17-7198 with Manhattan Construction for work for Phase 1A. The delivery team has continued to
move the project forward based on prior Board guidance. Phase 1A is well underway, on schedule, and
within budget. Phase 1A completes the primary underground utility work on the City Gate parcel,
provides 5 fields (4 turf, 1 grass), maintenance building, welcome center, market, and restrooms. This
phase also completes City Gate Boulevard South, main entrance improvements on City Gate Boulevard
North, and parking for this phase. This phase is expected to be completed in May of 2020 and is followed
by an overlapping phase for the stadium and Great Lawn (Phase 1B). Subsequent to Phase 1A and 1B, the
next phase (Phase 2) of the complex on Collier County’s adjacent property (CC305 Parcel) will be subject
to zoning, permits, mitigation, and funding at the time of construction.
On October 22, 2019 (Agenda Item 16.D9), the County entered into the Third Amendment to Agreement
No. 17-7198 with Manhattan Construction to revise and correct the Construction Manager’s Standard
Rates in Exhibit “G” to the CMAR and direct that the Contractor’s current invoices reflecting work in the

categories included in the revised Construction Manager’s Standard Rate Sheet be reimbursed, as
appropriate, for services provided.
The tables below depict the actual and forecast construction values (Hard Costs), the various fees and
other costs indirectly associated with construction (Soft Costs), and projected revenues funding the
project.

In order to minimize expenditures in phase 1B, the stadium has been scaled back to the greatest extent
possible. The Great Lawn has been enhanced to include a food truck pavilion and fitness area intended to
exploit the functionality of the area and maximize future revenues. The theater/stage area has been
designed to complement both events inside the stadium to the south and with the flexibility to program
events to the north facing the Great Lawn. The field house is being planned, but the decision to move
forward will be brought back to the Board when the final budget has been refined at the end of all field
construction phases.
As we complete Phase 1B and move into Phase 2 on the Collier County 305 property, we anticipate a
construction value to budget variance of approximately eight (8) to twelve (12) million dollars. This
variance is primarily due to the high cost of fill material, soft costs being covered from the construction
budget, and higher than anticipated construction values. Additionally, the County has not yet secured a
naming rights partner at this time. There are several areas that we can attempt to r ebalance the job to
available budget which include the following:
1. Reduce the number of buildings and move to prefabricated structures for the remaining
buildings;
2. Eliminate the future area reserved for little league/youth baseball and excavate that location

to take advantage of the fill material on site;
3. Reduce the number of fields to be built at this time and construct them later; and
4. Eliminate the campground area.
Staff does not recommend option 3. The prior Hunden study of facility needs a nd the current facility
manager, Sports Field Inc., do not recommend reducing the number of fields. The other options can be
evaluated prior to bid or placed as bid alternates when Phase 2 receives State and Federal permits and
zoning is complete. Additionally, Phase 2 will be broken out and sequenced to complete the City Gate
Boulevard North/Benfield Road phase to include clearing, grubbing, and lake excavation of the entire
CC305 land as a stand-alone phase. This is identical to the way the project was st arted with Phase 0 and
has proven to be a cost-effective way to stage construction.
We expect the permitting for Phase 2 to be completed in mid-2020 with road construction beginning soon
after. The final construction stage of Phase 2 will be bid in early 2021 or sooner. Tourist Development
Tax (TDT) revenue is currently tracking seven (7) to ten (10) percent above plan. Allocating that
additional revenue to construction over the next five years will offset most of the increased construction
cost for Phase 2.
Once all the construction values have been finalized for Phase 2, the Board will be able to evaluate the
viability of the field house in Phase 3. With respect to the field house in Phase 3, the County has
submitted a grant application for the field house to serve as a shelter and is also seeking an appropriation
from the State to make the field house a dedicated shelter with senior and special needs capacity. Funds
were also identified in the Sales Tax for hurricane resiliency and can be used in this phase.
FISCAL IMPACT: The source of funds is from Tourism Division Capital Projects Fund 758. Funding
has been appropriated for this Project No. 50156 (Sports Complex).
Construction of facilities at the Amateur Sports Complex will be paid from $65.45 million in bond
proceeds which were deposited into the Sports Complex Capital Fund (370) on or about October 24,
2018. The sale of these bonds was sized around a $3,750,000 debt service limit imposed by the Board
during deliberations on Ordinance 2017-35 which provided for an additional 1% Tourist Development
Tax (TDT) and related Tourist Development Plan. The remaining dollars generated from the 1% increase
in the TDT tax, will pursuant to the plan, dedicate additional dollars to beach re-nourishment and
maintain funding levels for destination marketing and County owned and operated museums.
The General Fund is responsible for funding Sports Complex land acquisition under the concept that the
facilities will be enjoyed by Collier County residents as well as for tournament caliber sports events. This
$12.1 million to acquire the primary 61.1+/- acre primary parcel and $975K to purchase an adjacent 4.8-
acre parcel for future Sport’s Complex use. In the event of any funding gap which may exist as facilit ies
are constructed and funds drawn down, the Board will be briefed, and options provided to close any
funding shortfall.
With respect to the impact fees to be assessed for the Amateur Sports Complex, the fees will be calculated
in accordance with Section 74-202 (l) of Chapter 74 of the Collier County Codes of Laws and Ordinances
(The Collier County Consolidated Impact Fee Ordinance), which provides for the calculation of impact
fees for land uses not contemplated under the adopted impact fee land use categories. Currently, the rate
schedules do not contain a land use that is applicable to determine the impact fees for the Sports
Complex. Therefore, staff will work with the County’s Impact Fee Consultants (Tindale-Oliver) to utilize
the adopted impact fee methodologies to calculate the impact fees in accordance with the Code
requirements. Impact fees for Phase 1 are currently estimated at $750,000, which will be validated as
additional information is provided through the building permit process.

With respect to the fees in the contract for the Construction Manager (CM), they have been modified
slightly. The CM initially requested 4.5% fee for the project. Staff negotiated a 3.5% fee for both Phase 0
and Phase 1A. For Phase 1B, the CM once again requested a 4.5% fee. Staff reviewed the recent market
rates and considered the City of Naples project and agreed to 4% (back-up attached). The .5% increase to
fee causes a net increase to the job of approximately $83,500. With respect to hourly rates, the CM
requested increases across the board ranging from 5% to 20%. The CM noted that their rates increase
annually in all their markets each year and they have not in this project. Staff agreed to a 3% increase in
rates. While one would surmise that it would have an impact to Phase1B, it does not as the General
Conditions (staff time on the job) maximum was negotiated to approximately 5% of construction value
prior to the agreed upon rate increase. This increase in rates will only impact Phase 1B if the County adds
time to the job. It will have a 3% impact in future phases if they are kept the same and if the CM is used
in future phases.
GROWTH MANAGEMENT IMPACT: There is no impact to the Growth Management Plan related to
this action.
LEGAL CONSIDERATIONS: This item is approved as to form and legality and requires majority vote
for Board approval. -SRT

ARCHITECT’S OPINION OF BID RESULTS
The current phase of the overall project includes the following:
Stadium Building and surrounding sitework
Food Truck Pavilion and Surrounding sitework
Fitness Pavilion and surrounding sitework
Great Lawn area
Parker / Mudgett / Smith Architects is satisfied that the bids that have been received by
Manhattan Construction for the vertical construction elements of this phase fairly
represent the current construction market and a reasonable cost of construction for the
project.
The majority of bid packages for the vertical construction had three or more bidding
companies. For the remainder only one bid package, sports lighting, received only one
bid. Though three bids for every package is optimal, it is not common in today’s
construction market across Southwest Florida as there is more demand for sub-
contractors than there are qualified companies.
As mentioned above, the bid package for sports lighting was the only vertical
construction element to receive only one bid. This is due in large part to a year-long
exercise with various sports lighting companies to identify the best product for Collier
County. Part of this exercise included comparing pricing from each of the major
vendors and so therefore was competitive prior to bidding.
The only other bid package that might seem to be out of the ordinary is the electrical
and low voltage package. It represents 10.01percent of the overall project cost. This is
not an unusual figure when we analyze our projects bid in the last 5 years.
Parker / Mudgett / Smith Architects recommends acceptance of the vertical
construction elements of Manhattan’s GMP.

We have received the Bid Tabulation Sheets from the Construction Manager at Risk (CMAR), Manhattan
Construction Company (MCC), and have reviewed the following bid items pertaining to the Phase 1B Horizontal
Construction for the proposed Collier County Sports Complex and Events Center (SCEC). The bulleted documents
below were provided to MCC during the bidding process.
• Scope 2.01 – City Gate Blvd North Streetscaping
• Scope 2.02 – City Gate Commerce Park Tract RL (Multi-purpose Pathway, Etc.)
• Scope 2.03 – City Gate Commerce Park MPUD Perimeter Buffer Construction Plans
• Scope 2.04 – Construction Documents – Great Lawn / Stadium, Etc.
• Scope 2.05 – Great Lawn / Tract RL – Fitness Areas
Upon internal review and meetings with MCC, it is apparent that all of MCC’s sub-contractors are qualified bidders.
The core sub-contractors clearly met all specifications, prepared thorough bids, and met the overall bid
requirements. Formal solicitation took place in October of 2019 with an advertised pre-bid meeting at MCC
offices, which Davidson Engineering attended. MCC received several formal proposals in the major categories
previously outlined. Davidson Engineering reviewed all bids received and found consistency with the monetary
values and material take-offs during reviews. As noted, DE also attended several post-bid meetings with the
CMAR. Material values were found to be consistent with engineering take-offs and estimates. The schedule of
values with unit price breakdowns were also found to be consistent with most of the recent horizontal
construction activity in Collier County.
Based on our review of the overall project scope as outlined in the construction documents, DE supports an award
of the Phase 1B horizontal scope items at the proposed Collier County Sports Complex and Events Center as
presented by Manhattan Construction Company. The Construction Documents noted above should be referenced
or included with the MCC contract as exhibits.
